Other members present were Robert Boyatt, Bernadette Dubuss, and Judy Proli. Also in attendance were Curt Henschel, City Planner, Jim Hitt, Planning and Zoning Director, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative Assistant. MINUTES of the Planning and Zoning Commission meeting held February 7, 2012 were approved as written. REPORTS Commissioner Nick Jones stated that there is a great symphony concert coming up. He stated that Pig on the Pond is this weekend. He stated that the Lion's Club will be at the gate to test for diabetes, glaucoma, hearing, and blood pressure. 1. REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request a Conditional Use Permit to allow for church facility in the M- 1 Industrial Zoning District. PROJECT NAME: Clermont Bible Fellowship OWNER: Towerco LLC APPLICANT: Lanny Evans LOCATION: 355 Citrus Tower Blvd. FUTURE LAND USE: Industrial EXISTING LAND USE: Retail/Industrial Building EXISTING ZONING: M-1 Industrial Zoning City planner Curt Henschel presented the Staff report as follows: The applicant is requesting a conditional use permit to operate a house of worship in the M-1 zoning district. The applicant is occupying approximately 1,500 square feet of building space located in the Heritage Square retail/industrial complex. For the past several years a church has been operating out of this same location, but a time limit was imposed on the previous Conditional Use Permit which has expired. The church is requesting the same uses without any time limits imposed for expiration. The church intends to have 40 seats for Sunday service (9:30 to Noon), and will hold a Wednesday and Friday evening bible study from 7:00 to 8:30. City of Clermont MINUTES PLANNING AND ZONING COMMISSION MARCH 6, 2012 Page 2 With the existing businesses operating at normal business hours, and the church operating at typical non -business hours, staff believes there will not be any parking issues on or off site. Staff recommends approval of the request for a Conditional Use Permit to allow a church facility on this M-1 (Industrial) zoned parcel. Lanny Evans, 355 Citrus Tower Blvd., stated that he agreed with staff recommendations. Commissioner Dubuss moved to recommend approval of the conditional use permit; seconded by Commissioner Boyatt. The vote was unanimous to recommend approval for the conditional use permit to City Council. 2. REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request to amend Res. No. 2011-18 Conditional Use Permit to modify the site plan, allow an automobile repair garage; and over four users for multi - tenant commercial buildings; within a C-2 General Commercial Zoning District. PROJECT NAME: Oak Hill Commons — Lot #1 (Pep Boys) OWNER/APPLICANT: Clermont Land Development, LLC (John McGill) LOCATION: Northeast corner of US 27 and Hooks Street (and west of Grand Highway) PARCEL SIZE: 4.09 acres +/- FUTURE LAND USE: Commercial EXISTING LAND USE: Vacant EXISTING ZONING: C-2, General Commercial District City planner Curt Henschel presented the Staff report as follows: The applicant is requesting an amendment to their conditional use permit for an automobile repair garage, and multi tenant commercial buildings located at the Northwest corner of Hooks Street and Grand Hwy. This Conditional Use Permit was originally approved by the City Council on September 27, 2011. At that time, the CUP also included a building over 20,000 square feet. The applicant is proposing site plan changes that were not consistent with the original Conditional Use Permit approval. These changes include a reduction of buildings (from three to two / now under 20,000 square feet) and a general change of layout for the site plan. All other uses remain the same for the development as approved. The original approved uses include an automotive repair garage, a building over 20,000 square feet, and to allow for more than four tenants within one building. Other changes are being proposed that would potentially eliminate previously approved variances. A variance for a grading cut of up to 18 feet would possibly be eliminated because City of Clermont MINUTES PLANNING AND ZONING COMMISSION MARCH 6, 2012 Page 3 the site will retain more of the existing grade, the new proposed cut is approximately 15 feet in depth. A second variance that could be eliminated is the splitting of a landscape buffer with a retaining wall. The site is now able to utilize slopes to make up grade changes and has now eliminated many of the walls that were previously proposed. Staff believes this development is consistent with the uses in the area and recommends approval of the Conditional Use Permit request for an automobile repair garage; over four users for multi - tenant commercial buildings; and, commercial building over 20,000 sq. ft., with the Conditional Use Permit conditions as provided. Rick McCoy, 606 S. Main Ave. Minneola, stated that they went out to bid and the cost came back way over budget so they reduced the building size and eliminated the retaining walls except for one six foot wall. He stated that this will also eliminate the landscape buffer variance. Commissioner Boyatt moved to recommend approval of the conditional use permit; seconded by Commissioner Proli. The vote was unanimous to recommend approval for the conditional use permit to City Council. There being no further business, the meeting was adjourned at 7:30 pm. The program (Lou's Place) will provide a safe place to go during the week to socialize, participate in supervised activities, and receive physical care and monitoring as needed, all while retaining as much independence as possible. Lou's place will be a licensed adult day care facility with the capacity of up to 33 adults, and will be open mostly from 7:30 a.m. to 7:30 p.m. Additional hours will be available on an as needed basis for clients with non typical work hours. There will be a minimum of two staff members at all times, with a peak of 5 at full capacity. Lou's Place is not set up or designed for overnight stays with bedroom facilities. The parcel was previously used as a 2,000 square foot professional office, and shares a driveway to the office building to the west. CUP CONDITIONS: Section 1 - General Conditions 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. 3. No business can occupy any portion of the building unless the proposed business has applied for and obtained a Local Business Tax Receipt from the Planning & Zoning Department. 4. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 3 - Lou's Place CUP The Conditional Use Permit must be executed and processed through the office of the City Clerk within 90 days of its date of grant by the City Council or the permit shall become null and void. 6. The Applicant shall record in the Public Records of Lake County within 90 days of its date of approval by the City Council, a short -form version of this Conditional Use Permit as provided by the City or a form acceptable to the City, to provide notice to all interested parties, the assigns, successors and heirs of the developer/applicant and all future owners of the above -referenced property that the real property described above is subject to the terms and conditions of the Conditional Use Permit. This permit shall become null and void if substantial construction work has not begun within two (2) years of the date the Conditional Use Permit is executed and signed by the appropriate parties. Substantial construction work means the commencement and continuous construction of required improvements ultimately finalized at completion. 8. The structure shall be inspected by the Fire Marshall for life safety requirements. All requirements must be met prior to any Certificate of Occupancy being issued. 9. The structure shall be inspected by the City Building Inspector and all building code violations must be corrected prior to a Certificate of Occupancy being issued. 10. Residential uses shall not be permitted. Section 2 — Land Use 1. Permitted uses shall include an adult day care facility. Other permitted uses in the C-1 Light Commercial zoning district are also permitted. Section 4 - Architectural Desim All structures shall be designed and constructed in accordance with the Architectural Standards of the City of Clermont. My passion is to help them have quality of life by being informed of available services, how to access resources and to understand and promote positive choices. The Lou Burdette Caregiver Fund: For Those Who Care was started in 2007 as a legacy to honor not only a great baseball player, but a wonderful man who loved and cared for his wife of 58 years who had Alzheimer's for her last 10 years. My Father never knew a stranger and was great to his family, friends and fans. He often participated in charity events and supported many worthy causes. When my parents passed away in 2007 we started building a fund in the Community Foundation of South Lake County. These funds that are presently held at the Foundation will go toward serving our community's seniors and their caregivers. With the purchase of this property I will be able to house the charity. By housing the charity the 501 c3 organization will not have to pay the overhead of rent or utilities, as Granny Nannies will pay these fees, therefore allowing the funds to go toward providing the following services. Plans in the works for the Lou Burdette Caregiver Fund: For Those Who Care is a Care Cottage that will provide an Adult Day Health Program and offering assistance to caregivers providing care for their loved ones. We will also help family members learn how to give care and access available resources. In addition we will provide scholarships for people with the desire and heart to be a professional caregiver such as Home Health Aides and Certified Nursing Assistants as well as loan medical equipment to the elderly. As our population ages, there is a growing need for new and better services for seniors to remain independent and at home with their families. During the applicant's assessment of the building use, they revised their needs and the uses for the building have changed to a support center for the operations of New Beginnings. These new uses include the following (as shown in the CUP Site Plan): Top floor uses: Worship services for the clients, bible study, tutoring, counseling, job training, bookkeeping, pastor's office, and similar uses. Because the uses of this building have changed from strictly a church to worship and numerous support services, the applicant has modified their variance request from all grass parking and one paved handicap space to one handicap and three paved spaces, and three grass parking spaces, for a total of seven spaces. If the grass spaces become an issue due to runoff or overuse, indicating the need to pave, staff will require that they all be paved. As with the first CUP, because of the limited number of parking spaces available to the site, the staff recommends that a cap of 28 people be placed for the occupancy load, as part of this CUP (See Section 2, #3). This number is based on the projected parking requirements as modified in accordance with the LDC of 1 space per 4 seats/users. (22 seats _ 4 seats = 6 spaces plus one HC) This includes the food storage uses on the bottom floor. All handicap parking must be paved with access. The previously approved variances covering building setback reductions and Landscape buffer width reductions remain in place. STAFF RECOMMENDATIONS: Staff recommends APPROVAL of the request for a CUP to allow the operation of the New Beginning Support Center with the occupancy load limit of 28 people, unless more property is added adjacent to the site to accommodate more, per the LDC (Section 2, # 2 and #3). Staff further recommends that the redevelopment and construction of this site be completed in accordance with Section 1, #12 (6 months to obtain permits, and one year for completion). The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2 - New Beginnings Support Center CUP 2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. 5. The structure shall be inspected by the Fire Marshall for life safety requirements, all requirements must be met prior to any certificate of occupancy being issued. 6. The structure shall be inspected by the City Building Inspector and all building code violations must be corrected prior to a certificate of occupancy being issued. 7. Required on -site parking spaces must be paved in accordance with City Code unless otherwise approved by the City Council through the variance process.
