SPECIAL COUNCIL MEETING
DECEMBER 19, 1995
A special meeting of the City Council of the City of Clermont was held Tuesday,
December 19, 1995 in the Council Chambers. The meeting was called to order at
7:30 p.m. by Mayor Pool with the following Council Members present: Council
Member Cole, Council Member Dupee, Council Member Sargent, and Council
Member Norquist. Also present was City Manager Saunders.
VISITORS WITH BUSINESS
Juanita Beckius - Request for Parking Variance
City Manager Saunders stated that the Beckius' are requesting a parking variance for a
proposed combination commercial and residential structure to be located at the north-
west corner of 7th Street and DeSoto Street. They are also requesting a pro-rated
payment for the off-site parking fees.
Mayor Pool stated that the request requires that a Quasi-Judicial hearing be held and
that anyone wishing to speak in favor of or in opposition to the request must be sworn
in. The following were sworn in:

Juanita Beckius stated there are two parts of the parking variance request. The first
part consists of eliminating eight of the required spaces. She stated that the four
apartments to be located on the second floor will be occupied by the first floor store
owners, and additional parking would be a duplication. The second part of the request
is to spread the payments out for the off-site parking fees with 1/3 to be paid at the
time of issuance of the building permit, 1/3 12 months from the date of the building
permit, and the final payment 24 months from the date of the building permit.
Mayor Pool asked for any other comments. Don Burris asked how many total spaces
are required. City Manager Saunders stated that 40 are required and that the applicant
is proposing to provide 24 on-site spaces, purchase 8 off-site spaces through the one-

time Central Business District parking exchange fee, and requesting for a variance for
elimination of 8 of the required spaces. Mayor Pool then closed the Public Heating.

A motion was made by Council Member Dupee, seconded by Council
Member Sargent, and carried unanimously to approve a parking variance
eliminating 8 of the required 40 spaces and approving a pro-rated
payment for the off-site parking fees. one-third to be paid at the time of
issuance of the building permit, one-third paid 12 months from the date
of the building permit, and the final payment 24 months _from the date of
the btdlding permit.
UNFINISHED BUSINESS
Watson Lawsuit
City Attorney Baird addressed the City Council regarding the Watson lawsuit. He
explained that the City was involved since right-of-way is claimed along Lake Avenue
south of Seminole Street. He presented the original City map and plats that have been
recorded and explained the legal processes that have occurred over the years regarding
this area. Mr. Baird explained that it would be in the City's best interest to negotiate
an agreement regarding the right-of-way since there is no clear indication of the City
having more right-of-way except for a minimum amount of one or two feet on each
side of the pavement.
Mr. Baird suggested that the City accept a negotiated agreement that would provide a
right-of-way which would include the existing 24' of pavement plus 5' on each side of
the pavement with an additional 12' of easement on the east and 4' of easement on the
west.

A motion was made by Council Member Dupee, seconded by Council
Member Cole, and carried unanimously to agree to the above suggested
settlement.
