The meeting of the Planning & Zoning Commission was called to order Tuesday December 4,
2012 at 7:00 p.m. by Vice -Chair Nick Jones. Other members present were Rob Boyatt, William
Henning, Nick Jones, Judy Proli, and Raymond Loyko. Also in attendance were Jim Hitt,
Planning and Zoning Director, Dan Mantzaris, City Attorney, and Rae Chidlow, Administrative
Assistant.
MINUTES of the Planning and Zoning Commission meeting held November 6, 2012 were
approved as amended.
REPORTS
Planning Director Jim Hitt stated that the City will add a section to the City's website listing the
new businesses that are opening in Clermont. He stated that there will also be a list of new
construction or renovation projects going on within the City.
Vice -chair Nick Jones stated that they would like to see an updated list of the results of the
agenda items that the Commission has voted on. He also requested to have the new City
Manager Darren Gray to attend one of their meetings to meet the Planning and Zoning
Commissioners.
Commissioner Proli moved to change the January meeting to Thursday, January 3, 2013;
seconded by Commissioner Boyatt. The vote was unanimous to change the January Planning
and Zoning meeting date.
1. REQUEST FOR CONDITIONAL USE PERMIT
PROJECT NAME: Vineyards of the World (aka Montrose Street Wine Bar)
REQUESTED ACTION: Request to amend a Conditional Use Permit to extend hours of
operation for a Bar within the Central Business District.

The applicant is requesting to amend their conditional use permit to extend the hours of
operation for their wine bar located at 712 West Montrose Street. Because the City Council
approved the original Conditional Use Permit with the 1:00 p.m. to 11:30 p.m. operating hours as

part of the Conditional Use Permit, in order to change those hours, an amendment to the
Conditional Use Permit is required.
The amendment request is to allow this business to serve alcoholic beverages the same hours as
allowed per code. This would still prohibit sales from 2:00 a.m. to 7:00 p.m., the same as any
other business selling alcoholic beverages. This business is an upscale wine/beer bar that offers
live entertainment, high end wine sales, light snacks and coffee.
Using the Fagade Improvement Grant Program, the owner painted the building and replaced the
canvas awning in front. All Codes are complied with.
Staff recommends approval of this Conditional Use Permit request to operate a Wine Bar located
at 712 West Montrose Street with the following conditions as listed for the proposed hours of
operation.
Yellowmary Montaluo, 1030 Willow Oak Loop, Minneola, stated that she is the owner of the
Wine Bar. She stated that she is requesting to have the same hours of operation as other
restaurants in the area. She stated that they customers get upset when they have to close early.
She stated that they are trying to create a night life ambience in downtown area of Clermont. She
stated that the City should work to try to promote nightlife in the downtown area and feels that
would attract more people to the downtown area.
Commissioner Dubuss moved to recommend approval of the conditional use permit to City
Council; seconded by Commissioner Boyatt. The vote was unanimous to recommend approval
for the conditional use permit to City Council.
2. REQUEST FOR LAND DEVELOPMENT CODE AMENDMENT

To rescind the existing Floodplain regulations and to restate new regulations that integrates with
the Florida Building Code.

SUMMARY:
The National Flood Insurance Program is a federally -subsidized flood damage insurance
program administered by the Federal Emergency Management Agency (FEMA). In order for
residents and business owners to be eligible to purchase flood insurance, communities must
adopt the most recent Flood Insurance Rate Maps (FIRM) and include within their land
development codes policies that comply with FEMA minimum federal regulations.
The Florida Division of Emergency Management has developed a completely new model
ordinance that is coordinated with the Florida Building Code (FBC) which also satisfies the
requirements of the National Flood Insurance Program (NFIP). The proposed ordinance adopts
the language of the model ordinance for communities with inland flood hazards. To insure
compliance with state and federal regulatory agencies, it has been reviewed and affirmed as
appropriate for local approval by the Florida Division of Emergency Management. Deviations
from this model ordinance are not encouraged by the State.
The following are important aspects of the proposed ordinance:
1. The new Floodplain Management chapter ordinance has been standardized in Florida and
has been written to be enforceable.
2. The new Floodplain Management ordinance (FPM) is coordinated with the FBC. The FBC
contains requirements for buildings and structures; the FPM model contains other
requirements necessary for consistency with the NFIP. In order to fulfill community
commitments to the NFIP, the FPM model requires buildings and structures that are
exempt from the FBC and development other than buildings to comply with requirements
of the ordinance if located in flood hazard areas. Examples of structures not covered by
the Florida Buildings Code but covered by Floodplain Management are playgrounds and
agricultural buildings.
3. As written, the Building Official and the Floodplain Administrator are responsible for
different aspects of enforcement but the new regulations coordinate these responsibilities.
This amendment is required by the Federal Emergency Management Agency (FEMA) and the
Florida Division of Emergency Management. All municipalities and counties are required to
amend their respective regulations incorporating these changes.
Staff recommends approval of the amended Floodplain Management Regulations.

to City Council; seconded by Commissioner Boyatt. The vote was unanimous to recommend

Woodwinds Condos — Conditional Use Permit
Because of the density provided by the Future Land Use, and the proximity of the surrounding neighborhoods to
the south (North Ridge) and the east (the Fountain Apartments), staff recommends approval of the conditional use
permit request with the CUP conditions as shown on the resolution.
Summary Explanation/Background
This request is to allow a multi -family residential Planned Unit Development at a density of 10.8 units/
acre. The applicant is proposing to build up to 108 upscale multi -story condos, including some with
basement garages.
This same Conditional Use Permit request was previously approved on August 22, 2006 (Res. No.
1475); September 23, 2008 (Res. No. 1592); and, October 26, 2010 (Res. No. 2010-23). Because of
market conditions, the owner has not started construction within the required two years and each CUP
was rendered void. The owner wishes to retain their development rights associated with approval of the
CUP and variances.
By establishing a Planned Unit Development within the High Density Residential future land use
district, the developer is able to request a maximum density of 12 units per acre. With the heavily
sloped parcel the applicant is proposing to construct 9 residential buildings yielding a 10.8 unit acre
maximum density. The proposed buildings will be terraced to cope with the topography of the parcel.
There are two variances associated with the proposed project.
1) Parking stall size (9' X 18' within garage area under each building)
2) Building height to exceed 45 feet.

CUP CONDITIONS:
Section 1 - General Conditions
1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs,
assigns and successors in title or interest.
2. The property shall be developed in substantial accordance with the conceptual site plan dated
8/16/10 prepared by Montverde Engineering. Formal construction plans, incorporating all conditions
stated in this permit shall be submitted for review and approval by the Site Review Committee prior to
the issuance of a zoning clearance of other development permits. The conceptual site plans submitted
with the CUP application are not the approved construction plans.
3. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve,
move, convert, or demolish any building or structure, or alter the land in any manner within the
boundary of the project without first submitting necessary plans, obtaining necessary approvals, and
obtaining necessary permits in accordance with the City of Clermont Land Development Regulations
and those of other appropriate jurisdictional entities.
4. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been
met.
5. If any of the stated conditions are violated, the applicant understands and agrees that the City
Council may revoke this Conditional Use Permit by resolution.
6. The Conditional Use Permit must be executed and filed in the office of the City Clerk within 90
days of its date of grant by the City Council or the permit shall become null and void.
7. This permit shall become null and void if substantial construction work has not begun within two
(2) years of the date that this Conditional Use Permit is executed and signed by the permittee.
"Substantial construction work" means the commencement and continuous prosecution of construction
of required improvements ultimately finalized at completion.
Section 2- Land Use
1. This CUP is for a multi -family residential development with up to 108 condos on 10 acres, for a
density of about 10.8 dwelling units/acre. The City's Site Review Committee must approve the site plan
prior to the construction plan approval.
2. The project shall be phased to allow the first 80 units of the 108 total, to be built without mitigation
of the student generation. The final 28 units, or phase 2, can only be built under either of the following
conditions:
a. The 28 units in phase 2 can only be built if the applicant and/or builder apply for mitigation
and receive concurrency from the Lake County School Board, as it applies to Florida
Statutes and the School Concurrency requirements, as adopted by the Lake County School
Board and the City of Clermont.
b. The 28 units in phase 2 can only be built if they are age restricted, in accordance with the
applicable laws of Florida, which would result in no generation of students.
Section 3 — Site Development
1. Detailed grading, erosion control, and dust abatement plans for the entire site shall be submitted to
and approved by the Site Review Committee prior to construction plan approval and the initiation of
development activity. The dust abatement plan shall detail measures to be taken to eliminate the
migration of dust particles from the site.
2. All excavated material shall be stored in a location approved by the City Engineer.
3. Geo-technical information regarding the soil characteristics of the site shall be submitted to the City
as part of the final site review process.
4. The permittee/developers shall provide both temporary and permanent grassing including fertilizer
application on all disturbed areas where construction is not immediately intended. Said plan shall be
provided in accordance with an approved ground cover plan acceptable to the City in accordance with
best management practices (BMP) of the U.S.D.A. Soil Conservation Service.
Section 4 — Transportation Improvements
1. Sidewalks shall be required along Grand Highway and within the development, in accordance with
FDOT regulations and City Codes.
2. The City may require that transportation improvements, necessitated by the portion of the project for
which a building permit is sought, be made at the time of construction. Project specific on and off -site
transportation designs are the sole responsibility of the developer.
3. A traffic study shall be required to address level of service (LOS) for the area, including any
connection to U.S. 27 and Hooks St. as needed per Code or policy.
Section 5 — Utilities and Stormwater
1. The permittee shall be responsible for purchasing, installing, and maintaining fire Hydrants within
the project. They shall be installed according to City Code.
2. The project shall be plumbed for reuse water with purple piping, Until such time as reuse water is
available, irrigation water shall be provided for by well.
Section 6 — Landscaping
1. The Landscape design for all parking areas, buffers, rights -of -way, pedestrian ways and focal points
shall be unified and complementary to the ambiance of the center.
2. All landscape plans and plantings shall meet or exceed the City of Clermont Code.
Section 7 - Architectural Design Standards
1. All structures shall be designed and constructed in accordance with the Architectural Standards of
the City of Clermont.
2. All fencing within public view shall be ornamental metal or brick, as approved by the Site Review
Committee.

Christian Brothers Automotive — Conditional Use Permit
Staff believes this development is consistent with the uses in the area and recommends approval of the
Conditional Use Permit request for an automobile repair center with the CUP conditions as provided.
Summary Explanation/Background
The applicant is requesting a conditional use permit (CUP) for an automotive repair center. The proposal is to
construct a new 5,200 square foot repair center with 9 bays for service, a sales office, and inventory area for parts.
As the site plan indicates, the bays will face west and not Highway 50.
The C-2 zoning allows for a wide variety of uses but the proposed use requires a CUP. The applicant is not
requesting to perform any major repairs such as engine and transmission replacement or body repairs. All
proposed automotive work will be done within the walls of the building.
There is one variances associated with the proposed project.

CUP CONDITIONS:
Section 1 - General Conditions
1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs,
assigns and successors in title or interest.
2. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve,
move, convert, or demolish any building or structure, or alter the land in any manner within the
boundary of the project without first submitting necessary plans, obtaining necessary approvals, and
obtaining necessary permits in accordance with the City of Clermont Land Development
Regulations and those of other appropriate jurisdictional entities.
3. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been
met.
4. If any of the stated conditions are violated, the applicant understands and agrees that the City
Council may revoke this Conditional Use Permit by resolution.
5. The Conditional Use Permit must be executed and filed in the office of the City Clerk within 90
days of its date of grant by the City Council or the permit shall become null and void.
6. This permit shall become null and void if substantial construction work has not begun within two
(2) years of the date that this Conditional Use Permit is executed and signed by the permittee.
"Substantial construction work" means the commencement and continuous prosecution of
construction of required improvements ultimately finalized at completion.
Section 2- Land Use
The property is approved for an automobile & tire repair center as well as permitted uses within the C-2
General Commercial Zoning District.
2. The property shall be developed in substantial accordance with the conceptual site plan dated 2012-
10-31 prepared by Howard Civil Engineering. Formal construction plans, incorporating all
conditions stated in this permit shall be submitted for review and approval by the Site Review
Committee prior to the issuance of a zoning clearance of other development permits. The
conceptual site plans submitted with the CUP application are not the approved construction plans.
3. All repairs or service (other than minor repairs such as wiper blades or headlight/taillight bulbs, or
similar minor items) must be done within an enclosed building.
4. Display sales of any vehicle(s) shall not be allowed.
5. No outside storage of any vehicles shall be allowed on site, except for vehicles awaiting immediate
repair.
6. No parking, storage of vehicles or equipment, or other uses of any kind are allowed on any
adjacent right-of-way.
7. In the event that the noise levels create a nuisance to the surrounding property owners, the City
reserves the right to open the CUP for further review and additional conditions. Recurring
documented complainants related to noise or other disturbances emanating from the operation shall
be considered prima facie evidence of a violation of this provision. The owner shall be given
written notice of such violations and shall have seven (7) days after receipt of such notice within
which to demonstrate that adequate measures have been taken to alleviate the source of the
disturbance which gave rise to the recurring complaints. If in the opinion of the Planning and
Zoning Director, the disturbances have not been corrected, the owner will be scheduled for the
next available City Council meeting to determine the appropriate action necessary to alleviate the
disturbance, including any additional restrictions on the operation of the business deemed
necessary to alleviate the complaints.
8. Automotive and truck repair service would be limited strictly to cars, SUVs, vans, recreational
vehicles, dump trucks, agricultural or construction implements such as (but not limited to) tractors
and front end loaders, semi tractors (without trailers attached) and small utility (light) trucks. No
semi -trailer, or heavy equipment (e.g. bulldozers), repairs, parking or storage, shall be permitted.
Section 3 — Site Development
1. Detailed grading, erosion control, and dust abatement plans for the entire site shall be submitted to
and approved by the Site Review Committee prior to construction plan approval and the initiation of
development activity. The dust abatement plan shall detail measures to be taken to eliminate the
migration of dust particles from the site.
2. All excavated material shall be stored in a location approved by the City Engineer.
1. Geo-technical information regarding the soil characteristics of the site shall be submitted to the City
as part of the final site review process.
2. The permittee/developers shall provide both temporary and permanent grassing including fertilizer
application on all disturbed areas where construction is not immediately intended. Said plan shall be
provided in accordance with an approved ground cover plan acceptable to the City in accordance with
best management practices (BMP) of the U.S.D.A. Soil Conservation Service.
Section 5 — Utilities and Stormwater
1. The permittee shall be responsible for purchasing, installing, and maintaining fire Hydrants within
the project. They shall be installed according to City Code.
2. The project shall be plumbed for reuse water with purple piping, Until such time as reuse water is
available, irrigation water shall be provided for by well.
Section 7 - Architectural Design Standards
1. All structures shall be designed and constructed in accordance with the Architectural Standards of
the City of Clermont.
2. All fencing within public view shall be ornamental metal or brick, as approved by the Site Review
Committee.

4. ALL CONSTRUCTION SHALL CONFORM TO MEET FEDERAL, STATE, AND LOCAL CODES, REGULATIONS
AND ORDINANCES.
S. CONTRACTOR SHALL OBTAIN ALL NECESSARY PERMITS PRIOR TO CONSTRUCTION AND ARE TO BE

8. THE OWNER OR LANDSCAPE ARCHITECT SHALL HAVE THE RIGHT TO REJECT ANY AND ALL WORK
AND MATERIALS WHICH, IN HIS OPINION, DO NOT MEET THE REQUIREMENTS OF THE PLANTING PLAN,
DETAILS, AND THESE SPECIFICATIONS.
9. THE LANDSCAPE CONTRACTOR SHALL FIELD VERIFY THE LOCATION OF ALL WORK AS SHOWN ON
THE PLAN AND CONTACT THE LANDSCAPE ARCHITECT IMMEDIATELY OF ANY CONFLICTS AND

10. THE LANDSCAPE CONTRACTOR SHALL EXAMINE THE SOILS OF ALL PLANTING AREAS PRIOR TO

11. THE LANDSCAPE CONTRACTOR SHALL CONTROL RUNOFF AND EROSION DURING CONSTRUCTION
THROUGH THE USE OF SEDIMENT BASINS, STRAW OR HAY BALES AS APPROPRIATE. THE
LANDSCAPE CONTRACTOR SHALL SPRINKLE OR OTHERWISE MANUALLY APPLY WATER TO
AFFECTED CONSTRUCTION AREA TO CONTROL BOTH SIGNIFICANT WIND EROSION AND FUGITIVE
DUST.
12. LANDSCAPE CONTRACTOR SHALL CLEAN THE WORK AREAS AT THE END OF EACH WORKING DAY.
RUBBISH AND DEBRIS SHALL BE COLLECTED AND DEPOSITED OFFSITE DAILY. ALL MATERIALS,
PRODUCTS, AND EQUIPMENT SHALL BE STORED IN AN ORGANIZED FASHION AS DIRECTED BY
OWNER'S REPRESENTATIVE.
13. THE LANDSCAPE CONTRACTOR SHALL ASSURE DRAINAGE AND PERCOLATION OF ALL PLANTING PITS
PRIOR TO INSTALLATION OF PLANT MATERIAL. CONTRACTOR SHALL FILL ALL TREE PITS WITH
WATER BEFORE PLANTING TO ASSURE THAT PROPER DRAINAGE AND PERCOLATION IS AVAILABLE.
CORRECT IF REQUIRED TO ASSURE PERCOLATION. CONTRACTOR IS RESPONSIBLE FOR
REPLACEMENT OF ALL PLANTS DUE TO INADEQUATE DRAINAGE CONDITIONS.
14. EXCEPT FOR PLANTINGS IN OR NEAR SURFACE WATER MANAGEMENT AREAS, THE SPECIFIED DEPTH
OF ORGANIC MULCH, MEASURED AFTER WATERING -IN, SHALL BE PLACED AND MAINTAINED AROUND
ALL NEWLY INSTALLED CANOPY TREES, ACCENT TREES, PALM TREES, AND SHRUBS. EACH TREE

15. TYPICALLY, SHRUB AND GROUNDCOVER PLANTINGS ARE SHOWN AS MASS PLANTING BEDS. PLANTS
SHALL BE PLACED ON A TRIANGULAR SPACING CONFIGURATION (STAGGERED SPACING).
16. ALL CONTAINER AND CALIPER SIZES NOTED ON PLANT LIST ARE MINIMUM. CONTRACTOR SHALL

18. ALL PLANTS SHALL BE CONTAINER GROWN EXCEPT AS NOTED ON PLAN. BARE ROOT TREES ARE

EVENT OF A VARIATION BETWEEN THE PLANT LIST AND THE ACTUAL NUMBER OF PLANTS SHOWN ON
THE PLANTING PLAN, THE PLANTING PLAN SHALL CONTROL.
20. GUYING / STAKING PRACTICES SHALL NOT PERMIT NAILS, SCREWS, WIRES, ETC., TO PENETRATE
OUTER SURFACE OF TREE OR PALM. TREES OR PALMS REJECTED DUE TO THIS PRACTICE SHALL BE
REPLACED WITH INSPECTOR ON SITE.
21. ALL MULCH BED QUANTITIES TO BE DETERMINED BY CONTRACTOR. CONTRACTOR SHALL MULCH ALL
PLANT MATERIAL THROUGHOUT AND COMPLETELY TO A THREE (3) INCH DEPTH WITH CLEAN, WEED
FREE MELALEUCA WOOD CHIPS.
22. LANDSCAPE CONTRACTOR SHALL COORDINATE ALL PLANTING WORK WITH IRRIGATION WORK.
LANDSCAPE CONTRACTOR SHALL BE RESPONSIBLE FOR ALL HAND WATERING AS REQUIRED BY
OWNER'S REPRESENTATIVE TO SUPPLEMENT IRRIGATION WATERING AND RAINFALL. LANDSCAPE
CONTRACTOR SHALL BE RESPONSIBLE FOR HAND WATERING IN ALL PLANTING AREAS, REGARDLESS

23. ALL PROTECTED TREES SHALL BE TRIMMED IN A MANNER CONSISTENT WITH THE "AMERICAN
NATIONAL STANDARD FOR TREE CARE OPERATIONS, ANSI, A300, CURRENT EDITION."
24. ALL PROPOSED LANDSCAPE AREAS AND SOD SHALL BE IRRIGATED WITH AN AUTOMATIC,
UNDERGROUND IRRIGATION SYSTEM. SYSTEM SHALL BE EQUIPED WITH A RAIN SENSOR DEVICE
CONNECTED TO AN IRRIGATION CONTROLLER(S), AS PER STATE OF FLORIDA REGULATIONS. AFTER

THE CONTRACTOR SHALL APPLY THE APPROPRIATE SOIL AMENDMENTS ADJUSTING SOIL PH TO ASSURE
A PH RANGE OF 5.5 TO 6.5.
31. THE CONTRACTOR IS RESPONSIBLE FOR COMPLETE MAINTENANCE OF ALL PLANTING AREAS
(INCLUDING WATERING, SPRAYING. MULCHING, MOWING, FERTILIZING, ETC.) THROUGH THE COURSE
OF THE PROJECT AND THROUGHOUT A NINETY (90) DAY ESTABLISHMENT / MAINTENANCE PERIOD
AFTER SUBSTANTIAL COMPLETION NOTICE BY THE OWNER'S REPRESENTATIVE.
3Z CONTRACTOR TO GUARANTEE PLANT MATERIAL FOR A ONE (1) YEAR PERIOD FOLLOWING DATE OF
SUBSTANTIAL COMPLETION. PRIOR TO ISSUING SUBSTANTIAL COMPLETION NOTICE THE
CONTRACTOR SHALL SUBMIT TO THE OWNER COPIES OF AS BUILT PLANS / DOCUMENTS AND COPIES
OF AN ANNUALIZED MAINTENANCE AND OPERATION MANUAL DETAILING ALL SCHEDULES, NURSERY
PRACTICES, WATERING REQUIREMENTS, FERTILIZATION, TRIMMING, ETC. FOR ALL PLANT MATERIALS
AND PLANT AREAS OF THE PROJECT.
33. CONTRACTOR TO REQUEST INSPECTION OF PROJECT IN WRITING. IF ALL WORK IS SATISFACTORY
AND COMPLETE IN ACCORDANCE WITH CONDITIONS OF CONTRACT DOCUMENTS, THEN THE
OWNER'S REPRESENTATIVE SHALL DECLARE SUBSTANTIALLY COMPLETE. SUBSTANTIAL
COMPLETION CONSTITUTES THE BEGINNING OF THE GUARANTEE PERIOD AND THE NINETY (90) DAY
ESTABLISHMENT I MAINTENANCE PERIOD OF MAINTENANCE.
