City of Clermont MINUTES PLANNING AND ZONING COMMISSION APRIL 3, 2012 Page 1 The meeting of the Planning & Zoning Commission was called to order Tuesday March 7, 2012 at 7:00 p.m. by Chair Cuqui Whitehead. Other members present were Robert Boyatt, Bernadette Dubuss, William Henning, Nick Jones, Raymond Loyko and Judy Proli. Also in attendance were Curt Henschel, City Planner, Jim Hitt, Planning and Zoning Director, Dan Mantzaris, City Attorney, and Denise Noak, Deputy City Clerk. MINUTES of the Planning and Zoning Commission meeting held March 6, 2012 were approved as written. REPORTS There were no reports 1. REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request for a CUP to allow an Adult Day Care Facility to be established in the C- 1 Light Commercial zoning district. PROJECT NAME: Lou's Place OWNER: Citizens First Bank APPLICANT: Mary Lou Wieloszynski LOCATION: 1150 West Minneola Ave PARCEL SIZE: 0.5 acre +/- FUTURE LAND USE: Downtown MU EXISTING LAND USE: Office Building EXISTING ZONING: C-1 Light Commercial City planner Curt Henschel presented the Staff report as follows: The applicant intends to locate an adult day care facility in an existing office building. The program (Lou's Place) will provide a safe place to go during the week to socialize, participate in supervised activities, and receive physical care and monitoring as needed, all while retaining as much independence as possible. Lou's place will be a licensed adult day care facility with the capacity of up to 33 adults, and will be open mostly from 7:30 a.m. to 7:30 p.m. Additional hours will be available on an as needed basis for clients with non typical work hours. There will be a minimum of two staff members at all times, with a peak of 5 at full capacity. Lou's Place is not set up or designed for overnight stays with bedroom facilities. The parcel was previously used as a 2,000 square foot professional office, and shares a driveway to the office building to the west. Commissioner Dubuss moved to recommend approval of the conditional use permit, seconded by Commissioner Boyatt. The vote was unanimous to recommend approval for the conditional use permit to City Council. 2. REQUEST FOR CONDITIONAL USE PERMIT REQUESTED ACTION: Request an amendment to a CUP (Res. 2011-08) to change the uses to a Support Center for New Beginnings within in a R-3, Residential/Professional zoning district. PROJECT: New Beginnings Support Center APPLICANT/OWNER: New Beginnings of Lake County, Inc. (Steve Smith) LOCATION: 792 East Montrose St. (west of Ambassador Cleaners & U.S. 27) SIZE OF PARCEL: 0.43 acres EXISTING LAND USE: Vacant building FUTURE LAND USE: Low Density Residential EXISTING ZONING: R-3, Residential/Professional City planner Curt Henschel presented the Staff report as follows: The applicant is requesting an amendment to a CUP (Res. 2011-08) for a church which was originally approved on May 24, 2011. During the applicant's assessment of the building use, they revised their needs and the uses for the building have changed to a support center for the operations of New Beginnings. These new uses include the following (as shown in the CUP Site Plan): Top floor uses: Worship services for the clients, bible study, tutoring, counseling, job training, bookkeeping, pastor's office, and similar uses. Bottom floor uses: Food storage and packaging. There will be no food distribution from the site. Because the uses of this building have changed from strictly a church to worship and numerous support services, the applicant has modified their variance request from all grass parking and one paved handicap space to one handicap and three paved spaces, and three grass parking spaces, for a total of seven spaces. If the grass spaces become an issue due to runoff or overuse, indicating the need to pave, staff will require that they all be paved. As with the first Conditional Use Permit, because of the limited number of parking spaces available to the site, the staff recommends that a cap of 28 people be placed for the occupancy load, as part of this CUP (See Section 2, #3). This number is based on the projected parking City of Clermont MINUTES PLANNING AND ZONING COMMISSION APRIL 3, 2012 Page 3 requirements as modified in accordance with the LDC of 1 space per 4 seats/users. (22 seats - 4 seats = 6 spaces plus one HC) This includes the food storage uses on the bottom floor. All handicap parking must be paved with access. The previously approved variances covering building setback reductions and Landscape buffer width reductions remain in place. Staff recommends approval of the request for a Conditional Use Permit to allow the operation of the New Beginning Support Center with the occupancy load limit of 28 people, unless more property is added adjacent to the site to accommodate more, per the LDC (Section 2, # 2 and #3). Staff further recommends that the redevelopment and construction of this site be completed in accordance with Section 1, #12 (6 months to obtain permits, and one year for completion). Commissioner Boyatt moved to recommend approval of the conditional use permit, seconded by Commissioner Proli. The vote was unanimous to recommend approval for the conditional use permit to City Council. 3. REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request a Conditional Use Permit to allow a commercial shopping center over 20,000 sq. ft., within a C-2 General Commercial Zoning District PROJECT: Sandhill Commons, Lot 1 — Hobby Lobby, Phase I OWNER: Dewitt Enterprises, Inc. APPLICANT: Argate Properties, Inc. (Steven T. Siegel) LOCATION: Northwest corner of Hooks St. and Sandhill View Blvd. (South of S.R. 50) PARCEL SIZE: 4.09 acres +/- EXISTING LAND USE: Vacant FUTURE LAND USE: Commercial EXISTING ZONING: C-2, General Commercial District City planner Curt Henschel presented the Staff report as follows: The applicant is requesting a Conditional Use Permit for a two-phase commercial project with over 20,000 sq, ft. Phase I consists of a 55,000 sq. ft. Hobby Lobby store on 5.75 acres which will be adjacent to Sandhill View Blvd. The front of the store will face Sandy Grove Ave. and S.R. 50, and the rear will be off Hooks Street. Phase II will be built at a future date when a tenant is identified and will have a maximum 34,000 sq. ft. on 4.34 acres. Both phases total 89,000 sq. ft. on 10.09 acres. City of Clermont MINUTES PLANNING AND ZONING COMMISSION APRIL 3, 2012 Page 4 The site is well served by the transportation network and will have access from Sandy Grove Ave. on the north, Sandhill View Blvd. on the east and Hooks St. on the south. The project will have a screen wall provided for the loading area backing up to Hooks Street, which will also shield the compactor and some parking. There is one variance from the LDC requested in conjunction with this Conditional Use Permit: ➢ To allow for the absence of a landscape buffer along internal property lines — Sec. 118-37 (d) (1). Staff believes this development is consistent with the uses in the area and recommends approval of the Conditional Use Permit request for a two -phased commercial shopping center with over 20,000 sq. ft. within a C-2 General Commercial Zoning District, with the Conditional Use Permit conditions as provided. Commissioner Boyatt moved to recommend approval of the conditional use permit; seconded by Commissioner Proli. STAFF RECOMMENDATION: Staff believes this area is suitable this type of use and recommends APPROVAL of the request for a CUP to allow a professional office for a travel business. No further expansion of the use or additions to the facility shall be permitted except as approved by another Conditional Use Permit. 3. Formal construction plans, incorporating all conditions stated in this permit shall be submitted for review and approved by the Site Review Committee prior to the issuance of a zoning clearance or other development permits. The conceptual site plans submitted with the CUP application are not the approved construction plans. 4. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. 5. No business can occupy any portion of a building unless the proposed business has applied for and obtained a Local Business Tax Receipt from the Planning & Zoning Department. 6. The Conditional Use Permit must be executed and processed through the office of the City Clerk within 90 days of its date of grant by the City Council or the permit shall become null and void. 7. The Applicant shall record in the Public Records of Lake County within 90 days of its date of approval by the City Council, a short - form version of this Conditional Use Permit as provided by the City or a form acceptable to the City, to provide notice to all interested parties, the assigns, successors and heirs of the developer/applicant and all future owners of the above -referenced property that the real property described above is subject to the terms and conditions of the Conditional Use Permit. 8. This permit shall become null and void if substantial construction work has not begun within two (2) years of the date the Conditional Use Permit is executed and signed by the appropriate parties. Substantial construction work means the commencement and continuous construction of required improvements ultimately finalized at completion. 9. The applicant shall be required to submit a formal site plan for review and approval by the City staff. The project shall be designed in substantial accordance with the site plan (Exhibit "A") presented at the preliminary site review meetings and public hearings with the exception of modifications necessary to comply with final CUP conditions. 4 - Travel House of America, CUP 10. All parking must be provided for the building in accordance with the Land Development Code. 11. The structure shall be inspected by the Fire Marshall for life safety requirements. All requirements must be met prior to any Certificate of Occupancy being issued. 12. The structure shall be inspected by the City Building Inspector and all building code violations must be corrected prior to a Certificate of Occupancy being issued. 13. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. Section 2 — Land Use The property is approved for use as a professional office for a travel business, as well as uses permitted with the R-3-A zoning district. Section 3 — Landscaping: All landscaping shall comply with the City of Clermont's Land Development Code. Section 4 - Transportation Improvements: The owner/developer shall provide the following transportation improvements: 1.
