City of Clermont MINUTES PLANNING AND ZONING COMMISSION J U LY 5, 2011 Page 1 The meeting of the Planning & Zoning Commission was called to order Tuesday July 5, 2011 at 7:00 p.m. by Chair Cuqui Whitehead. Other members present were Robert Boyatt, Bernadette Dubuss, Nick Jones, Raymond Loyko and Judy Proli. Also in attendance were Curt Henschel, City Planner, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative Assistant. MINUTES of the Planning and Zoning Commission meeting held June 7, 2011 were approved as written. REPORTS Commissioner Boyatt asked about the recreational vehicle section that was removed from the resolution recently submitted for Land Development Code changes. City attorney Dan Mantzaris stated that the recreational vehicle and trailers amendment will be revisited and eventually resubmitted. Commissioner Nick Jones stated that there is a new program called FLSO Season 7 Program. He stated that the opening concert is scheduled for October 20, 2011 in Mount Dora and October 21, 2011 at South Lake High School at 7:30 pm. He stated that you could call 352-589-1500 for tickets. Chairwoman Whitehead stated that she thanks everyone for their prayers for her sister. 1. REQUEST FOR CONDITIONAL USE PERMIT APPLICANT/OWNER: PROJECT: REQUESTED ACTION: GENERAL LOCATION: EXISTING ZONING: EXISTING LAND USE: Trustco Bank/Brian Hammond The Church at South Lake Request for a Conditional Use Permit 2500 & 2525 Hooks Street C-2, General Commercial Commercial City planner Curt Henschel stated that the applicant is requesting a conditional use permit to operate a house of worship in the C-2 General Commercial zoning district. He stated that this location had a conditional use permit in 2008 for multi -tenant retail which has been voided due to lack of activity for over two years. Mr. Henschel stated that the proposed location has two buildings on lots 1 & 2 which total about 16,400 square feet and are proposed for an auditorium, classrooms and nursery classes during Sunday worship, and administrative offices. He stated that lots 3 & 4 and associated parking areas to the west are not to be developed at this time. He stated that the area between the two existing buildings is proposed to be grassed for outdoor activities and possible playground. He stated that the church intends to have approximately 500 members which would require 161 parking spaces, for which 181 spaces will be provided. He stated that staff believes there will not be any parking issues on site even with an increase of membership up to about 600 members. He stated that additional building and parking area is available on lots 3 & 4 for future use as noted on the plan submitted with the conditional use permit application. Mr. Henschel stated that staff recommends approval of the request for a conditional use permit to allow a church facility in this C-2 General Commercial district with the conditional use permit conditions. Brian Hammond, 268 Mohawk Rd., stated that they currently own and meet in a facility in Clermont Commons. He stated that this new location will allow them adequate space and parking for expansion. He stated that they have talked about developing the other two lots in the future. He stated that the church will occupy the two buildings that have been empty for a while now. Commissioner Boyatt asked if there will be any other tenants at this location. Mr. Hammond stated that the church would be the only tenant. He stated that the smaller of the two buildings would be for the children ministry services and the larger building would be used for their auditorium and staff offices. Commissioner Boyatt asked if they meet on Wednesday's. Mr. Hammond stated that they may have some gatherings on Wednesday's, but right now they only meet on Sunday's due to space and scheduling issues. Commissioner Dubuss stated that she knows what the traffic is like during rush hour in that area. Mr. Hammond stated that they do not have a mid -week service on Wednesday's and they do not anticipate adding a mid -week service at this time. Commissioner Jones asked if the property will be landscaped and improved. Mr. Hammond stated yes, the landscaping will be completed. Commissioner Proli asked if this facility will be an extension of an existing church. Mr. Hammond stated that they will be relocating from the current facility to this location. Commissioner Proli asked if they currently have a membership of 500 at their current location. Commissioner Loyko stated that his only concern was traffic on Hooks Street coming onto Hancock Road, but they just added a light, so he sees no problems. Chairperson Whitehead stated that she is glad that someone is interested in those buildings. Commissioner Dubuss moved to recommend approval of the conditional use permit; seconded by Commissioner Boyatt. The vote was unanimous to recommend approval for the conditional use permit to City Council. There being no further business, the meeting was adjourned at 7:14 pm. According to the city code, a bar is not specifically called out under the Conditional Uses within the Central Business District, and therefore falls under section 122-244 (b) "in case of uncertainty of the classification of any use, uses may be permitted which, after consideration by the planning and zoning commission and approval by the city council" The vacant 1700 square foot building was formerly occupied by Town Digger Advertising. The proposal is to open an upscale wine/beer bar that will offer live entertainment, high end wine sales, and serve light snacks and coffee. Hours of operation are proposed to be from 1:00 p.m. to 11:30 p.m. The hours of operation are not included within the CUP conditions, and are open for council discretion. Needs flooring/bar back/lighting and paint-decor/seating/etc. The idea is to start small and learn while keeping the very well paid day job We will be a on -premise beer and wine facility with off -premise wine sales. In addition we will have daily/weekly food pairings to complement the wines. Mostly "tapas" and cold snacks. Regular daily menu will include some wine bar "staples" such as cheese and fruit plates, hard meats, chutneys, chocolates, etc. We will not be able to compete with the costco's and large retailers in this segment so we are searching for lesser known value wines from boutique vineyards. Average glass of wine will be $6-7 for on -premise consumption. Craft beer on tap only (i think). Only quality stemware will be used at a fairly large expense i know. A wine preservation system has been purchased to prolong the life of an open wine (still or bubbly) bottle to 3-5 weeks. This will allow us to open expensive wines and give patrons the opportunity to have a glass that might be out of their reach price wise. Or they simply just want one glass of said wine. This high -end wine would rotate each month to keep things interesting for those in this demographic. Decor will be upscale while not over -the -top. Probably will go with the French or Tuscany Style. Tiles for flooring open ceiling painted black to open the small room up a little. Nice wine red or similar paint. Wine storage around the perimeter walls that will allow it with some free-standing wine racks spread around the room. Comfortable seating is key. There will be one flat screen in the lounge room and of course music piped in (sonos system for some novelty. This will allow the patrons to pick from a library of music) . For thurs/fri/sat nights there will be live entertainment... small 1-2 person setups with jazz/blues/light rock/etc. Themes. There will also be a wine club run from this location. The basement has an area that will be used for monthly processing of wine club orders. Looking at local deliveries with xx amount minimum. Our sub -market is Clermont that we will draw from has an average household income in the $65,000 range and average age is 32. There is also is a decent Hispanic market which is an up-and-comer in this wine segment. CUP CONDITIONS: Section 1 - General Conditions 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. No business can occupy any portion of the building unless the proposed business has applied for and obtained a Local Business Tax Receipt from the Planning & Zoning Department. 4. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 5. The Conditional Use Permit must be executed and processed through the office of the City Clerk within 90 days of its date of grant by the City Council or the permit shall become null and void. 6.
