Resolution No. 2021-009RCITY OF CLERMONT FAILED RESOLUTION NO.2021-009R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, FLORIDA CREATING A SPECIAL POLICE DEPARTMENT CITIZENS ADVISORY COMMITTEE; PROVIDING FOR THE PURPOSE; MEMBERSHIP; QUALIFICATIONS; STAFF ASSIGNMENT/ RESPONSIBILITIES; CONDUCT OF MEETINGS; CONFLICT AND AN EFFECTIVE DATE. . WHEREAS, pursuant to Section 2-61 of the City Code, the City Council has the authority to create special committees as the Council deems in the best interest of the City of Clermont; WHEREAS, a safe community is made possible by a strong, positive and trusting relationship between the community and the police department; WHEREAS, the effective delivery of public safety services requires police partnering together with the citizens to ensure the safety of all its residents and those visiting; and WHEREAS, the City Council has determined that it is in the best interest of the citizens of the City of Clermont, to create a special limited advisory committee to bring feedback to the Police Department from the community concerning public safety issues. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont, Florida that: SECTION 1: The City Council of the City of Clermont does hereby create a committee to be known and designated as the Clermont Police Department Citizens Advisory Committee subject to the following: 1. Purpose The purpose of the Police Department Citizen Advisory Committee is to act in an advisory capacity to bring the Police Department feedback from the community concerning public safety issues and law enforcement needs and actions. The Police Department Citizen Advisory Committee shall focus its efforts on facilitating the flow of ideas relative to police services for the continued improvement of the quality of life of the community. 2. Membership There shall be five (5) members of the Police Department Citizen Advisory Committee. The seats shall be numbered one (1) through five (5), shall correspond to the numbers of the seats on the City Council and shall be appointed by the council member filling that seat. All seats shall be coterminous positions with the corresponding council seat. Page 11 of 4 CITY OF CLERMONT RESOLUTION NO.2021-009R 3. Qualifications To qualify as a member, the individual must be a registered elector for the City of Clermont and shall satisfactorily completed a criminal background check as determined by the City Manager. No member shall serve more than three consecutive terms. Any appointed member who does not attend a minimum of three meetings in a calendar year, without an approved absence by the Chairperson, shall be disqualified from membership on the Police Department Citizen Advisory Committee. 4. Staff Assigninent/Committee Responsibilities a. The City's Police Chief, or his designee, shall be the lead staff for the Police Department Citizen Advisory Committee and shall update the committee on a regular basis with regard to matters related to the Committee's established purpose. The Police Chief shall designate necessary staff to provide administrative support to the Committee. b. In addition to such items as may be presented by the Police Department or as may be requested or assigned by the City Council, the Committee shall: i. Review closed citizen complaints and completed internal investigations in the following instances: 1. Use of deadly force 2. Alleged use of excessive force 3. Any instances wherein police action resulted in death or serious bodily injury ii. Review established policies, procedures, rules, regulations, general or special orders pertaining to the use of force and police conduct towards the citizenry. iii. Where applicable, the Police Department Citizen Advisory Committee shall provide recommendations and comments with regard to the matters presented or reviewed. The recommendations and comments shall be included in a report to be timely provided by the Chairperson, or in his or her absence, the Vice Chairperson, to the Police Chief. 5. Conduct of Meetings Police Department Citizen Advisory Committee shall meet quarterly at a time and in a place as designated by the Police Chief or his designee. The Police Department Citizen Advisory Committee shall operate in accordance with applicable law. At its first meeting of each calendar year, the committee shall appoint a chairperson, who shall conduct the meetings and a vice chairperson who shall conduct the meetings in the absence of the chairperson. A quorum of three (3) shall be required to conduct official business of the committee. Page 12 of 4 A CITY OF CLERMONT �XTr `�. ,:,, RESOLUTION NO.2021-009R SECTION 2: CONFLICT All resolutions, rules, regulations, restrictions, or policies of the City of Clermont in conflict herewith are hereby repealed to the extent of the conflict.
