COUNCIL WORKSHOP MEETING
March 25, 1999
A Workshop Meeting of the City Council of the City of Clermont was held Thursday,
March 25, 1999, at the Police Department. The meeting was called to order at 6:00 p.m.
by Mayor Turville. Council Members Jeff Biddle, Jim Brown, Hope Lamb and Speedy
Wolfe were present. Also present were City Attorney Baird and City Manager
Saunders
City Attorney Baird presented the Council with an update on the Utilities, Inc. vs. The
City of Clermont with regards to the water service to be provided on the west side of
Highway 50, specifically the proposed Legends project by Lennar Homes.
City Manager Saunders provided each Council Member with a memo he had received
from Jake Varn, the attorney who has been handling the suit for the City. The memo
outlined the City's options. After considerable discussion there was consensus to
proceed to defend the Summary Judgment. City Attorney Baird left the meeting at
approximately 6:30 p.m.
Representatives of Jaymark Development joined the meeting. Mr. Joe Zagame and Mr.
Bob Shaker explained to the Council the proposed recreation area for the Lost Lake
Reserve project. They explained that they are proposing to dedicate approximately
eleven acres to the City for recreational use and would not be requesting any impact fee
credits for the land value. Mr. Shaker did discuss with the Council the possibility of
building certain recreational facilities on the site for which they would seek recreation
impact fee credits.
Council Member Lamb then stated that she had received a letter written by Mr. Matt
Modica who had requested that it be read into the record regarding the grading issues at
the Lost Lake Reserve area. City Manager Saunders asked the Jaymark representatives
if to the best of their knowledge they were within the parameters of their grading permit
and Mr. Shaker stated that he was sure they were operating within the permit
limitations.
The next item to be discussed was the short-listing of the attorneys who had submitted
letters of interest and qualifications for the City Attorney position. After considerable
discussion the Council short-listed the firms to include Fowler, Barice, Feeney &
O'Quinn, Leslie Campione, Frank Kruppenbacher, and Fishback, Dominick, Bennett,

Stepter, Ardaman, Ahlers & Banks. City Manager Saunders explained that this would
need to be placed on a City Council Agenda for a vote and this could be done at the
upcoming Council meeting. He further explained that the short-listed applicants would
be invited to make presentations to the Council at an upcoming workshop.
Mr. Ken Norquist was in the audience and addressed the Council concerning an
interpretation of the City's Land Development Regulations and Comprehensive Plan
with regards to commercial development in the flood plain as it relates to docks in the
Central Business District. City Manager Saunders stated that he would provide
additional information regarding this as well as ask for an opinion from the City's
attorney regarding the language that is now in the Comprehensive Plan.
There being no more business, the meeting adjourned at 7:40 p.m.
