REGULAR COUNCIL MEETING
SEPTEMBER 12~ 199~
A regular meeting of the City Council of the City of Clermont was held Tuesday,
September 12, 1995 in the Council Chambers at the Police Department. The meeting
was called to order at 7:30 p.m. by Mayor Pool with the following Council Members
present: Mayor Pro Tem Norquist, Council Member Dupee, Council Member Cole,
and Council Member Sargent. Other City officials present were City Manager
Saunders, City Attorney Baird, Finance Director Van Zile, and Deputy City Clerk
Whitlock.
INVOCATION
The Invocation was offered by City Manager Saunders followed by the repeating of
The Pledge of Allegiance to the Flag by all present.
MINUTES
The minutes of the Regular Council Meeting held August 22, 1995, Public Workshop
Meeting held August 15, 1995 and Council Workshop Meetings held July 20 and
August 16, 1995 were approved as presented.
CITY MANAGER SAUNDERS' REPORT
Workshop
Council Members agreed to hold a WorkshOp on Wednesday, September 20 at 6:00
p.m. in the City Hall conference room.
COUNCIL MEMBER DUPEE'S REPORT
League of Cities Meeting
Council Member Dupee stated that the issue of double-taxation by Counties is being
addressed by the League of Cities.

COUNCIL MEMBER COLE'S REPORT
Council Member Cole asked that the excess construction materials, etc. behind South
Lake Plaza Shopping Center be removed.
MAYORAL PROCLAMATIONS
Constitution Week Proclamation September 17-23
Mayor Pool explained that Constitution Week will be observed in Clermont during the
week of September 17-23. He urged that all citizens reflect during the week on the
benefits, privileges and responsibilities of American citizenship.
Industry Appreciation Week September 18-22
Mayor Pool explained that Industry Appreciation Week is observed the week of
September 18-23. He urged residents to salute our industries and their employees for
their contributions to our community.
VISITORS WITH BUSINESS
Julian M. Fogle
City Manager Saunders explained that Mr. Fogle is requesting a variance for side yard
setback on Lot 13 and Lot 24 (927, 929, 937, 939 Disston Avenue) of 7.12', 5.08'
and 5.52' rather than 7.5' required. Mayor Pool stated that the request requires that a
Quasi-Judicial hearing be held and that anyone wishing to speak in favor of or in
opposition to the request must be sworn in. Mr. Eugene Fogle, 13420 Davey Lane,
Clermont was sworn in by City Clerk Van Zile. Mayor Pool opened the Public
Hearing.
Mr. Eugene Fogle stated that two duplexes are presently located on the property that
they want to add 25' to the rear, increasing the apartments from approximately 600
square feet to 1,000 square feet each. He stated that Mr. Montgomery will be the
contractor and he displayed the plans to the Council Members.

City Manager Saunders referred the Council Members to the site plan which shows
the existing two duplexes and the proposed 125' additions to the east. The proposed
additions will not increase the encroachment and the side yards will remain the same.
He stated that the City Council has historically granted this type of variance where no
additional encroachment is made, and he recommended approval. Mayor Pool closed
the Public Heating.

A motion was made by Council Member Cole. seconded by Council
Member Norquist. and carried unanimously to grant a 7.12' sideyard
variance on the north and a 5. 08' sideyard setback on the south of Lot
13, and a 5. 52' sideyard variance on the north of Lot 24.
NEW BUSINESS
Rate Study
City Manager Saunders stated that four proposals had been received in response to
advertising for consultants for a sewer rate study. Two firms were interviewed, which
included Hartman & Associates, Inc. and PRMG, Inc. A bond feasibility report will
also be needed which both firms are very capable of doing.
City Manger Saunders stated that both finns submitted proposals which included their
costs and estimated time to complete both the study and the feasibility report. Both
firms proposals were within $1,000 of each other, however, the firm that we believe
will complete the job in the least amount of time is Hartman & Associates, Inc.
Their bid was $6,900 for the rate analysis and $15,700 for the bond feasibility report.

A motion was made by Council Member Dupee. seconded by Council
Member Cole, and carried unanimously to award the bid to Hartman _,6
Associates, Inc. for the Sewer Rate Study_ ($6,900) and Bond Feasibility
Report (15,700).

Street Striping
City Manager Saunders stated that at the direction of the City Council at the last
meeting, a change order was requested from Sunray Paving for street striping that was
planned to take place next year. The change order amount is $3,169.56 and this will
complete all of the safety bar striping throughout the City.

A motion was made by Council Member Norquist. seconded by Council
Member Sargent, and carried unanimously to approve Change Order #1
to Sunray Paving for additional street striping in the amount of
$3.169.56.
Cooper Memorial Library
City Manager Saunders stated that approval is requested for the following change
orders for Mark Cook Builders for Cooper Memorial Library expansion.

A mort'on was made by Council Member Cole, seconded by Council
Member Dupee, and carried unanimously to approve the above Change
Orders #1. #2. #3. #4. #7. #8, and #9 to Mark Cook Builders.
City Manager Saunders stated that the Library has requested that the old part of the
building be cleaned, the cracks filled, and repainted, including the metal fascia. Mark
Cook Builders bid $7,350. An additional proposal fi.om Professional Painting and
Waterproofing was received for $2,350.

A motion was made by Council Member Dupee, seconded by Council
Member Norquist, and carried unanimously to award the bid to clean,
fill cracks, and repaint the oM part of Cooper Memorial Libra~_ to
Professional Painting and Wate~_ roofing for $2.350.
Lake Community Action Agency - Appointment to Board of Directors
City Manager $aunders stated that Lake Community Action Agency has requested that
we appoint a member to the Board of Directors. Council Member Cole currently
holds this position and has done an excellent job in the past in representing our
community.

A motion was made by Council Member Sargent, seconded by Council
Member Norquist, and carried unanimously to appoint Council Member
Cole to the Board of Directors for Lake Communi~_ Action Agency.
There being no further business or discussion, the meeting adjourned at 8:00 p.m.
