03-12-1996 Regular Meeting CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING MARCH 12, 1996 A regular meeting of the City Council of the City of Clermont was held Tuesday, March 12, 1996 in the Council Chambers at the Police Department. The meeting was called to order at 7:30 p.m. by Mayor Pool with the following Council Members present: Mayor Pro Tem Norquist; Council Member Dupee; Council Member Cole; and Council Member Sargent. Other officials present were City Manager Saunders, City Attorney Baird, Planning Director Harker, Finance Director Van Zile, and Deputy City Clerk Whitlock. INVOCATION The Invocation was offered by Mayor Pro Tern Norquist followed by the repeating of The Pledge of Allegiance to the Flag by all present. MINUTES The minutes of the Regular Council Meeting held February 27, 1996 were approved as presented. CITY MANAGER SAUNDERS' REPORT Tree City USA City Manager Saunders stated that he received notification from the Dept. of Agriculture that the City of Clermont has been awarded the Tree City USA designation for 1995 and also the Growth Award for 1995. COUNCIL MEMBER DUPEE'S REPORT Council Member Dupee extended an invitation to those present to attend the Chamber of Commerce Breakfast on Friday, March 15 at 7:30 at Jenkins Auditorium. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING MARCH 12, 1996 Page 2 UNFINISHED BUSINESS Final Reading of Ordinance 285-C City Manager Saunders stated that this Ordinance will amend our open air sales permit Ordinance to limit any open air sales permits to one permit per calendar year for a period not to exceed 30 consecutive days. In the past our ordinance allowed the Council to approve open air sales permits for greater than 30 days under certain circumstances. This longer open air permit option will now be deleted. The same exceptions will still apply which include open storage of the sale of automobiles, boats, farming implements and also open air permits in conjunction with established businesses in the Central Business District and shopping centers located in the C-2 zoning districts. Mayor Pool read Ordinance 285-C by title only and asked if anyone present wanted to speak in favor of or against Ordinance 285-C. No one asked to speak. 96-068 A motion was made by Council Member Sargent, seconded by Council Member Cole, and carried unanimously by roll call vote to adopt Ordinance 285-C. NEW BUSINESS Introduction of Ordinance 302-M City Manager Saunders stated that this ordinance will introduce the annexation of approximately 10 acres (Tract 29 of Lake Highlands Subdivision) located east of the North Ridge Subdivision at the northeast corner of Jacks Lake owned by the Crittenden Fruit Company. Current City limits join this property on both the north and the west boundaries. Mayor Pool read Ordinance 302-M by title only. 96-069 A motion was made by Council Member Cole and seconded by Council ..... Member Dupee to introduce Ordinance 302-M. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING MARCH 12, 1996 Page 3 Introduction of Ordinance 303-M City Manager Saunders stated that this ordinance will rezone approximately 10 acres to be annexed in Ordinance 302-M, (Tract 29 of Lake Highlands Subdivision) from UR Urban Estate to R-1 Residential. The property owners have indicated their willingness to enter into an annexation agreement that would place the same restrictions on the lots within this R-1 area that were imposed on the North Ridge Subdivision which joins this property to the west. The R-1 minimum lot size is 7,500 square feet with a 75' minimum lot width and 25' setback. The restrictions would require a minimum 10,000 square foot lot and a minimum lot width of 80' which is a compromise between the R-1 and R-lA districts and would be in keeping with the platted subdivision to the west. This agreement should be included with the final reading of this ordinance. Without the agreement in place, the recommendation would be for R-1-A zoning rather than R-1. Mayor Pool read Ordinance 303-M by title only. 96-070 A motion was made by Council Member Dupee and seconded by Council Member Cole to introduce Ordinance 303-M. Introduction of Ordinance 304-M City Manager Saunders stated that this ordinance will introduce the closing of the eastern end of Palm Street. The closing of this was negotiated with the owners of Bell Ceramics and was a part of the property swap agreement entered into by the Council last month. Another parcel owned by Bell Ceramic will be transferred to the City by deed which will allow the new alignment of Palm Street. Mayor Pool read Ordinance 304-M by title only. 96-071 A motion was made by Council Member Norquist and seconded by Council Member Dupee to introduce Ordinance 304-M. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING MARCH 12, 1996 Page 4 Final plat approval of Clermont Commons City Manager Saunders stated that they are ready to recommend approval of the final plat for Clermont Commons subject to a few items which will not affect the plat. He explained that this is the industrial subdivision being developed on Mohawk Road. Some of these lots will be developed with condominiums. Mr. Joe Zagame explained where the condominiums are planned to be built. City Manager Saunders stated that the subdivision is now ready for platting and he recommended approval. 96-072 A motion was made by Council Member Sargent, seconded by Council Member Cole. and carried unanimously approve the final plat of Clermont Commons. Bid Award - Street Tree Maintenance City Manager Saunders stated that funds have been budgeted for the last two years for on-going tree maintenance. The maintenance is done on trees that were identified in the Street Tree Inventory performed about three years ago. $10,000 has been allocated in this year's budget for removal and pruning and two bids were received for removing 21 Priority 2 trees and hazard reduction pruning of one tree. City Manager Saunders stated that Professional Tree Service entered a bid for $10,225 and the second bid was received from Southeastern Tree for $14,710. Professional Tree Service is the same company that provided the tree service last year and did an excellent job and he recommended awarding the bid to them. 96-073 A motion was made by Council Member Cole, seconded by Council Member Sargent, and carried unanimously to award the tree maintenance bid to Professional Tree Service for $I0,225.
