JULY 12, 1999
The meeting of the Planning & Zoning Commission was called to order Monday, July
12, 1999 at 7:05 p.m. by Mayor Turville with the following Council Members in
attendance: Council Member Biddle and Council Member Wolfe. Planning and Zoning
Members in attendance were: Joseph Janusiak, Charles Forth, Matt Modica, Elaine
Renick, Bill Rauch and Misty O'Bar. Also attending were Wayne Saunders, City
Manager, Barry Brown, Principal Planner, Tamara Richardson, City Engineer and Mimi
Ogden, Planning and Zoning Specialist.
Planning Director Brown explained that Staff would go through the list of changes that
had been provided in the packets distributed to the Council and the Commission.
City Engineer Richardson explained that the proposed change to Section 94-194 would
require a reclamation plan and a reclamation bond. Proposed changes to Section 94-
221 are for clarification of the Citys stormwater retention requirements.
Principal Planner Brown explained the proposed changes to Chapter 98 which adds
some uses that are not presently addressed. Mayor Turville suggested a minimum
number of parking spaces, perhaps 2 or 3, be required for warehousing. Council
Member Wolfe suggested that the parking requirements for a church be changed from
1 space per 4 seats in the sanctuary to-1 space per 3 seats in the sanctuary.
Planning and Zoning Specialist Ogden explained that the proposed change to Chapter
102, Section 102-7 is simply adding the allowance for "for sale" and "for lease" signs in
commercial areas to be 32 square feet. Discussion followed regarding potential
regulations for dealing with off-site directional signs that are being placed in the right-of-
ways throughout the City.
City Engineer Richardson explained the proposed change to Chapter 106, Section 106-
6 will require a site lighting plan to be submitted in the site plan review process. The
addition of "or designated representative" to Chapter 110, Section 110-8 is for
clarification, as the City does now have their own inspector. Section 110-32 (c) and (d)
should be deleted and a paragraph added that states "plan approval shall be valid for
12 months, unless the plat has been recorded. If the plat is recorded, the approved
plans shall be valid for a period of 2 years unless substantial construction has begun".
Section 110-192 would allow the construction of private streets with the approval of the
City Council. Mayor Turville expressed his concern with private streets that may create
a physical barrier that may require traffic to be directed back to Highways 50 and 27.
Council Member Wolfe expressed his concern with traffic going through residential
neighborhoods. City Manager Saunders suggested that the regulation remain as it is.

Should a developer wish to construct private streets a variance would be required which
would give the Council the opportunity to review each request on a case by case basis.
A sentence should be added to that should private streets be approved they must be
constructed to City Code.
City Engineer Richardson explained that the Public Services Director has requested
that Chapter 110, Section 110-194 subbase, base and pavement requirements be
change to require 2 inches of asphalt rather than I~A inch. Rick McCoy of Miller,
McCoy and Einhouse, stated that other municipalities require only 1 inch. Council
Member Wolfe asked if this change would reduce the amount of maintenance the City
would need to do to the roads in the future. City Manger Saunders noted that this
would reduce the cost of maintenance. Mr. McCoy noted his concern with using a
thicker layer of S-3 asphalt which does not contain a lot of aggregate and may be easily
deformed, suggesting that perhaps an S-1 asphalt which contains more aggregate may
be a better solution. City Manager Saunders noted that Staff would investigate other
possibilities.
Regarding Chapter 110, Section 110-232, City Engineer Richardson noted that the
proposed amendment would require storm sewer inlets and pipes to be designed to
provide a minimum of 5 foot clear travel are for each lane centered in the center of the
roadway. Mr. Rick McCoy stated that other municipalities in central Florida allow an
inch over the crown with standard curbing. City Manager Saunders explained that 5
foot clear travel lane at least gives a vehicle enough room to maneuver around a large
puddle and also helps to prevent hydroplaning.
City Engineer Richardson explained that the change to Section 110-265 is simply to
bring the sidewalk slope into conformance with ADA regulations. The change to
Section 110-269 is again simply for clarification of the Citys storm drainage system
requirements. Mr. McCoy stated that he had some concerns with the use of the plastic
pipe on steeper slopes, suggesting that velocity limits be placed on the use of this pipe.
City Engineer Richardson stated that she would investigate Mr. McCoys concerns. City
Manager Saunders suggested that the use of the pipe be based on grade rather than
velocity.
City Engineer Richardson noted that the changes recommended in Section 110-270(c)
are for clarification, ensuring that the minimum main size and flow rate are consistent
with those listed in the table. Also included in this section is an amendment changing
the minimum size of single service lines to 1 inch, changing double service lines to 2

inch and requiring a wye to provide future connection for an irrigation meter. Mr. McCoy
stated that he was concerned with this change as this would double the number of
service lines going underneath the pavement, which would double the chance of a leak.
Also, there would be more potential flow with one 11~ inch line than there would be from
two 1 inch lines. City Engineer Richardson stated that she would consult with Preston
Davis, Director of Public Services regarding these changes. The changes to paragraph
(e) of Section 10-270 are simply to require that all reuse water lines and appurtenances
to be colored purple.
Changes to Chapter 114, Section 114-3 would require that underground utilities be
installed by an underground contractor licensed in the State of Florida. Changes to
Section 114-4(a)(1), again requires services with a one-inch wye to accommodate
irrigation meters. Section 114-4(a)(3) would mandate that pressure reducing valves be
installed in all water mains serving developments on the east water system and also
requires that individual services with pressure greater than 80 psi be equipped with
individual pressure reducing valves. Changes to Section 114-4(b) specify the design
standards for water distribution systems.
City Engineer Richardson explained the proposed changes to Section 114-4(c) Fire
Hydrants. Paragraph (8) would require that all hydrants and mains, including those
privately owned, that are connected to the City's potable water system to conform to
City construction standards and spacing requirements. City Manager Saunders
explained that the City is now providing water to areas outside of the City limits. The
Fire Department would like the hydrants to be installed per the Citys code which is a lot
more stringent than Lake Countys code. The reasoning for this is that should these
'areas be annexed into the City at a later date, the City would be able to provide good
fire service. The City Attorney has been asked to investigate if the City can require this
of developments that are not within the City limits.
Rick McCoy stated, regarding the Minimum Main Size, Flow Rate and Hydrant Spacing
table, that a strict interpretation of these requirements can cause problems and gave
examples. City Engineer Richardson agreed that there are rare occasions when the
required main size may be excessive to serve a particular use and in these instances, if
it can be demonstrated that fire flows can be met with a smaller line it could be
reviewed and considered. City Manager Saunders suggested that an addition be made
to this paragraph that would allow the City Engineer and Fire Department to review and
approve a smaller main size if a project engineer can demonstrate that adequate fire
flow can be obtained with a smaller line size.

City Engineer Richardson noted the proposed changes to Section 114-5(4) would
require a minimum 750 gallon grease trap in sewer services for establishments that
prepare food or as determined necessary by the Public Services Director. Council
Member Biddle stated that there are businesses such as his, that are licensed to
prepare food but the license does not permit them to produce grease. Engineer
Richardson explained that this is intended for large scale food production facilities.
Director of Planning Brown explained the proposed changes to Chapter 118,
Vegetation. The proposed changes would require a minimum 2~ inch caliper rather
than the 1~ inch that is presently required, and increase the minimum height from 8
feet to 10 ten. It was agreed to change the minimum caliper size to 3 inches.
Discussion followed regarding requiring replacement trees to be larger, i.e. 6 inches in
caliper.
Discussion followed regarding the sodding of lots. It was decided to require that at a
minimum lA acre must be sodded on residential lots and to add "or other approved
ground coverings".
Planning and Zoning Specialist Ogden explained the change to Section 122-37 and
Section 122-343 were for clarification purposes only.
Planning Director Brown noted the proposed change to Section 122-224 would require
structures over 50,000 square feet in the C-2 zoning district to require a Conditional
Use Permit. It was decided to amend the change to require a Conditional Use Permit
for structures over 20,000 square feet.
Rick McCoy suggested that the City adopt architectural review standards. Mayor
Turville directed Staff to draw up architectural review standards.
After discussion of regulations for landscape buffers and landscape islands, Staff was
directed to explore several options. It was the consensus of the Council and the
Commission that palm trees should be removed from the preferred tree list. Staff was
directed to do further research on formulating an ordinance for adult bookstores and
adult oriented establishments. Staff was asked to contact several fence companies and
ask if they know of any historical problems with green vinyl fencing. Staff was also
asked to do further research into requiring water retention areas to be landscaped.

City Manager Saunders noted that several citizens have asked that the Open Air Sales
Permit Ordinance be amended to allow more than one per year and asked that the
Council and Commission weigh this issue and perhaps it can be discussed at the next
workshop. City Manager Saunders also noted that it has been discussed in the past
that the M-1 zoning district be amended to allow a maximum impervious surface area of
80% rather than 60% and the requirement that when a variance is granted "construction
must be completed within one year", should be changed to state "construction must be
started within one year".
Member Elaine Renick explained that the Planning and Zoning Commission has spent
a lot of time discussing changing the landscape ordinance to require berms within the
landscape buffer. Director of Planning Brown stated staff would explore some options
for berm requirements and report his findings at the next workshop.
The next Joint Workshop was scheduled for August 23, 1999 at 6:30 p.m.
