The meeting of the Planning & Zoning Commission was called to order Tuesday July 5, 2011 at
7:00 p.m. by Chair Cuqui Whitehead. Other members present were Robert Boyatt, Bernadette
Dubuss, Nick Jones, Raymond Loyko and Judy Proli. Also in attendance were Curt Henschel,
City Planner, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative Assistant.
MINUTES of the Planning and Zoning Commission meeting held June 7, 2011 were approved
as written.
REPORTS
Commissioner Boyatt asked about the recreational vehicle section that was removed from the
resolution recently submitted for Land Development Code changes.
City attorney Dan Mantzaris stated that the recreational vehicle and trailers amendment will be
revisited and eventually resubmitted.
Commissioner Nick Jones stated that there is a new program called FLSO Season 7 Program.
He stated that the opening concert is scheduled for October 20, 2011 in Mount Dora and October
21, 2011 at South Lake High School at 7:30 pm. He stated that you could call 352-589-1500 for
tickets.
Chairwoman Whitehead stated that she thanks everyone for their prayers for her sister.

City planner Curt Henschel stated that the applicant is requesting a conditional use permit to
operate a house of worship in the C-2 General Commercial zoning district. He stated that this
location had a conditional use permit in 2008 for multi -tenant retail which has been voided due
to lack of activity for over two years.
Mr. Henschel stated that the proposed location has two buildings on lots 1 & 2 which total about
16,400 square feet and are proposed for an auditorium, classrooms and nursery classes during
Sunday worship, and administrative offices. He stated that lots 3 & 4 and associated parking
areas to the west are not to be developed at this time. He stated that the area between the two
existing buildings is proposed to be grassed for outdoor activities and possible playground.

Mr. Henschel stated that parking requirements are based on 1 space per 4 seats. He stated that
the church intends to have approximately 500 members which would require 161 parking spaces,
for which 181 spaces will be provided. He stated that staff believes there will not be any parking
issues on site even with an increase of membership up to about 600 members. He stated that
additional building and parking area is available on lots 3 & 4 for future use as noted on the plan
submitted with the conditional use permit application.
Mr. Henschel stated that staff recommends approval of the request for a conditional use permit to
allow a church facility in this C-2 General Commercial district with the conditional use permit
conditions.
Brian Hammond, 268 Mohawk Rd., stated that they currently own and meet in a facility in
Clermont Commons. He stated that this new location will allow them adequate space and
parking for expansion. He stated that they have talked about developing the other two lots in the
future. He stated that the church will occupy the two buildings that have been empty for a while
now.
Commissioner Boyatt asked if there will be any other tenants at this location.
Mr. Hammond stated that the church would be the only tenant. He stated that the smaller of the
two buildings would be for the children ministry services and the larger building would be used
for their auditorium and staff offices.
Commissioner Boyatt asked if they meet on Wednesday's.
Mr. Hammond stated that they may have some gatherings on Wednesday's, but right now they
only meet on Sunday's due to space and scheduling issues.
Commissioner Dubuss stated that she knows what the traffic is like during rush hour in that area.
Mr. Hammond stated that they do not have a mid -week service on Wednesday's and they do not
anticipate adding a mid -week service at this time.
Commissioner Jones asked if the property will be landscaped and improved.
Mr. Hammond stated yes, the landscaping will be completed.
Commissioner Proli asked if this facility will be an extension of an existing church.
Mr. Hammond stated that they will be relocating from the current facility to this location.
Commissioner Proli asked if they currently have a membership of 500 at their current location.

Mr. Hammond stated that yes they have 500 church members at this time.
Commissioner Loyko stated that his only concern was traffic on Hooks Street coming onto
Hancock Road, but they just added a light, so he sees no problems.
Chairperson Whitehead stated that she is glad that someone is interested in those buildings.
Commissioner Dubuss moved to recommend approval of the conditional use permit; seconded by
Commissioner Boyatt. The vote was unanimous to recommend approval for the conditional use
permit to City Council.
There being no further business, the meeting was adjourned at 7:14 pm.

ANALYSIS: The applicant is requesting a conditional use permit to operate a wine
bar located at 712 West Montrose Street. According to the city code, a bar is not
specifically called out under the Conditional Uses within the Central Business District,
and therefore falls under section 122-244 (b) "in case of uncertainty of the classification
of any use, uses may be permitted which, after consideration by the planning and
zoning commission and approval by the city council"
The vacant 1700 square foot building was formerly occupied by Town Digger
Advertising. The proposal is to open an upscale wine/beer bar that will offer live
entertainment, high end wine sales, and serve light snacks and coffee. Hours of
operation are proposed to be from 1:00 p.m. to 11:30 p.m. The hours of operation are
not included within the CUP conditions, and are open for council discretion.

STAFF RECOMMENDATION:
Staff recommends approval of this Conditional Use Permit request to operate a Wine
Bar located at 712 West Montrose Street. with the following conditions as listed.
CUP CONDITIONS:
Section 1 - General Conditions
1. The conditions as set forth in this Conditional Use Permit shall be legally binding
upon any heirs, assigns and successors in title or interest.
2. No further expansion of the use or additions to the facility shall be permitted
except as approved by another Conditional Use Permit.
3. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair,
remove, improve, move, convert, or demolish any building or structure, or alter the land
in any manner within the boundary of the project without first submitting necessary
plans, obtaining necessary approvals, and obtaining necessary permits in accordance
with the City of Clermont Land Development Regulations and those of other appropriate
jurisdictional entities.

4. No business can occupy any portion of the building unless the proposed
business has applied for and obtained a Local Business Tax Receipt from the Clermont
Planning Department.
5. If any of the stated conditions are violated, the applicant understands and agrees
that the City Council may revoke this Conditional Use Permit by resolution.
6. The Conditional Use Permit must be executed and processed through the office
of the City Clerk within 90 days of its date of grant by the City Council or the permit shall
become null and void.
7. The Applicant shall record in the Public Records of Lake County within 90 days
of its date of approval by the City Council, a short -form version of this Conditional Use
Permit as provided by the City or a form acceptable to the City, to provide notice to all
interested parties, the assigns, successors and heirs of the developer/applicant and all
future owners of the above -referenced property that the real property described above
is subject to the terms and conditions of the Conditional Use Permit.
Section 2 — Land Use
1. Permitted uses shall include a Wine Bar at 712 West Montrose Street. Should
the Bar cease operations for more than six (6) months, the owner, applicant any heirs,
assigns and successors in title or interest must apply for a new Conditional Use Permit.
2. No consumption of alcoholic beverages sold from the bar may be consumed
outside, unless otherwise approved by the City.

since it will help them to keep their businesses open until later.

The idea is to start small and learn while keeping the very well paid
day job
We will be a on -premise beer and wine facility with off -premise wine sales.
In addition we will have daily/weekly food pairings to complement the wines.
Mostly "tapas" and cold snacks.
Regular daily menu will include some wine bar "staples" such as cheese and
fruit plates, hard meats, chutneys, chocolates, etc.
We will not be able to compete with the
costco's and large retailers in this segment so we are searching for lesser
known value wines from boutique vineyards.
Average glass of wine will be $6-7 for on -premise consumption. Craft beer
on tap only (i think). Only quality stemware will be used at a fairly large
expense i know. A wine preservation system has been purchased to prolong
the life of an open wine (still or bubbly) bottle to 3-5 weeks. This will allow
us to open expensive wines and give patrons the opportunity to have a glass
that might be out of their reach price wise. Or they simply just want one
glass of said wine. This high -end wine would rotate each month to keep
things interesting for those in this demographic.
Decor will be upscale while not over -the -top. Probably will go with the
French or Tuscany Style. Tiles for flooring open ceiling painted black to open
the small room up a little. Nice wine red or similar paint. Wine storage
around the perimeter walls that will allow it with some free-standing wine
racks spread around the room. Comfortable seating is key.
There will be one flat screen in the lounge room and of course music piped in
(sonos system for some novelty. This will allow the patrons to pick from a
library of music) . For thurs/fri/sat nights there will be live entertainment...
small 1-2 person setups with jazz/blues/light rock/etc. Themes.
There will also be a wine club run from this location. The basement has an
area that will be used for monthly processing of wine club orders.
Looking at local deliveries with xx amount minimum.
Our sub -market is Clermont that we will draw from has an average
household income in the $65,000 range and average age is 32. There is also
is a decent Hispanic market which is an up-and-comer in this wine segment.
We will cater special events to:
• corporate parties and meetings
• bachelorette parties
• retirement parties
• local golf/private club events
• in -home tasting parties
• wine trivia parties with give aways (store credit and/or promotional shirts,
etc.)
• pta, local sports organization fundraisers
• local vineyards to sponsor on -site tastings/learning events (Lakeridge)

ZONING MAP OF THE CITY OF CLERMONT, REFERRED TO IN

ANALYSIS:
The applicant is requesting to rezone this site from R-1 residential to C-1 in order to permit
the processing of a Conditional Use Permit (CUP) for a convenience store and gas station.
The CUP application is being processed concurrently with this rezoning request. The
remainder of the site will also be developed in accordance with the C-1 requirements and
the Land Development Code.
This site was originally approved in 2008 as one portion of a CUP for Kings Crossing. This
development would have allowed a mix of C-1 and office uses. In the past, various uses
were allowed as part of a CUP approval. However, staff recommends that uses be directly
associated with actual zoning districts to avoid any future confusion with allowed uses and
conditional uses within particular zoning districts.
The Future Land Use for this site and the portion to the south is Commercial. The C-1
Light Commercial Zoning District is the lowest level zoning of commercial to match this
land use. Convenience stores and gas stations are required to have a CUP in a C-1 Light
Commercial Zoning District.
The rezoning to C-1 would be consistent with this request and the area as a whole.
The site is well served by the transportation network with access to three streets.

ANALYSIS:
The applicant is requesting a conditional use permit for a gas station and convenience
store located at the Northeast corner of U.S. 27 and Citrus Tower Blvd. Access to the 2.39
acre development will only be from U.S. 27 and two locations off Citrus Tower Blvd. (right-
in/right-out for all three). Two of these are to be shared access with the remaining 3.13
acres of the overall 5.52 acre area.
This site was originally approved in 2008 as one portion of a CUP for Kings Crossing. This
development would have allowed a mix of C-1 and office uses. In the past, various uses
were allowed as part of a CUP approval. However, staff recommends that uses be directly
associated with actual zoning districts to avoid any future confusion with allowed uses and
conditional uses within particular zoning districts. The Kings Crossing CUP is now void
because no development occurred within the two year time frame required.
The Future Land Use for this site and the portion to the south is Commercial, and the C-1
Light Commercial Zoning District is the lowest level zoning of commercial to match this
land use. Convenience stores and gas stations are required to have a Conditional Use
Permit (CUP) in a C-1 Light Commercial Zoning District.
The site is well served by the transportation network with access to three streets.
STAFF RECOMMENDATION: Staff believes this development is consistent with the
uses in the area and recommends approval of this Conditional Use Permit request for a
gas station and convenience store with the following CUP conditions as listed.
CUP CONDITIONS:
Section 1 - General Conditions
1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any
heirs, assigns and successors in title or interest.
2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove,
improve, move, convert, or demolish any building or structure, or alter the land in any manner
within the boundary of the project without first submitting necessary plans, obtaining
necessary approvals, and obtaining necessary permits in accordance with the City of Clermont
Land Development Regulations and those of other appropriate jurisdictional entities.
No business can occupy any portion of the building unless the proposed business has applied
for and obtained a Local Business Tax Receipt from the Planning & Zoning Department.
4. If any of the stated conditions are violated, the applicant understands and agrees that the City
Council may revoke this Conditional Use Permit by resolution.
5. The Conditional Use Permit must be executed and processed through the office of the City
Clerk within 90 days of its date of grant by the City Council or the permit shall become null
and void.
6. The Applicant shall record in the Public Records of Lake County within 90 days of its date of
approval by the City Council, a short -form version of this Conditional Use Permit as provided
by the City or a form acceptable to the City, to provide notice to all interested parties, the
assigns, successors and heirs of the developer/applicant and all future owners of the above -
referenced property that the real property described above is subject to the terms and
conditions of the Conditional Use Permit.
7. This permit shall become null and void if substantial construction work has not begun within
two (2) years of the date the Conditional Use Permit is executed and signed by the appropriate
parties. Substantial construction work means the commencement and continuous construction
of required improvements ultimately finalized at completion.
8. The applicant shall be required to submit a formal site plan for review and approval by the
City staff. The project shall be designed in substantial accordance with the plan presented at
the preliminary site review meetings and public hearings with the exception of modifications
necessary to comply with final CUP conditions.
9. The structure shall be inspected by the Fire Marshall for life safety requirements. All
requirements must be met prior to any Certificate of Occupancy being issued.
10. The structure shall be inspected by the City Building Inspector and all building code violations
must be corrected prior to a Certificate of Occupancy being issued.
11. An emergency generator shall be installed to allow continuous operation of the gas station in
the event of any power shortages.
12. Extension of the 12 inch ductile iron water main on the northeast side of the property to U.S.
27 shall be completed prior to final Certificate of Occupancy.
Section 2 — Land Use
1. Permitted uses shall include a gas station with up six fuel islands for 12 fueling stations and a
convenience store.
Section 3 - Transportation Improvements:
The developer shall provide the following transportation improvements:
Access to U.S. 27 and Citrus Tower Blvd. shall be approved by the applicable state and local
agencies and meet all codes as required.
2. A traffic study shall be required to address level of service (LOS) for the area, including any
connection to U.S. 27 and Citrus Tower Blvd. as needed per Code or policy. FDOT and City of
Clermont shall determine if any deceleration turning lane would be required for access.
Installation shall be at the developer's cost.

Section 4 - Architectural Design:
All structures shall be designed and constructed in accordance with the Architectural Standards of
the City of Clermont. In addition, the following shall be allowed:
1. All fencing within public view shall be ornamental metal or brick, as approved by the City's
Site Review Committee. Chain link fencing shall be prohibited.
2. Direct exposed view neon tubing and scrolling text message boards are prohibited. Neon
tubing shall not be utilized for building trim or accent areas.
3. Signage shall not be allowed on the canopy covering the pumps. All other signage shall
comply with applicable codes.
