City of Clermont MINUTES PLANNING AND ZONING COMMISSION August 6, 2013 Page 1 The meeting of the Planning & Zoning Commission was called to order Tuesday August 6, 2013 at 7:00 p.m. by Chairman Nick Jones. Other members present were Harry Mason, Gail Ash, Bernadette Dubuss, and Raymond Loyko. Also in attendance were Curt Henschel, Senior Planner, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative Assistant. MINUTES of the Planning and Zoning Commission meeting held July 2, 2013 were approved as amended. REPORTS There were no reports. 1. REQUEST FOR CHANGE TO THE LAND DEVELOPMENT CODE APPLICANT: Staff REQUESTED ACTION: Request for Land Development Code amendments to Chapter 34, Environment, Section 34-65 Exceptions; Chapter 98, Parking and Vehicular Use Areas, Section 98-3, Parking Spaces; Chapter 118 Vegetation, Section 118-2 Definitions; Section 118-35 Maintenance and Pruning; 118-36 Plant Material; Section 118-37 Landscape Buffers; Section 118-38 Vehicular Use Area, Interior Landscaping; and Section 118-71 Minimum Tree Requirements. City planner Curt Henschel presented the following staff report: Staff recommends approval of Ordinance 2013-17, which includes updates to eight sections of the Land Development Code. These sections address mowing exemptions for parcels greater than three acres; elimination of wheel stop requirements; definitions for excessively pruned, raising and shaping of trees; specifications for palm sizes at planting; provisions to allow landscape buffers to slope up to 4:1; increases in landscape buffer width between abutting properties and buffers adjacent to rights -of - way; and tying tree requirements to lots' available landscape space. Some of the proposed changes, such as the change in slope maximums, are in response to variance requests approved by the City Council. Other proposed changes, such as those addressing tree requirements on residential lots, are intended to update the code to better match the number of required trees to the size of the available planting area on a property. Commissioner Dubuss asked if the tree amendment will affect the current ordinance that is specific to Kings Ridge. City of Clermont MINUTES PLANNING AND ZONING COMMISSION August 6, 2013 Page 2 City attorney Dan Mantzaris stated that this amendment will not change the language that is specific to Kings Ridge. He stated that this amendment will help avoid creating codes specific to a subdivision. Commissioner Mason asked if Chapter 118 requires homeowners to have trees in their front yards. Mr. Henschel stated that the code does not require a tree in the front yard. Commissioner Ash stated that not planting trees close to the driveways should be included in the language because the roots break up the driveways as well. Commissioner Mason asked why 60% of required canopy trees in parking lots must be live oaks. Mr. Henschel stated that this code was created after the hurricanes. He stated that the city had tree experts come out. He stated that at that time laurel oaks were the preferred tree because they grow fast and tall. He stated that it was the majority of the laurel oaks that fell over due to the hurricanes. He stated the expert was asked what the best tree is for longevity and the live oak was the tree suggested. Commissioner Gail Ash moved to recommend approval of the Land Development Amendments as amended; seconded by Commissioner Bernadette Dubuss. The vote was unanimous to recommend approval for the Land Development Code Amendments to City Council. There being no further business, the meeting was adjourned at 7:34 pm. The existing church occupies approximately 1,200 square feet of retail/ office space located in Sunnyside Plaza. The church has a congregation of 25 to 50 for Sunday service, and holds a Tuesday evening bible study at 7:00 p.m. The amendment request is to allow the church to hold monthly fund raising events within the parking lot. Each event will be held one day per month on Saturday or Sunday and is centered around food sales during lunch hours (10am to 3pm). A small area with a tent and portable grill will be set up along the east property line and will occupy several parking spaces during the event. The Black West property was annexed into the City in 2006 pursuant to City Ordinance No. 599-M and a related Water and Sewer Utilities/Annexation Agreement. Also in 2006, the City amended its Future Land Use Map to designate the property for residential (single-family and multi -family) development at a density of up to 2.5 units per net acre and up to 21 acres of commercial space. At the time it was annexed, the property was given the default zoning classification of UE (Urban Estate). Pursuant to Section 122-83 of the City Code, Planned Unit Development (PUD's) are allowed in the UE district as a conditional use. The applicant purposes a mixed -use development for the property consisting of up to 1,200 residential units (including up to 1,000 age -restricted units) and -up to 100,000 square feet of commercial uses. The project -will contain significant open space and recreational improvements, including an integrated trail system that will connect to and expand upon the existing South Lake Trail system. The Florida Department of Transportation, through Florida's Turnpike Enterprise, is committed to opening a regional interchange located at Milepost 279 along Florida's Turnpike in the City of Minneola. Located just north of the Black West property, the new interchange is scheduled to be opened in 2016. At the same time, Lake County is committed to extending Hancock Road north from its existing connection at Old Highway 50 to the proposed interchange. A portion of the Hancock Road improvements will extend through the Black West property and provide an additional means of access to the project. Currently, the project has substantial frontage along, and access to, both Old Highway 50 and Blackstill Lake Road. The project proposes certain waivers to those sections of the Code that deal with lot sizes in the conventional UE zoning district and standards for new street construction and grading. Because this is a Planned Unit Development, these considerations or variances are considered to be part of the "zoning parameters" for the PUD rather than an actual variance request. The applicant's justification for these waivers is tied to safety, aesthetics and the desire for a vibrant, mixed -use community. By grading the property in excess of the maximum allowed in certain limited areas (up to 25 feet), it allows land for active and passive recreation to be maximized in other areas — including the setting aside of significant amounts of land in its natural and undisturbed state. Specific considerations/variances within the PUD are as follows: 1) To allow for private streets with gates. 2) A grading request for up to 25' of cut/fill rather than 10 feet per code. 3) Increasing the grading between multi level developments from 5:1 slope to 4:1 slope. 4) Allowing retaining walls to be 10 feet in height rather than a maximum of 6 feet. 5) To allow lot sizes smaller than one acre, down to 5,500 square feet. 6) To allow sidewalks to be located 5 feet off the back of the right-of-way line (within the right-of-way) rather than located on the edge of the right-of-way. 7) Increase total impervious surface coverage areas for individual lots from 55% to 75%, and from 45% to 65% for the principal structure. 8) Reduce front yard setbacks from 35 feet to 15 feet. 9) Reduce the side yard setback from 15 feet to 5 feet. 10) Reduce the rear yard setback from 25 feet to 20 feet. 11) Reduce the 7.5 side yard utility easements to match the side yard setbacks. 12) The project proposes a waiver to allow the existing billboards on the property to remain in place but on a temporary basis. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 2. The property shall be developed in substantial accordance with the conceptual site plan dated August 26, 2013 prepared by Bowyer Singleton. Formal construction plans, incorporating all conditions stated in this permit shall be submitted for review and approval by the Site Review Committee prior to the issuance of a zoning clearance of other development permits. The applicant/owner must coordinate with the Lake County School District for capacity review and requirements pertaining to schools, and in conformance with City Code, prior to issuance of any building permits. Section 3 — Site Development 1. Detailed grading, erosion control, and dust abatement plans for the entire site shall be submitted to and approved by the Site Review Committee prior to construction plan approval and the initiation of development activity. The dust abatement plan shall detail measures to be taken to eliminate the migration of dust particles from the site. 2. All excavated material shall be stored in a location approved by the City Engineer. 3. Geo-technical information regarding the soil characteristics of the site shall be submitted to the City as part of the final site review process. 4. The permittee/developers shall provide both temporary and permanent grassing including fertilizer application on all disturbed areas where construction is not immediately intended. Said plan shall be provided in accordance with an approved ground cover plan acceptable to the City in accordance with best management practices (BMP) of the U.S.D.A. Soil Conservation Service. 5. All platting must be completed in accordance with City Codes. 6. The offsite reclaim line shall be a 16-inch main line based on the Tetra Tech hydraulic analysis report. 7. The developer shall extend the off -site reclaim line to the project from the point of connection depicted on the Conditional Use Permit prior to issuance of a certificate of completion for the infrastructure constructed pursuant to the phase 2 or the next phase of construction proposed. The 229 age restricted and primary phase 1 lots will be serviced in the interim by the internal reclaim line which will be jumped off of the potable system. Section 4 — Transportation Improvements Sidewalks shall be required along Old Highway 50 and within the development, in accordance with FDOT regulations and City Codes. 2. The City may require that transportation improvements, necessitated by the portion of the project for which a building permit is sought, be made at the time of construction. A traffic study in accordance with City Codes shall be required to address level of service (LOS) for the area. Also in 20o6, the City amended its Future Land Use Map to designate the property for residential (single-family and multi- family) development at a density of up to 2.5 units per net acre and up to 21 acres of commercial space. At the time it was annexed, the property was given the default zoning classification of UE (Urban Estates). Pursuant to Section 122-83 of the City Code, Planned United Development (PUD's) are allowed in the UE district as a conditional use. The enclosed application is for a mixed -use PUD that contains a variety of lot sizes to better accommodate the marketplace and enhance overall aesthetics. The proposed mix of uses and variety of lot sizes can only be accomplished through certain waivers to the City Code.
