The meeting of the Planning & Zoning Commission was called to order Tuesday June 5, 2012 at
7:00 p.m. by Chair Cuqui Whitehead. Other members present were Bernadette Dubuss, William
Henning, Nick Jones, Judy Proli and Raymond Loyko. Also in attendance were Jim Hitt,
Planning and Zoning Director, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative
Assistant.
MINUTES of the Planning and Zoning Commission meeting held May 1, 2012 were approved
as amended.
REPORTS
Chairwoman Cuqui Whitehead stated that she turned in her resignation to run for City Council.
The resignation is not effective until Seat 1 is sworn in for the new election.
1. REQUEST FOR CONDITIONAL USE PERMIT
PROJECT NAME: South Lake Hospital — Multi -purpose Fields
OWNER/APPLICANT: South Lake Hospital, Inc.
REQUESTED ACTION: Request to amend a Conditional Use Permit for a Planned Unit
Development (Res. No. 1551) to allow the addition of four multi-
purpose sports fields.
LOCATION: North of Legends Way, south of Oakley Seaver Dr. and east of
Citrus Tower Boulevard.
FUTURE LAND USE: Public Facilities/Institutional
ZONING: UE (CUP for a PUD)
Planning Director Jim Hitt presented the Staff report as follows:
The applicant is requesting an amendment to their Conditional Use Permit to add four new multi-
purpose sports fields with parking and bathroom facilities. These fields are in addition to the
existing fields and uses previously approved for the overall Hospital site. These fields are to be
developed and used for an indefinite period of time, until the land is developed for medical and
office uses as previously envisioned by past Conditional Use Permits.
There are four fields planned — two on the north side of Legends Way, one on the south side of
Legends Way and one on the new Don Wickham Blvd. extension. The multi -purpose fields are
being built using Lake County grant monies and will be used for youth soccer, college and
international competition teams.
All previous Conditional Use Permit requirements will remain intact where applicable. This
amendment pertains to the new multi -purpose fields. These fields are considered long term, but
the Hospital would still consider them temporary in the long term plan for the site, which will

eventually be for offices and similar uses. Site plans for any proposed changes will still have to
be submitted to the City for proper review and development procedures.
The Hospital would also like to delay the road construction requirement from Legends Way to
S.R. 50 that was part of the previous Conditional Use Permits. This request is outlined in the
new Conditional Use Permit under Section 5 Transportation Improvements #5.
There are four variances associated with this Conditional Use Permit amendment for the multi-
purpose fields which include the following:
➢ Grass parking with stabilized drive isles
➢ Retaining wall higher than six feet
➢ Light poles in excess of 30 feet
➢ Cut and fill in excess of 15 feet
➢ No perimeter buffer landscaping
➢ No parking lot landscaping
Parking is being provided at 60 spaces per field. The proposed Conditional Use Permit conditions
do include a provision that if this proves to be inadequate, the City can reopen the Conditional Use
Permit to address the issue.
Staff believes this is an appropriate location for the multi -purpose fields and associated facilities.
Staff recommends approval of the amendment to the Conditional Use Permit.
Rick McCoy, 606 S. Main Ave., Minneola, stated that the hospital came to him to put in soccer
fields. He stated they will have to some extreme contouring of the land to create a flat ground for
the fields but he feels the fields will be good for the community.
Commissioner Dubuss asked if postponing the road extension will interfere with traffic getting to
the property.
Mr. Hitt stated that the property will be accessible from three different routes so he does not see
this as an issue.
Commissioner Proli asked if the lighting for the fields will be a nuisance for the hotel.
Mr. McCoy stated that the hotel will probably enjoy the fields being there for out of town games
and people who will need hotels.

Commissioner Loyko asked about providing a crosswalk for pedestrians going from the hotel to
the fields.
Mr. McCoy stated that they might end up with a crosswalk because it is a concern, but the fire
station is right there as well so drivers should be slowing down anyways.
Commissioner Loyko asked if this issue needs to be addressed at this time or is it something that
will be addressed when it becomes a concern.
Mr. Hitt stated that he can convey that concern in his motion in regards with the pedestrian
crossing from the hotel to the ball fields.
City attorney Dan Mantzaris stated that a condition can be added to Section 2, Condition 4 which
deals with the parking issues. He stated that adding it to this condition will allow the City to
bring the Conditional Use Permit back to Council if it becomes an issue.
Commissioner Loyko stated that he likes what Mr. Mantzaris just stated.
Chairwoman Whitehead stated that her concern is bus parking.
Mr. McCoy stated that there will be more parking room because they are asking for variances for
grass parking and landscaping so there will essentially be more room to park. He stated that they
will be grading and stabilizing the property so it will support buses. He stated that he feels 60
parking spaces will be enough for the soccer fields.
Chairwoman Whitehead stated that there will need to be room for the buses as well.
Mr. McCoy stated that when the buses come there should be fewer cars. He stated that Legends
Way is city controlled road so if the City wants them to do a school type zone and crossing at the
field location, they will do that.
Commissioner Loyko stated that when he's been at the restaurants near the ball fields when the
games have ended and he has watched hoards of people crossing the road to get to the
restaurants. He stated that he doesn't want to get to the point where they have to put up signs and
flashing lights.
Mr. McCoy stated that it makes people aware that pedestrians maybe crossing.
Commissioner Proli asking if there was plenty of lighting on Legends Way in that area so that
when kids cross the road drivers will see them.
Mr. McCoy stated that they will need to look into the lighting issues for Legends Way.

Commissioner Dubuss moved to recommend approval of the conditional use permit with the
additional language pertaining to the parking and pedestrian traffic, if it becomes an issue the
conditional use permit will be brought back to City Council, seconded by Commissioner Proli.
The vote was unanimous to recommend approval for the conditional use permit to City Council.
There being no further business, the meeting was adjourned at 7:27 pm.

The applicant proposes to occupy approximately 1,200 square feet of retail/ office
space located in Sunnyside Plaza.
The church intends to have a congregation of 25 to 50 for Sunday service, and will hold
a Tuesday evening bible study at 7:00 p.m.
With the existing businesses operating at normal business hours, and the church
operating at typical non -business hours, staff believes there will not be any parking
issues on or off site.

STAFF RECOMMENDATIONS:
Staff recommends APPROVAL of the request for a CUP to allow a church facility on
this C-2 (General Commercial) zoned parcel.
CUP CONDITIONS:
Section 1 - General Conditions
1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon
any heirs, assigns and successors in title or interest.
2. No expansion of the use or additions to the facility shall be permitted except as approved
by another Conditional Use Permit.
3. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove,
improve, move, convert, or demolish any building or structure, or alter the land in any
manner within the boundary of the project without first submitting necessary plans,
obtaining necessary approvals, and obtaining necessary permits in accordance with the
City of Clermont Land Development Regulations and those of other appropriate
jurisdictional entities.
4. The structure shall be inspected by the Fire Inspector for life safety requirements, all
requirements must be met prior to any certificate of occupancy being issued.

5. The structure shall be inspected by the Building Inspector and all building code violations
must be corrected prior to a certificate of occupancy being issued.
6. The final Certificate of Occupancy shall not be issued until each of the stated conditions
has been met.
7. If any of the stated conditions are violated, the applicant understands and agrees that the
City Council may revoke this Conditional Use Permit by resolution.
8. The Conditional Use Permit must be executed and filed in the office of the City Clerk
within 90 days of its date of grant by the City Council or the permit shall become null and
void.
9. The Applicant shall record in the Public Records of Lake County within 90 days of its
date of approval by the City Council, a short -form version of this Conditional Use Permit
as provided by the City or a form acceptable to the City, to provide notice to all interested
parties, the assigns, successors and heirs of the developer/applicant and all future owners
of the above -referenced property that the real property described above is subject to the
terms and conditions of the Conditional Use Permit.
10. If, at a future date, parking at this site proves inadequate the applicant understands and
agrees that the City may require additional parking or rescind this Conditional Use
Permit.
11. Should the church use become an infringement upon the other business within the
development, the city reserves the right to reopen the CUP for additional review and
conditions.
12. This permit shall become null and void if the church has not begun operations with a
certificate of occupancy within two (2) years of the date the Conditional Use Permit is
executed and signed by the appropriate parties.
13. Should the church use cease operations for a period greater than 180 days, a new
Conditional Use Permit shall be required.

ANALYSIS:
The applicant is requesting a Conditional Use Permit for a new building over 20,000 sq.
ft. According to the Land Development Code, M-1 Industrial Districts are governed
under the same development conditions as a C-2 General Commercial District.
Buildings over 20,000 sq. ft. and a job training center would require a CUP. The
proposed Goodwill Industries building overall is 25,000 sq. ft. which includes 12,550 sq.
ft. of retail space; 6,078 sq. ft. of loading/storage area; and, 3,666 sq. ft. for a job
training center.
There are four fields planned — two on the north side of Legends Way, one on the south
side of Legends Way and one on the new Don Wickham Blvd. extension. The multi-
purpose fields are being built using Lake County grant monies and will be used for

STAFF RECOMMENDATION:
Staff believes this is an appropriate location for this use and recommends approval of
the CUP, with the following conditions.

improve, move, convert, or demolish any building or structure, or alter the land in any
manner within the boundary of the project without first submitting necessary plans,
obtaining necessary approvals, and obtaining necessary permits in accordance with the City
of Clermont Land Development Regulations and those of other appropriate jurisdictional
entities.
5. No business can occupy any portion of a building unless the proposed business has applied
for and obtained a Local Business Tax Receipt from the Planning & Zoning Department.

6. The Conditional Use Permit must be executed and processed throu hie office of the City
Clerk within 90 days of its date 0grant by the City Council or the permit shall become null
and void.
7. The Applicant shall record in the Public Records of Lake County within 90 days of its date
of approval by the City Council, a short -form version of this Conditional Use Permit as
provided by the City or a form acceptable to the City, to provide notice to all interested
parties, the assigns, successors and heirs of the developer/applicant and all future owners of
the above -referenced property that the real property described above is subject to the terms
and conditions of the Conditional Use Permit.
8. This permit for the addition of the multi -purpose fields shall become null and void if
substantial construction work has not begun within two (2) years of the date the
Conditional Use Permit is executed and signed by the appropriate parties. Substantial
construction work means the commencement and continuous construction of required
improvements ultimately finalized at completion.
9. The applicant shall be required to submit a formal site plan for review and approval by the
City staff. The project shall be designed in substantial accordance with the site plan
(Exhibit "A") presented at the preliminary site review meetings and public hearings with
the exception of modifications necessary to comply with final CUP conditions and State,
County or City Codes.
10. The structures shall be inspected by the Fire Marshall for life safety requirements. All
requirements must be met prior to any Certificate of Occupancy being issued.
11. The structures shall be inspected by the City Building Inspector and all building code
violations must be corrected prior to a Certificate of Occupancy being issued.
12. If any of the stated conditions are violated, the applicant understands and agrees that the
City Council may revoke this Conditional Use Permit by resolution.
Section 2 — General Improvements & Landscaping
1. All signage and landscaping shall conform to adopted City Codes and Standards.
2. No outside storage or drop boxes shall be allowed on the site. All donations or drop offs
must be taken inside.
Section 3 — Stormwater Management Plan Requirements
Verification of the stormwater run-off data, assumptions, and calculations shall be provided
and approved by both the City Engineer and St. John's River Water Management District
prior to any development activity. The drainage and stormwater retention requirements of

the City and the appropriate regulatory agencies shall be met. These areas shall be properly
maintained.
2. If required by the City Engineer, a St. John's River Water Management District stormwater
permit shall be required and filed with the City prior to receipt of a building permit or any
development activity.
3. Permeability tests must be submitted as part of the stormwater/site plan review process.
Permeability shall be maintained.
4. Final disposition of storm water outfall shall be as approved by the City Engineer.
Section 4 — Physical Site Development
1. A dust abatement plan shall be submitted to the City detailing measures to be taken in
eliminating the migration of dust particles from the site. The plan must specifically outline
those measures recommended by Florida Department of Environmental Protection
(F.D.E.P.).
2. All disturbed adjacent sites cleared must be sodded, or seeding as approved by the City
Engineer and part of the dust abatement plan.
3. Ingress/egress to the site for construction shall be from a formally designated route as
approved by the City Site Review Committee.
Section 5 — Transportation Improvements
1. Sidewalks shall be required along all public road frontages in accordance with adopted City
Codes.
2. Access to any adjoining street shall be approved by the applicable state and local agencies
and meet all codes as required. Such plans for this project include but are not limited to,
access drives, accel/decal lanes, turn lanes, traffic signalization devices, and internal
signage and traffic movement lanes.

DETAILED DESCRIPTION OF REQUEST
Goodwill Industries of Central Florida, Inc. is a not -for -profit 501(c)(3) corporation.
Goodwill operates 26 stores and 5 attended donation centers in the Central Florida area. Revenue raised
from the sale of donated goods in these stores is channeled directly into employment and training
programs that help people to work. On average, 90% of every dollar Goodwill spends is for a program -
related expense. In furtherance of its mission, Goodwill operates eight Job Connection Centers,
designed to assist individuals find employment. Job Connection Centers provide comprehensive
interview skills training, job seeking and resume writing assistance, networking opportunities, and
computer, fax and telephone services, coupled with professional guidance and encouragement.
This parcel is zoned M-1. Specific uses permitted within M-1 zoning are "offices or
technical training enterprises," as well as any C-2 permitted uses, which include "any retail business or
service, including the sale of goods and services for resale, as long as it is incidental to and in
conjunction with a retail business," and "professional offices... and similar businesses." Goodwill intends
to construct upon this 3.27 acre parcel a 24,037 square foot building, which will consist of 12,550 square
foot of retail sales space, 6,078 square foot of back room, offices and processing, and a 3,666 square
foot job training center, thus falling squarely within M-1 zoning by operation of a retail business and job
training center. Parking, landscaping, and all architectural requirements will be is in compliance with
applicable codes, and no variances will be required.

The applicant intends to locate an adult day care facility in a former child care building.
The 3,000 square foot building will be the new home for the Lake County Adult Activity
Center. The center will provide a safe place to go during the week to socialize,
participate in supervised activities, and receive physical care and monitoring as needed,
all while retaining as much independence as possible.
Lake County Adult Activity Center was previously approved as a CUP in 2009 at 1172
Grand Highway. This Grand Highway location has now become too small for their
growing business, and has located this site on West Broom Street as their new potential
home. Since the site was already used as a childcare center, many features are already
in place for use as an adult daycare center.
Lake County Adult Activity Center will be a licensed adult day care facility with the
capacity of up to 30 adults. Hours of operation will be Monday through Friday from
8:00am to 5:00pm and three employees will staff the facility throughout the day.

STAFF RECOMMENDATION: Staff believes this development is consistent with the
uses in the area and recommends approval of this Conditional Use Permit request for an
adult day care facility with the following CUP conditions as listed.
CUP CONDITIONS:
Section 1 - General Conditions
The conditions as set forth in this Conditional Use Permit shall be legally binding upon any
heirs, assigns and successors in title or interest.
2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove,
improve, move, convert, or demolish any building or structure, or alter the land in any
manner within the boundary of the project without first submitting necessary plans,
obtaining necessary approvals, and obtaining necessary permits in accordance with the City
of Clermont Land Development Regulations and those of other appropriate jurisdictional
entities.
3. No business can occupy any portion of the building unless the proposed business has applied
for and obtained a Local Business Tax Receipt from the Planning & Zoning Department.
4. If any of the stated conditions are violated, the applicant understands and agrees that the City
Council may revoke this Conditional Use Permit by resolution.
5. The Conditional Use Permit must be executed and processed through the office of the City
Clerk within 90 days of its date of grant by the City Council or the permit shall become null
and void.

6. The Applicant shall record in the Public Records of Lake County within 90 days of its date
of approval by the City Council, a short -form version of this Conditional Use Permit as
provided by the City or a form acceptable to the City, to provide notice to all interested
parties, the assigns, successors and heirs of the developer/applicant and all future owners of
the above -referenced property that the real property described above is subject to the terms
and conditions of the Conditional Use Permit.
7. This permit shall become null and void if the Adult Day Care has not begun operations with
a certificate of occupancy within two (2) years of the date the Conditional Use Permit is
executed and signed by the appropriate parties.
The structure shall be inspected by the Fire Marshall for life safety requirements. All
requirements must be met prior to any Certificate of Occupancy being issued.
9. The structure shall be inspected by the City Building Inspector and all building code
violations must be corrected prior to a Certificate of Occupancy being issued.
10. Residential uses shall not be permitted.
Section 2 — Land Use
Permitted uses shall include an adult day care facility. Other permitted uses in the C-1 Light
Commercial zoning district are also permitted.
Section 3 - Architectural Desisn:
All structures shall be designed and constructed in accordance with the Architectural Standards of
the City of Clermont. In addition, the following shall be allowed:
All fencing within public view shall be ornamental metal or brick, as approved by the City's
Site Review Committee. Chain link fencing shall be prohibited.
2. Direct exposed view neon tubing and scrolling text message boards are prohibited. Neon
tubing shall not be utilized for building trim or accent areas.

ANALYSIS: The applicant is requesting a conditional use permit to allow for restaurant
within the CBD zoning district. The proposed restaurant will include a new 4,725 sq. ft.
building consisting in indoor and outdoor patron areas. The 4,040 sq. ft. warehouse
currently used as the Wakeboard camp is proposed to remain as part of the project but
will only be used for storage and a 150 sq. ft. office area. Restaurant hours of
operation will be Sunday — Thursday from 11:00 am to 10:00 pm and Friday — Saturday
from 11:00 am to 11:00 pm. The hours may be modified due to activities or events for
the restaurant.
The outdoor area along the east side of the property is proposed to be used for
recreation and various activities.
There are other events and activities that the owner would like to include as part of the
CUP restaurant approval:
Weddings, holiday parties, special event venues
Live music (on the restaurant deck and outdoor area)
Public movie night and poetry night
Contests — talent show, hot dog eating, competition hosting for Miss Clermont
and Lake County, dancing, singing, music, karate, high school cheer/dance,
sand castle, doggie dress -up parades, and similar functions
Children playground area, beach volleyball, horseshoe and cornhole
Bicycle and water sport rental area, ice/vending machines and bait sales

There are six variances being requested in conjunction with this CUP request and
include the following: four landscape buffer variances; one outdoor storage variance;
and, one parking variance.
v Reduction of the west landscape buffer from 10' to 5'
y No landscape buffer along the north shore area
No landscape buffer along the east side, adjacent to the City's Waterfront Park
y Southern landscape buffer to be on the City's property
y Outside storage and display for rentals
�= Reduction in parking from the CBD standards
This site is directly adjacent to the South Lake Trail to the south and east, and staff is
recommending as part of the CUP, that if the existing structure is ever removed, that
the owner grant a 7-foot easement for the purpose of widening the trail to the needed
15 feet.
STAFF RECOMMENDATION:
The CBD location of the proposed restaurant use is in accordance with the LDC. Due
to the location of the proposed restaurant, and by keeping the existing structure, the
site is limited in size for the proposed use. The proposed CUP site plan will require
approval of a few of the variance requests. The elimination of the east and south
landscape buffers open the site up for lake and park vistas.
Staff recommends approval of the Conditional Use Permit request to operate a
Restaurant located at 848 W. Osceola St.

7. This permit shall become null and void if substantial construction work has not begun
within two (2) years of the date the Conditional Use Permit is executed and signed by the
appropriate parties. Substantial construction work means the commencement and
continuous construction of required improvements ultimately finalized at completion.
The Restaurant use shall be required to install and maintain any required grease trap for
food services in accordance with the Clermont Code of Ordinances and other local or state
regulations. Installation and size are to be determined by the Utility Director.
9. The applicant shall be required to submit a formal site plan for review and approval by the
City staff. The project shall be designed in substantial accordance with the site plan
(Exhibit "A") presented at the preliminary site review meetings and public hearings with
the exception of modifications necessary to comply with final CUP conditions and State,
County or City Codes.
10. The final Certificate of Occupancy shall not be issued until each of the stated conditions
has been met. If any of the stated conditions are violated, the applicant understands and
agrees that the City Council may open the Conditional Use Permit for further conditions or
revoke this Conditional Use Permit by resolution.
11. Should the restaurant use cease operations for a period greater than one year, a new
Conditional Use Permit shall be required.
12. In the event that the noise levels create a nuisance to the surrounding property owners, the
City reserves the right to open the CUP for further review and additional conditions.
Recurring documented complainants related to noise or other disturbances emanating from
the operation shall be considered prima facie evidence of a violation of this provision. The
owner shall be given written notice of such violations and shall have seven (7) days after
receipt of such notice within which to demonstrate that adequate measures have been taken
to alleviate the source of the disturbance which gave rise to the recurring complaints. If in
the opinion of the Planning and Zoning Director, the disturbances have not been corrected,
the owner will be scheduled for the next available City Council meeting to determine the
appropriate action necessary to alleviate the disturbance, including any additional
restrictions on the operation of the business deemed necessary to alleviate the complaints.

Construction of a 4,725 SF restaurant consisting of indoor and outdoor patron areas The existing
4,040SF warehouse will remain as part of the project and will be used for storage The following uses
are proposed as part of this CUP Application and compatible with the surrounding properties
1) A 4,754 SF restaurant with indoor, outdoor seating and a indoor bar area (liquor sales licence)
2) Outdoor area along the east side of the property used for recreation and activities
3) Events/activities including but not limited to the following:
a) Weddings, holiday parties, special event venues
b) Live music (on the restaurant deck and the outdoor area)
c) Public movie night and voetry night
d) Contests (talent show, hot dog eating competition hosting for Miss Clermont and Lake County,
dancing singing music karate high school cheer/dance sand castle doggie dress -Up parades
e) Children olayground area beach volleyball horseshoe and cornhole
