REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request a Conditional Use Permit to allow an Adult Day Care Facility to be established in the M-1 Industrial Zoning District PROJECT NAME: Lake County Adult Activity Center OWNER: Mercator Properties Inc. PARCEL SIZE: 1 acre +/- FUTURE LAND USE: Industrial EXISTING LAND USE: Commercial/Office Building EXISTING ZONING: M-1 Industrial City Planner Curt Henschel presented the Staff report as follows: The applicant intends to locate an adult day care facility in an office building. The 2,050 square foot unit will be the new home for the Lake County Adult Activity Center. The center will provide a safe place to go during the week to socialize, participate in supervised activities, and receive physical care and monitoring as needed, all while retaining as much independence as possible. Lake County Adult Activity Center was previously approved as a Conditional Use Permit in 2009 at 1172 Grand Highway. This Grand Highway location has now become too small for their growing business, and now proposes to relocate to this site off of Mohawk Rd. as their new potential home. Lake County Adult Activity Center will be a licensed adult day care facility with the capacity of up to 30 adults. Hours of operation will be Monday through Friday from 8:00am to 5:00pm and three employees will staff the facility throughout the day. City of Clermont MINUTES PLANNING AND ZONING COMMISSION SEPTEMBER 4, 2012 Page 2 Staff believes this development is consistent with the uses in the area and recommends approval of this Conditional Use Permit request for an adult day care facility. Carolina Garcia, 13224 Pinyon Dr., stated that she is the director of the activity center and they are seeking permission to operate in this location. Commissioner Loyko asked if the location was on the west side of the building. Ms. Garcia stated that they will be on the west side. Commissioner Jones moved to recommend approval of the conditional use permit to City Council; seconded by Commissioner Dubuss. The vote was unanimous to recommend approval for the conditional use permit to City Council. There being no further business, the meeting was adjourned at 7:07 pm. Due to the unique nature of the memory -care facility, and in order to provide the best care to the residents, the memory care facility is comprised of a one-story building. The applicant is proposed 48 units of this type. The remaining 80 units proposed by the applicant will make up the assisted -living facility covering the balance of the site. A current version of the proposed site plan and building layout is shown in the provided plans. The current land use is commercial. When the property was first annexed, it attained a UE (Holding) zoning. Upon development, the owner understood' from the City of Clermont that the property would be rezoned to a commercial zoning. With this application for the Living Well Lodge development and the proposed adjacent Police Headquarters development, justification now comes forth to re -zone the property to a C-2 zoning designation. The drainage and stormwater retention requirements of the City and the appropriate regulatory agencies shall be met. These areas shall be properly maintained. 8 - Living Well Lodge, CUP 2. If required by the City Engineer, a St. John's River Water Management District stormwater permit shall be required and filed with the City prior to receipt of a building permit or any development activity. 3. Permeability tests must be submitted as part of the stormwater/site plan review process. Permeability shall be maintained. 4. Final disposition of storm water outfall shall be as approved by the City Engineer. Section 4 — Physical Site Development A dust abatement plan shall be submitted to the City detailing measures to be taken in eliminating the migration of dust particles from the site. The plan must specifically outline those measures recommended by Florida Department of Environmental Protection (F.D.E.P.). 2. All disturbed adjacent sites cleared must be sodded, or seeding as approved by the City Engineer and part of the dust abatement plan. 3. The applicant shall submit a detailed excavation, grading and erosion control plan for the site during the site plan review process which must be approved by the City Site Review Committee prior to initiation of development activity. 4. Noise levels during construction shall not exceed those recommended by the Florida Department of Environmental Protection. Any vibratory compaction shall be limited to the hours of 8:00 A.M. to 6:00 P.M. Monday through Saturday only. Vibrations shall be limited to avoid any damages to neighboring persons or properties. Heavy Equipment and normal work operations will be allowed on the site between the hours of 7:00 A.M. and 7:00 P.M. Monday through Saturday.
