REGULAR COUNCIL MEETING
NOVEMBER 28, 1995
A regular meeting of the City Council of the City of Clermont was held Tuesday,
November 28, 1995 in the Council Chambers at the Police Department. The meeting
was called to order at 7:30 p.m. by Mayor Pool with the following Council Members
present: Mayor Pro Tern Norquist, Council Member Cole, Council Member Dupee,
and Council Member Sargent. Other City officials present were City Manager
Saunders, City Attorney Baird, Finance Director Van Zile, and Deputy City Clerk
Whitlock.
INVOCATION
The Invocation was offered by City Manager Saunders followed by the repeating of
The Pledge of Allegiance to the Flag by all present.
MINUTES
The minutes of the Regular Council Meeting held November 14, the Special Meeting
held November 8, and the Workshop Meeting held October 17, 1995 were approved
as presented.
CITY MANAGER SAUNDERS' REPORT
Recreational Bike Ride December 31
City Manager Saunders stated that Fred Sommers of CFT Sports has requested the use
the Jaycee Beach area and the pavilion on December 31 for a family recreation bicycle
ride beginning at 8:00 a.m. The event has been held for several years and they
estimate 200 participants who will be started in small groups. They also state that no
Public Address system will be used.

/1 motion was made by Council Member Sargent, seconded by Council
Member Norquist, and carried unanimously to approve the use of the
Jaycee Beach area and pavilion to CFT Sports_for the_family recreation
ride scheduled December 31, 1995 at 8.'00 a.m.

Council Workshop
Council Members agreed to hold a Workshop Meeting just prior to the next regular
Council Meeting on Tuesday, December 12, 1995 at 6:30 p.m. in the Council
Chambers at the Police Department to discuss final Clermont Waterfront Park site
plans and 1996 insurance requirements.
Alternate Fuel Grant
City Manager Saunders stated that it is possible to piggy-back on Lake Apopka
Natural Gas' alternate fuel grant application. They are applying for fueling stations
and we can include 7 or 8 vehicle conversions with a cash match of less than $10,000.

A motion was made by Council Member Dupee, seconded by Council
Member Cole, and carried unanimously to approve entering into an
Alternate Fuel Grant Application with Lake Apopka Natural Gas.
COUNCIL MEMBER DUPEE'S REPORT
Council Member Dupee stated she recently attended the Florida League of Cities
Legislative Conference in Tampa. She reported that Senator Matt Meadows, chairman
of the Community Affairs Committee is co-sponsoring a bill to allow partial
assessments a local option. She also reported that a new Water Committee is
considering requiring land development be tied with water availability.
Council Member Dupee invited everyone to the December 1 Orange Blossom
Breakfast at Jenkins Auditorium at 7:30 a.m. and the Light Up Clermont ceremony at
Center Lake December 1 at 7:00 p.m.
MAYOR POOL'S REPORT
Mayor Pool reported that the Open House for Cooper Memorial Library on November
18 was well attended and many special events were held for children.

VISITORS WITH BUSINESS
Mr. & Mrs. William Gural - Garbage Fee Waiver
Mayor Pool stated that Mr. Gural is requesting that the City waive the monthly
garbage collection fee for their residence at 1401 W. Highway 50 which is located in
Emerald Lakes Mobile Home Park.
Mr. Gural stated they are on a limited income and he has permission from his
employer to use the commercial dumpster which they have done for several months.
He asked to be discontinued from City garbage service.
City Manager Saunders stated that Chapter 10 of the City's Code of Ordinances was
written many years ago which requires all property owners to have garbage collection
unless approved otherwise by the City Council. He stated that the City sets its rates
for garbage collection service based on servicing the entire population. To start
arbitrarily allowing property owners to dispose of their garbage through other methods
would have a detrimental affect on the entire system. To his knowledge, the City
Council has not approved to discontinue service in the past. Staff recommends that
the Council not approve this request and also to direct staff to present an amendment
to Chapter 10 that will delete the section that allows for a request to be made to the
City Council for an exception.

A motion was made by Council Member Norquist, seconded by Council
Member Sargent, and carried unanimously to deny waiving the garbage
collection fee for Mr. & Mrs. William Gural
Juanita T. Beckius - Resolution No. 888
City Manager Saunders stated that this is a request for a Conditional Use Permit to
allow construction of a combined commercial and multi-family use in the Central
Business District. The site is located on the northwest corner of 7th and DeSoto
Streets.

Mayor Pool stated that the request requires that a Quasi-Judicial hearing be held and
that anyone wishing to speak in favor of or in opposition to the request must be sworn

Tom Beckius presented the proposed building elevation and stated that the first floor
of the building (approximately 6,000 square feet) will be used for retail sales and fou~
apartments will be located on the second floor, one of which will be a rental. The
project requires 16 more parking spaces than they are able to provide, and he asked to
negotiate regarding the cost of those spaces in a future centralized parking area.
City Manager Saunders stated that the Planning & Zoning Commission and staff
recommend approval of the request with the conditions outlined in Resolution No.
888. The required number of parking spaces is a problem, however, a centralized
parking area for additional required parking spaces is allowed in Central Business
District developments. A business will be able to buy into the centralized parking
area. A resolution establishing the cost for the parking area will be presented to the
Council at the next meeting which will allow this development to buy into the future
centralized parking. The proposed cost will be $1,500 per space. He recommended
one change in Section 1 to Resolution No. 888, changing it to "up to four dwelling
units".
Juanita Beckius asked about a waiver or help in buying into the centralized parking
area. City Manager Saunders stated that a waiver or variance regarding parking could
not be addressed at this meeting because the issue had not been legally advertised. If
approval is given to the Conditional Use Permit, a variance request regarding parking
can be requested later.
Mayor Pool closed the public hearing and read Resolution No. 888 by title only..

A motion was made by Council Member Cole, seconded by Council
Member Dupee, and carried unanimously by roll call vote to adopt
Resolution No. 888 with the change in Section 1 of "up to four dwelling
units ".
OLD BUSINESS
Final Reading of Ordinance 284-C
City Manager Saunders stated that this is the final reading for Ordinance No. 284-C
which will provide for revisions to the Fire Pension Plan to increase the benefit
accrual amount from $2 to $5 per month per year of service for Fire Department
retirees. He stated that this was requested by ~the Pension Board and he recommended
its adoption.
Mayor Pool read Ordinance No. 284-C by title only and asked for any comments. No
comments were made and he closed the public hearing.

A motion was made by Council Member Dupee, seconded by Council
Member Cole, and carried unanimously by roll call vote to adopt
Ordinance No. 284-C.
NEW BUSINESS
Bid Award - Wastewater Treatment Facility Painting
City Manager $aunders stated that four quotes for painting of the wastewater treatment
facility were received, as follows:

City Manager Saunders recommended approval of the low bid of Bishop Painting and
Decorating of $3,775.

A motion was made by Council Member Cole, seconded by Council
Member Dupee, and carried unanimously to award the Wastewater
Treatment Facili~_ painting bid to Bishop Painting and Decorating_for
$3.775.
Soccer Field Netting
City Manager Saunders stated that the next soccer season will commence in January
and he would like to move ahead with the installation of the netting at the west end of
the soccer field to prevent balls from entering the water retention area. The cost
would be approximately $1,500. He explained that this was not a budgeted item and
would also require a budget amendment for this year.

A motion was made by Council Member Dupee, seconded by Council
Member Cole, and carried unanimously to approve the installation of the
netting at the west end of the soccer field, and a General Fund Budget
amendment for approximately $1,500.
There being no further business or discussion, the meeting adjourned at 8:08 p.m.
