CITY OF CLERMONT PARKS AND RECREATION
CONTRACT FOR SERVICES
This CONTRACT, entered into this N day of -;Jã 11 tlð 1- ~. , 2000, by and
between the CITY OF ~RMONT, hereinafter referred to as e CITY
, c41.~ J ~ hereinafter referred to as the CONTRACTOR.
NOW THEREFORE, in consideration of the covenants contained herein, the parties
hereto ~gree as follows:
1. The CITY hereby engages the CONTRACTOR for a period beginning

2. The CONTRACTOR shall submit any reports, analyses, and information
regarding the instructional program addressed in the contract as reasonably
requested by the Parks & Recreation Coordinator to City of Clermont, Attn:
Recreation Coordinator P.O. Box 120219, Clermont, Florida 34712-0219.
3. The CONTRACTOR shall adhere to the rules, regulations, policies, and
procedures adopted by the Parks and Recreation Department. This Contract shall
be administered by the Parks and Recreation Department.

4. The Parks and Recreation Department shall provide any necessary information to
the CONTRACTOR so that the CONTRACTOR may perform the services
required under this Contract.
5. The Parks and Recreation Department will be responsible for the registration and
collection of fees ftom each participant in the classes to be performed by the
CONTRACTOR.
6. The CONTRACTOR shall receive compensation for providing said services
during the period of time set forth above in the amount of80% Instructor 120%
City minus any monies spent by the CITY for promotional items and dates
missed by the instructor. The amount of monies rendered will be divided
equally between instructors if there is more than one instructor for the said
service. The total payment being tendered by the CITY to the
CONTRACTOR(S) at the end of the service as described in Paragraph 1.
7. The CITY may terminate the Contract, with or without cause, upon not less than
ten (10) days notice. In the event of Contract termination or abandonment, the
CITY shall be responsible to compensate the CONTRACTOR and students based
upon the number of class hours of instruction by the CONTRACTOR.

8. For purposes of this Contract and any services rendered hereunder, it is hereby
understood and agreed that the CONTRACTOR shall be an independent
contractor and shall not be classified as or considered, an agent or employee of
the CITY OF CLERMONT.
The CONTRACTOR shall not be entitled to participate in group life or health
insurance programs or pension plans or the CITY and shall not be covered under any
fiinge benefits of the CITY including, but not limited to: Vacation, Sick Leave,
Pension, Holidays, Unemployment Compensation, and Worker's Compensation. (An
Exception would be a CONTRACTOR who is also a dependent of a CITY
employee). Nothing in this contract would ÙIlpair any benefits the CONTRACTOR
would enjoy as a dependent of a CITY employee.
9. The CONTRACTOR shall maintain during the tenn of this Contract
comprehensive general liability insurance with limits of $300,000 per occurrence,
combined single limit for bodily injury liability and property damage liability.
CONTRACTOR shall indemnify, hold harmless, and defend the CITY OF
CLERMONT and its agents and employees from all suits and actions, including
attorney's fees and all cost of litigation and judgments of every name and
description brought against the CITY as a result of loss, damage, or injury to
person or property by reason of any act or failure to act by CONTRACTOR, its
agent, servants, or employees.

10. The CONTRACTOR must make all legally required payments for Federal taxes,
including, but not limited to: Social Security and Federal Income Tax. The CITY
will not provide Worker's Compensation Insurance. It will be the responsibility
of the CONTRACTOR to purchase his/her own Worker's Compensation
Insurance, as applicable.
