ENGINEERING/SURVEYING SERVICES PROPOSAUAGREEMENT
SCOPE OF SERVICE:
Provide engineering and surveying services to design drainage improvements for the southeast
corner of Montrose and West Avenue and the alley lying between Montrose and Desoto. east of
8th Street, at the intersection of Desoto and 8th Avenue, and along 8th Street to Center Lake.
TASK I
ROUTE SURVEY
Field locate right-of-way. pavement grades, underground utilities, and existing stormwater
structures. Locate existing above ground features such as buildings. sidewalks, and
parking areas within the limits as shown on the attached aerial photograph.
Fee: $21,575.00
TASK II
STORMWATER SYSTEM DESIGN
A.
Design of a stormwater conveyance system to intercept stormwater runoff on the south side
of Montrose Street draining westerly towards West Avenue adjacent to the police station
in order to intercept stormwater and drain or convey south into the police station parking
lot ultimately through the stormwater pond south of the police station. The drainage design
will also consider the sidewalk and driveway grades north of the auto repair shop and
landscape island and curb grade for the southeast corner of the intersection of Montrose
and West Avenue.
B.
Design of a stormwater collection and conveyance system to collect stormwater runoff from
the alley way lying between Montrose and Desoto conveying stormwater through a
proposed easement to Desoto to tie into proposed inlets on Desoto east of 8th Street
intersection then southerly along 8th Street to Center Lake and modification of 8th Street and
drainage system at 8th Street and Center Lake north of Junata Street.
C.
Construction plans shall include construction details and specifications.
Fee: $6,800.00
TASK III
PROJECT ADMINISTRATION
The scope of services shall include administrative services necessary to coordinate all aspects of
the project through the planning, design and permitting phase. These services shall include project
scheduling with all regulatory agencies and public utility companies during the design and
permitting phase of the project. Bid documents preparation and bid coordination with site work
contractors.
Fee: $1,800.00

TASK IV
CONSTRUCTION ADMINISTRATION
All necessary inspections, final certifications and as-builts as required by permit conditions which
consist of the following:
A.
Farner, Barley & Associates. Inc., will advise and consult with Owner and act as its
representative during construction. Farner, Barley & Associates, Inc., will make one weekly
visit to the site to observe the progress and quality of the executed site work and to
determine in general if the work is proceeding in accordance with the construction drawings.
Farner, Barley & Associates, Inc., will review and approve shop drawings, results of tests
and inspections and other data that the contractor is required to submit.
Based upon the on-site observations and a signed and sealed as-built survey provided by
the contractor, Farner, Barley & Associates, Inc. shall prepare and submit as-built
construction drawings and certifications of completions to the owner and the following
State and local agencies as required:

GENERAL CONDITIONS
A.
TERMINATION:
The agreement may be terminated by either party upon thirty (30) days written notice.
B.
REQUEST FOR SERVICE:
Any request to replace or repair existing work such as survey control points shall be
complied within a reasonable time period of twenty-four (24) hours.
C.
DOCUMENTS:
All original drawings. computations, details, design calculations, and electronic media that
result from Farner, Barley & Associates, Inc.. services are the property of Farner, Barley
& Associates, Inc. Upon payment if full for services completed. client may at his expense,
obtain copies of any documents or reproducible copies of drawings. In doing so. client
agrees that no additions. deletions. changes or revisions shall be made to same without the
express written approval of Farner, Barley & Associates. Inc.
D.
RENEGOTIATION:
The hourly rates given in this contract are applicable through January 1, 2005, and are
subject to renegotiation on January 1. each year, thereafter (contract prices shall remain
as quoted).
E.
REGULATORY REQUIREMENTS:
The fees quoted herein are quoted based on all regulations, state and or local that are
presently in effect as of this date. If regulations change during the permitting and design
phase of this project, Farner. Barley & Associates, Inc.. reserves the right to renegotiate
fees for services that may be affected by regulatory changes.
F.
PERMIT ACQUISITION
Farner, Barley & Associates, Inc., cannot guarantee the acquisition of all permits/approvals.
However, we will strive toward this end. Client is responsible for payment of all consulting
fees due Farner, Barley & Associates. Inc.. regardless of agency/governmental actions.
COMPENSATION
A.
ADDITIONAL SERVICES:
Farner, Barley & Associates, Inc., will be compensated for additional services, such as:
1.
Changes in scope of services defined in this contract at the client's request.
2.
Revisions caused by changes of governmental requirements after the date of this
agreement.

Redesign per client after preliminary design has been submitted to the approving
agency.
B.
OUT-OF-POCKET EXPENSES:
In addition to the fee schedule and any additional services, Farner, Barley & Associates,
Inc., shall be reimbursed for out-of-pocket expenses for actual cost, such as: blueprints,
copies, plots, aerials. express deliveries, specialized postage. and travel outside of the
Central Florida area.
C.
ACCEPTANCE:
Billing shall be sent on a bi-monthly basis and each shall reflect the percentage of work
completed during the billing period. All invoices shall be paid within fourteen (14) days. All
unpaid balances after fourteen (14) days shall be subject to a finance charge of 1.5%
interest. Farner, Barley & Associates. Inc., reserves the right to withhold submittal of
applications until such time that all unpaid balances have been satisfied. The undersigned
will pay all costs and expenses, including a reasonable attorney's fee, incurred or paid by
Farner, Barley & Associates, Inc., in the collection of this obligation by suit or otherwise.
Farner, Barley & Associates, Inc.. reserves the right to stop work on the above agreed
scope of services if any invoice remains unpaid in its entirety for more than 60 days.
Any and all outstanding balances shall be paid or brought current before submittal of Final
Improvement Drawings and or Final Plat for approval by state and local agencies.
