City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 1 The meeting of the Planning & Zoning Commission was called to order Tuesday January 3, 2012 at 7:00 p.m. by Chair Cuqui Whitehead. Other members present were Robert Boyatt, Bernadette Dubuss, William Henning, Nick Jones, Raymond Loyko and Judy Proli. Also in attendance were Curt Henschel, City Planner, Jim Hitt, Planning and Zoning Director, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative Assistant. MINUTES of the Planning and Zoning Commission meeting held December 6, 2011 were approved as written. REPORTS Commissioner Dubuss shared an email that she received from Afghanistan. 1. REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request a Conditional Use Permit (CUP) to allow a gas station and convenience store within a C-2 General Commercial Zoning District. PROJECT NAME: 7-Eleven Convenience Store and Gas Station OWNER: Carole J. Kramer APPLICANT: Verdad Real Estate, Inc. — Jennifer Volin LOCATION: 189 N. U.S. Hwy. 27 (SE corner of U.S. 27 and Citrus Tower Blvd.) PARCEL SIZE: 0.62 acres +/- FUTURE LAND USE: Commercial EXISTING LAND USE: Vacant building & pumps EXISTING ZONING: C-2 General Commercial Planning director Jim Hitt stated that the applicant is requesting a conditional use permit for a gas station and convenience store located at the Southeast corner of U.S. 27 and Citrus Tower Blvd. He stated that convenience stores and gas stations are required to have a Conditional Use Permit in a C-2 General Commercial Zoning District. Mr. Hitt stated that access to the 0.62 acre development will be from U.S. 27 and Citrus Tower Blvd. (right-in/right-out for both). He stated that in addition, cross access to the parcel to the south (TD Bank) is also available. Mr. Hitt stated that this site had an established gas station and convenience store that closed gas operations over a year ago and the convenience store portion in March 2011. He stated that there is an existing front setback variance of 17 feet for the existing canopy (approved 8/12/97) that can remain in place, provided the setback is not decreased. He stated that the proposed plan maintains this setback for the canopy. City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 2 Mr. Hitt stated that the proposed plan calls for a redevelopment of the entire site, except for the canopy and pump locations. He stated that the new 2,520 sq. ft. building, parking, and signage will meet Code, and includes underground retention. He stated that a 20-foot landscape buffer is required on both U.S. 27 and Citrus Tower Blvd., and there are two variances that are being applied for the site due to its constrained size: ➢ Landscape buffer setback — 6-feet on U.S. 27 and 14-feet on Citrus Tower Blvd. — rather than the required 20-feet. ➢ Canopy tree — location of trees from street buffer to another portion of the site. The number of trees meets the Code. Mr. Hitt stated that staff believes this development is consistent with the uses in the area and recommends approval of this Conditional Use Permit request for a gas station and convenience store with the Conditional Use Permit conditions listed. Roger Strcula, 265 Kenilworth Ave., Ormond Beach, stated that the applicants agree with the conditions to the conditional use permit and they are present to answer any questions. Chris Travis, 11609 Arbor Gate Dr., stated that as the market has gone down, you've seen several businesses go vacant. He stated that when national creditable tenants come in willing to redevelop a vacant site, he feels we need to be willing to work with them. Commissioner Jones asked where the stormwater retention is located. Mr. Hitt stated that the stormwater retention is all underground. Commissioner Jones asked about the abutting property owners having issues with the shared driveway. Mr. Hitt stated that he does not foresee any issues with the driveway because it is an existing cut now. Commissioner Dubuss moved to recommend approval of the conditional use permit; seconded by Commissioner Boyatt. The vote was unanimous to recommend approval for the conditional use permit to City Council. 2. REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request a Conditional Use Permit to allow an automobile repair garage and shopping center with five or more users within a C-2 General Commercial Zoning District PROJECT NAME: West End Commerce Center City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 3 OWNER/APPLICANT: Eric Caporale LOCATION: South of S.R. 50 and northeast of Emerald Lakes Mobile Home Park. PARCEL SIZE: 1.5 acres +/- FUTURE LAND USE: Commercial EXISTING LAND USE: Vacant EXISTING ZONING: C-2, General Commercial District Planning director Jim Hitt stated that the applicant is requesting a conditional use permit for an automobile repair garage and shopping center with 5 or more users. He stated that the applicant is proposing to construct a 7,558 square foot building that will be used either as an automotive repair garage or a shopping center with warehouse space. He stated that the C-2 zoning allows for a wide variety of uses but the proposed uses do require a Conditional Use Permit. He stated that the automotive repair garage will provide light automotive repair and maintenance to vehicles such as brakes, shocks, and electronic components. He stated that the applicant is not requesting to perform any major repairs such as engine and transmission replacement or major body repairs. Mr. Hitt stated that all proposed automotive work will be done within the walls of the building, and the hours of operation will be Monday through Friday from 8-5 and closed on weekends. Mr. Hitt stated that staff believes this development is consistent with the uses in the area and recommends approval of the Conditional Use Permit request for an automobile repair garage and shopping center with five or more users. John Herbert, 207 N. Moss Rd., Suite 211, Winter Springs, stated that he has worked with staff to make this a functioning site. Glen Caporale, 11150 Lake Katherine Circle, stated that they have worked with the city to comply with the site. He stated that the five units are due to getting the creditors to fund this project. He stated that typically a tenant will use up at least 2 units so he does not ever foresee having five tenants. Eric Caporale, 11743 Oswalt Road., stated that it is an established business in Minneola and they have never had any code issues against them. He stated that his work is specific. He stated that he has a credible reputation. Keith Westfall, 1401 SR 50, #65, stated that he does not personally have any issues with this project, but there are several residents who do have concerns. He stated that some of the concerns are the height of the retaining wall, noise issues, directional lighting and access to the site. City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 4 Mr. Hitt stated that there is a strict rule on parking lot lighting. He stated that the height of the wall will be 5'4" and there will be landscape around the wall. He stated that the access road will not remain open to the public. He stated that access will be off of SR 50. Mr. Westfall asked what type of material the retaining wall will be made of. Mr. Herbert stated that the plans right now call for an 8" concrete masonary wall with a stucco finish. David LaFevers, 1401 SR 50, #124, stated that he is also concerned about the access road. Mr. Hitt stated the access road will go away. Mr. LaFevers asked about the stormwater retention for the property. Mr. Herbert showed where the stormwater retention will be located between the retaining wall and the property line along Emerald Lakes Mobile Home Park. Commissioner Jones stated that when they built the Emerald Lakes clubhouse years ago, one wing of that building has since sunken 4 feet. He stated that he suggests the owners do due diligence to the property and test the soil prior to building. Commissioner Proli asked if they will be offering the same services at this location as they do at the Minneola location. She also asked about noise issues. Mr. Caporale stated that it will be more maintenance based. He stated that there is not money made in repairs because most people can't afford repairs with today's economy. He stated that the building will be located on the opposite side of the property from Emerald Lakes Mobile Home Park so that the noise level should not affect the home owners. Commissioner Jones moved to recommend approval of the conditional use permit; seconded by Commissioner Proli. The vote was unanimous to recommend approval for the conditional use permit to City Council. 3. REQUEST FOR COMP PLAN AMENDMENT REQUEST: Request to amend the Capital Improvements Element of the comprehensive plan. APPLICANT: City Staff City staff Barbara Hollerand stated that the request tonight is for an administrative large-scale comprehensive plan amendment to amend the Goals, Objectives and Policies of the Capital City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 5 Improvements Element of the comprehensive plan to update the five-year schedule of capital improvements. Ms. Hollerand stated that local governments are required to adopt annual updates to the Capital Improvements Element, which identifies those capital projects needed to maintain adopted Level of Service standards. Ms. Hollerand stated that as part of this annual amendment, the City updates Policy 1.6.2 to identify the current Lake County Schools facilities master plan and its adoption date. She stated that Appendix B of the element outlines a schedule for construction of necessary improvements to accommodate new growth. She stated that it includes estimates of the cost of public improvements, and it demonstrates the City's ability to finance and construct the improvements. Ms. Hollerand stated that the City updates the schedule by dropping the previous year and adding the fifth year out. She stated that many of the projects are ongoing, and extend to the fifth year and beyond. Ms. Hollerand stated that staff recommends approval of the text changes to the Capital Improvements Element. Commissioner Jones moved to recommend approval of the amendments to the Capital Improvements Elements; seconded by Commissioner Boyatt. The vote was unanimous to recommend approval for the rezoning to City Council. There being no further business, the meeting was adjourned at 7:46 pm. This current location has been approved and utilized as a house of worship / church several times before, but the last Conditional Use permit has expired. The church (approx. 4000 s.f.) will operate on Sundays and Wednesday evenings (7:00 — 8:30) for bible study. The proposed school will target kids 4 through 18 years of age that have a specific learning disability and kids deemed "uneducatable" by the public school system. The school will operate during normal school hours Monday through Friday from 8:00 to 3:30. STAFF RECOMMENDATION: Staff believes this development is consistent with the uses in the area and recommends approval of the Conditional Use Permit request for house of worship and school to operate at 155 North Hwy. 27 with the following conditions: CUP CONDITIONS: Section 1 - General Conditions 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. 3. The overall development is 3.86 acres and has two additional lots that are not part of this Conditional Use Permit. As the proposed development is currently presented. staff has identified several variances that will need approval before the site may be constructed as presented. The variances identified are as follows: ➢ To allow electronic signage for the price section of the two monument signs proposed. No other gas station has been allowed such signage. The City's code does not permit this, and we have no requirements in place that regulate how bright an electronic sign can be. Section 122-23 ➢ To allow for an increase in size of a secondary ground sign as regulated by Section 102- 15 (4) To allow for reduced fagade landscaping located in front of the store. Section 118-37 (1) To allow for additional signage under gas canopy that is not addressed by code. The structure shall be inspected by the City Building Inspector and all building code violations must be corrected prior to a Certificate of Occupancy being issued. 11. An emergency generator shall be installed to allow continuous operation of the gas station in the event of any power shortages, in accordance with Florida Statutes. Section 2 — Land Use Permitted uses shall include a gas station with up to eight fuel islands for 16 fueling stations and a convenience store. Other permitted uses in the C-2 General Commercial zoning district are also permitted. Section 3 - Transportation Improvements: The developer shall provide the following transportation improvements: Access to U.S. 27 and Hooks St.. shall be approved by the applicable state and local agencies and meet all codes as required. All access installation shall be at the developer's cost. FDOT, Lake County, and City of Clermont shall determine if any deceleration turning lane would be required for access. Installation shall be at the developer's cost. 2. A traffic study shall be required to address level of service (LOS) for the area, including any connection to U.S. 27 and Hooks St. as needed per Code or policy. Section 4 - Architectural Design: All structures shall be designed and constructed in accordance with the Architectural Standards of the City of Clermont. In addition, the following shall be allowed: 1. All fencing within public view shall be ornamental metal or brick, as approved by the City's Site Review Committee. Chain link fencing shall be prohibited. 2. Direct exposed view neon tubing and scrolling text message boards are prohibited. Neon tubing shall not be utilized for building trim or accent areas. 3. Signage shall not be allowed on the canopy covering the pumps. Eliminate existing southern driveway connection on US 27. Response: As discussed, since the southern driveway is existing and not part of this Lot 1 development, no impacts are proposed at this time to this driveway connection. This driveway will be addressed during the Lot 213 site plan review. Comment: 2. Eliminate proposed connection to slip ramp. Response: As discussed, depicting the proposed connection is acceptable. Comment: 3. Include decel lane on US 27 for entrance to site. Response: As discussed, a decel lane along US-27 shall not be provided since FDOT is proposing none within the corridor. However, the inbound radius for the driveway connection was increased per direction provided at our meeting. Comment: 4. Include decel lane on Hooks St for entrance to site. Response: As discussed, a decel lane along Hooks St. shall not be provided. However, the inbound radius for the driveway connection was increased. Comment: 5. Eliminate compact spaces. At the City Council approval meeting, Council required that in order to have full access at the northern access point, there would have to be an acceleration lane for the left turn movement heading north on Citrus Tower. City staff and the applicant have contacted Lake County and Lake County will not be able to put in an acceleration lane. Therefore, the applicant is requesting that this requirement be eliminated from the CUP and they be allowed a full access point at the northern location. Lake County has approved this full movement provided Clermont also approves it. The site is well served by the transportation network with three access locations. These locations to the 2.39 acre development include one on U.S. 27 and two locations off Citrus Tower Blvd. Two of these are to be shared access with the remaining 3.13 acres of the overall 5.52 acre area. As part of this application, the applicant has submitted updated architectural drawings which meet our Code requirements. No other changes have been requested to the CUP at this time. The applicant is also requesting the following variances with this CUP amendment: 1) To allow a second and third wall sign rather than just one. The overall size of the two signs if totaled separately would be less than what would be permitted per code for one. 2) To allow for gas pump canopy signage rather than none. The LDC does not have a provision for canopy signage or size, and therefore according to the Code is not permitted. The CUP as presented would not allow canopy signage, which is consistent with the last approved CUP (also the PIX and 7-11 CUPs). 3) To allow electronic signage for the price section of the two monument signs proposed. No other gas station has been allowed such signage. The City's code does not permit this, and have no parameters in place that regulate how bright an electronic sign can be. STAFF RECOMMENDATION: Staff believes this development is consistent with the uses in the area and recommends approval of this amendment to the Conditional Use Permit eliminating the requirement for the acceleration lane on Citrus Tower Blvd. for the gas station and convenience store. The amended CUP conditions are shown with stroke through and underline notations. 2 — RaceTrac CUP amendment CUP CONDITIONS: Section 1 - General Conditions 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the project without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and those of other appropriate jurisdictional entities. 3. No business can occupy any portion of the building unless the proposed business has applied for and obtained a Local Business Tax Receipt from the Planning & Zoning Department. 4. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 5. The Conditional Use Permit must be executed and processed through the office of the City Clerk within 90 days of its date of grant by the City Council or the permit shall become null and void. 6. The Applicant shall record in the Public Records of Lake County within 90 days of its date of approval by the City Council, a short -form version of this Conditional Use Permit as provided by the City or a form acceptable to the City, to provide notice to all interested parties, the assigns, successors and heirs of the developer/applicant and all future owners of the above - referenced property that the real property described above is subject to the terms and conditions of the Conditional Use Permit. 7. This permit shall become null and void if substantial construction work has not begun within two (2) years of the date the Conditional Use Permit is executed and signed by the appropriate parties. Substantial construction work means the commencement and continuous construction of required improvements ultimately finalized at completion. 8. The applicant shall be required to submit a formal site plan for review and approval by the City staff. The project shall be designed in substantial accordance with the plan presented at the preliminary site review meetings and public hearings with the exception of modifications necessary to comply with final Conditional Use Permit conditions. 9. The structure shall be inspected by the Fire Marshall for life safety requirements. All requirements must be met prior to any Certificate of Occupancy being issued. 10. The structure shall be inspected by the City Building Inspector and all building code violations must be corrected prior to a Certificate of Occupancy being issued. 11. An emergency generator shall be installed to allow continuous operation of the gas station in the event of any power shortages, in accordance with Florida Statutes. 3 — RaceTrac CUP amendment Section 2 — Land Use 1. MINUTES of the Planning and Zoning Commission meeting held December 6, 2011 were approved as written. REPORTS Commissioner Dubuss shared an email that she received from Afghanistan. 1. REQUEST FOR CONDITIONAL USE PERMIT REQUEST: Request a Conditional Use Permit (CUP) to allow a gas station and convenience store within a C-2 General Commercial Zoning District. U.S. Hwy. 27 (SE corner of U.S. 27 and Citrus Tower Blvd.) PARCEL SIZE: 0.62 acres +/- FUTURE LAND USE: Commercial EXISTING LAND USE: Vacant building & pumps EXISTING ZONING: C-2 General Commercial Planning director Jim Hitt stated that the applicant is requesting a conditional use permit for a gas station and convenience store located at the Southeast corner of U.S. 27 and Citrus Tower Blvd. He stated that convenience stores and gas stations are required to have a Conditional Use Permit in a C-2 General Commercial Zoning District. Mr. Hitt stated that access to the 0.62 acre development will be from U.S. 27 and Citrus Tower Blvd. (right-in/right-out for both). He stated that in addition, cross access to the parcel to the south (TD Bank) is also available. Mr. Hitt stated that this site had an established gas station and convenience store that closed gas operations over a year ago and the convenience store portion in March 2011. He stated that there is an existing front setback variance of 17 feet for the existing canopy (approved 8/12/97) that can remain in place, provided the setback is not decreased. He stated that the proposed plan maintains this setback for the canopy. City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 2 Mr. Hitt stated that the proposed plan calls for a redevelopment of the entire site, except for the canopy and pump locations. He stated that the new 2,520 sq. ft. building, parking, and signage will meet Code, and includes underground retention. He stated that a 20-foot landscape buffer is required on both U.S. 27 and Citrus Tower Blvd., and there are two variances that are being applied for the site due to its constrained size: ➢ Landscape buffer setback — 6-feet on U.S. 27 and 14-feet on Citrus Tower Blvd. — rather than the required 20-feet. ➢ Canopy tree — location of trees from street buffer to another portion of the site. The number of trees meets the Code. Mr. Hitt stated that staff believes this development is consistent with the uses in the area and recommends approval of this Conditional Use Permit request for a gas station and convenience store with the Conditional Use Permit conditions listed. Roger Strcula, 265 Kenilworth Ave., Ormond Beach, stated that the applicants agree with the conditions to the conditional use permit and they are present to answer any questions. Chris Travis, 11609 Arbor Gate Dr., stated that as the market has gone down, you've seen several businesses go vacant. He stated that when national creditable tenants come in willing to redevelop a vacant site, he feels we need to be willing to work with them. Commissioner Jones asked where the stormwater retention is located. Mr. Hitt stated that the stormwater retention is all underground. Commissioner Jones asked about the abutting property owners having issues with the shared driveway. Mr. Hitt stated that he does not foresee any issues with the driveway because it is an existing cut now. Commissioner Dubuss moved to recommend approval of the conditional use permit; seconded by Commissioner Boyatt. The vote was unanimous to recommend approval for the conditional use permit to City Council. 2. PARCEL SIZE: 1.5 acres +/- FUTURE LAND USE: Commercial EXISTING LAND USE: Vacant EXISTING ZONING: C-2, General Commercial District Planning director Jim Hitt stated that the applicant is requesting a conditional use permit for an automobile repair garage and shopping center with 5 or more users. He stated that the applicant is proposing to construct a 7,558 square foot building that will be used either as an automotive repair garage or a shopping center with warehouse space. He stated that the C-2 zoning allows for a wide variety of uses but the proposed uses do require a Conditional Use Permit. He stated that the automotive repair garage will provide light automotive repair and maintenance to vehicles such as brakes, shocks, and electronic components. He stated that the applicant is not requesting to perform any major repairs such as engine and transmission replacement or major body repairs. Mr. Hitt stated that all proposed automotive work will be done within the walls of the building, and the hours of operation will be Monday through Friday from 8-5 and closed on weekends. Mr. Hitt stated that staff believes this development is consistent with the uses in the area and recommends approval of the Conditional Use Permit request for an automobile repair garage and shopping center with five or more users. John Herbert, 207 N. Moss Rd., Suite 211, Winter Springs, stated that he has worked with staff to make this a functioning site. Glen Caporale, 11150 Lake Katherine Circle, stated that they have worked with the city to comply with the site. He stated that the five units are due to getting the creditors to fund this project. He stated that typically a tenant will use up at least 2 units so he does not ever foresee having five tenants. Eric Caporale, 11743 Oswalt Road., stated that it is an established business in Minneola and they have never had any code issues against them. He stated that his work is specific. He stated that he has a credible reputation. Keith Westfall, 1401 SR 50, #65, stated that he does not personally have any issues with this project, but there are several residents who do have concerns. He stated that some of the concerns are the height of the retaining wall, noise issues, directional lighting and access to the site. City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 4 Mr. Hitt stated that there is a strict rule on parking lot lighting. He stated that the height of the wall will be 5'4" and there will be landscape around the wall. He stated that the access road will not remain open to the public. He stated that access will be off of SR 50. Mr. Westfall asked what type of material the retaining wall will be made of. Mr. Herbert stated that the plans right now call for an 8" concrete masonary wall with a stucco finish. David LaFevers, 1401 SR 50, #124, stated that he is also concerned about the access road. Mr. Hitt stated the access road will go away. Mr. LaFevers asked about the stormwater retention for the property. Mr. Herbert showed where the stormwater retention will be located between the retaining wall and the property line along Emerald Lakes Mobile Home Park. Commissioner Jones stated that when they built the Emerald Lakes clubhouse years ago, one wing of that building has since sunken 4 feet. He stated that he suggests the owners do due diligence to the property and test the soil prior to building. Commissioner Proli asked if they will be offering the same services at this location as they do at the Minneola location. She also asked about noise issues. Mr. Caporale stated that it will be more maintenance based. He stated that there is not money made in repairs because most people can't afford repairs with today's economy. He stated that the building will be located on the opposite side of the property from Emerald Lakes Mobile Home Park so that the noise level should not affect the home owners. Commissioner Jones moved to recommend approval of the conditional use permit; seconded by Commissioner Proli. The vote was unanimous to recommend approval for the conditional use permit to City Council. 3. REQUEST FOR COMP PLAN AMENDMENT REQUEST: Request to amend the Capital Improvements Element of the comprehensive plan. APPLICANT: City Staff City staff Barbara Hollerand stated that the request tonight is for an administrative large-scale comprehensive plan amendment to amend the Goals, Objectives and Policies of the Capital City of Clermont MINUTES PLANNING AND ZONING COMMISSION JANUARY 3, 2012 Page 5 Improvements Element of the comprehensive plan to update the five-year schedule of capital improvements. I ' Ms. Hollerand stated that local governments are required to adopt annual updates to the Capital Improvements Element, which identifies those capital projects needed to maintain adopted Level of Service standards. Ms. Hollerand stated that as part of this annual amendment, the City updates Policy 1.6.2 to identify the current Lake County Schools facilities master plan and its adoption date. She stated that Appendix B of the element outlines a schedule for construction of necessary improvements to accommodate new growth. She stated that it includes estimates of the cost of public improvements, and it demonstrates the City's ability to finance and construct the improvements. Ms. Hollerand stated that the City updates the schedule by dropping the previous year and adding the fifth year out. She stated that many of the projects are ongoing, and extend to the fifth year and beyond. Ms. Hollerand stated that staff recommends approval of the text changes to the Capital Improvements Element. Commissioner Jones moved to recommend approval of the amendments to the Capital Improvements Elements; seconded by Commissioner Boyatt.
