02-09-1999 Regular Meeting CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 A regular meeting of the City Council of the City of Clermont was held Tuesday, February 9, 1999 at Jenkins Auditorium. The meeting was called to order at 7:30 p.m. by Mayor Turville with the following Council Members present: Council Member Biddle, Council Member Brown, Council Member Lamb and Council Member Wolfe. Other City officials present were City Manager Saunders, City Attorney Baird, Planning Director Harker, Principal Planner Brown, and Deputy City Clerk Whitlock. INVOCATION The Invocation was offered by Council Member Brown followed by the repeating of the Pledge of Allegiance to the Flag by all present. MINUTES .. 99-030 A motion was made by Council Member Biddle, seconded bY Council Member Brown, and carried unanimously to approve the minutes of the regular Council Meeting hem Januarv 26, 1999 with Council Member Wolfe noted as giving the invocation rather than Council Member Brown. CITY MANAGER SAUNDERS' REPORT Palatlakaha Recreation Area Fee Waiver and Possible Field Conversion City Manager Wayne Saunders stated that the Little League and Girl's Softball League met with Council Member Biddle and recommend that the Senior League field at Palatlakaha Recreation Area be converted to a sot~ball field. He stated that a review of the field for a conversion possibility is currently being performed and he recommended that the Council approve the conversion to a Little League field provided no major problems are found or no better solution is developed. 99-031 A motion was made by Council Member Biddle and seconded by Council Member Brown to convert the senior fieM to a softball fieM at Palatlakaha CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 2 Recreation Area, and that the_fees be waived for practice at Palatlakaha Recreation Area_for the next 2 ~ weeks. The motion was dropped and not voted upon. Council Member Lamb stated she was concerned that no public hearing was held to discuss this issue. Matt Modica stated that the field conversion proposal was not brought before Little League's Board of Directors and he stated he was against any field reconfiguration at Palatlakaha Recreation Area. Louann Edwards stated that the parents had not been notified of the proposed reconfiguation and they would appreciate an opportunity to speak. 99-032 A motion was made bp Council Member Wolfe, seconded b? Council Member Lamb, and carried unanimous!¥ to waive all fees at the Palatlakaha Recreation Area_for 2-1/2 weeks of practice before the regular season. Oak Hill Cemetery Well City Manager Saunders stated that the problems have occurred with the well drilling for the new well at Oak Hill Cemetery. They can abandon the well which is drilled to 200', costing approximately $5,600, or go deeper and put in a 6" casing for an estimated total cost of $7,100. 99-033 A motion was made by Council Member Wolfe, seconded b? Council Member Lamb, and carried unanimousl_¥ to approve drilling deeper_for the Oak Hill Cemete~_ well, for a total estimated cost 0f$7,100. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 3 MAYOR TURVILLE'S REPORT Tree City USA Mayor Turville reported that he received a copy of a letter from Bob Crawford, Agriculture Commissioner to the National Arbor Day Foundation recommending Clermont to receive the Tree City USA award. COUNCIL MEMBER WOLFE'S REPORT Lincoln Park Task Force Council Member Wolfe reported that the Lincoln Park Task Force is planning a dedication of McKinney Park on March 27 and they will be requesting publicity for the event. A workshop is scheduled for February 17 to coordinate a "Spruce Up Clermont" at the same time. The Kiwanis Club will be doing landscaping, which should be done before the dedication. City Attorney Search Council Member Wolfe asked City Manager Saunders to report on the search for City Attorney and if specifications had been established. City Manager Saunders stated that advertisements have been placed in the Lake Sentinel and the Orlando Sentinel which asked for proposals. He stated that prior Council discussions regarding specifications for City Attorney were to advertise for an attorney with land use law and municipal experience. Council Member Wolfe asked that an ad also be placed in the Law Review and to check with the League of Municipalities regarding their recommendations. Mayor Turville stated that the Council had discussed specifications at the retreat and had decided not to develop specifications in order to keep all options open. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 4 COUNCIL MEMBER BROWN'S REPORT Oak Hill Cemetery Markers Council Member Brown stated he received a letter from Dorothy Turner who has been refused a second marker for her husband's grave. He asked that cemetery marker guidelines be placed on a Council Workshop agenda. Kehlor Park Tennis Court Aprons Council Member Brown stated that the aprons around the tennis courts at Kehlor Park are muddy in the rainy season and additional pavement may bc desirable. COUNCIL MEMBER BIDDLE'S REPORT Cooper Memorial Library Council Member Biddle reported that Cooper Memorial Library served 867 people in one day last week. Chamber Activities Council Member Biddle reported that former Council Member Ann Dupee was honored as "Citizen of the Year" at the South Lake Area Chamber of Commerce's annual banquet. He also presented a Certificate of Appreciation to the City of Clermont from the Chamber. CITY MANAGER SAUNDERS' REPORT (Continued) Council Members agreed to hold a workshop to discuss the Fire Department on Thursday, February 25 at 6:00 p.m. in the Police Department Community Room. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 5 UNFINISHED BUSINESS IXC Communications - Resolution 1047 Mayor Turville read Resolution 1047 by title only. City Manager Saunders explained that the request is for a Conditional Use Permit for the construction of a fiber optics regeneration station on Lot 19 of Clermont Commons. He stated that the request was tabled from the previous Council meeting following questions regarding the safety of the facility and if there would be any type of operation taking place that would be detrimental to the neighborhoods surrounding this area. Mayor Turville stated that the request requires that a Quasi-Judicial Hearing be held and that anyone wishing to speak in favor of or in opposition to the request should be sworn in. S, Austin, TX Rt. 1, Box 26, Kingsland, TX 713 Montrose Street, Clermont, FL 908 Roanoke Drive, Clermom, FL 810 Highpoint Circle, Minneola, FL Rick McCoy stated he is the engineer for the project. He explained that they propose to build a 1,000 square foot unmanned building to house fiber optic regeneration equipment on Lot 19 of Clermont Commons. Kim Boulden stated that fiber optic cables are glass and use light waves. The equipment is powered by direct current batteries that clarifies light and transfers it to the next facility which is near Miami. He explained there is no noise normally generated. A generator located outside of the building will have a noise barrier around it. The generator is for emergency use in the event of a power outage. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 6 Karen O'Brian stated she no longer had concerns. She questioned the landscaping plans, particularly on the slope. Victor Saul asked what light industrial allows and asked about a sidewalk on South Avenue. City Manager Saunders stated that staff and the Planning and Zoning Commission recommend approval of the Conditional Use Permit. The landscape plans were reviewed and he explained that a sidewalk on South Street cannot be addressed because that is in the city limits of Minneola. City Clerk Van Zile swore in Elaine Renick, 1974 Brantley Circle, Clermont who asked if there is a sound barrier for the generator. Rick McCoy explained that Condition #24 requires a masonry wall to buffer the noise. 99-034 A motion was made bY Council Member Biddle, seconded bY Council Member Lamb and carried unanimousl_¥ bY roll call vote to adopt Resolution 1047 for a Conditional Use Permit for the construction ora fiber optics regeneration station on Lot 19 of Clermont Commons_for LYC Communications. Final Reading of Ordinance 376-M Mayor Turville read Ordinance 376-M by title only. City Manager Saunders stated the ordinance will close a portion of 3 rd Street that lies north of S.R. 50 and runs from S.R. 50 to the south edge of Crystal Lake Drive. He explained that this portion of 3 rd Street is very steep and is approximately 200' long. Recommendation is for approval with the condition that the property owners grant to the City a 30' wide easement along either the western or eastern boundary of the property. A single property owner owns both sides of 3 rd Street and this will allow them to develop a facility utilizing both parcels. Mayor Turville opened the public hearing. Nancy Fullerton asked about the location of the property, if it was currently being used, and what was proposed to be built there. George Fioga stated he owned the property and he plans to locate an office building on the property. 99-035 A motion was made bY Council Member Wolfe, seconded bY Council Member Lamb and carried unanimously bY roll call vote to adopt Ordinance 3 76-M, closing and abandoning a portion of 3 rd Street that lies north ofS. R. 50 and runs from S.R. 50 to the south edge of C~_ stal Lake Drive. Contract Approval - C.T. Hsu City Manager Saunders stated that the Council asked that an analysis of the old Hospital be included in the scope of services for a possible city hall site. He stated he met with C.T. Hsu today and toured the old Hospital, however, they will need a few days to review plans and make a proposal to include the analysis in their scope of services. He recommended tabling the contract approval with C.T. Hsu until the February 23 meeting. 99-036 A motion was made bY Council Member Wolfe, seconded bY Council Member Biddle, and carried unanimously to table the contract approval with C.T. Hsu_for space needs analysis and site analysis for a new city hall until the Februa~ 23, 1999 meeting. NEW BUSINESS Contract Approval - George Wood City Manager Saunders reviewed the proposed contract with Mr. George Wood for the preliminary analysis of the possible expansion of the Kehlor Park facility and McKinney Park pavilion. He stated that the total project will be $14,000, however he asked that Phase 1 for Kehlor Park in the amount of $4,900 and McKinney Park pavilion in the amount of $1,800 be approved at this time for a total of 6,700. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 8 99-037 A motion was made by Council Member Biddle, seconded bP Council Member Brown and carried unanimously to approve Phase 1 of Kehlor Park in the amount 0f$4,900 and McKinne¥ Park pavilion in the amount of $1,800 to George Wood. Introduction of Ordinance 291-C Mayor Turville read Ordinance 291 by title only and stated that the final reading and public hearing will be held February 23. City Manager Saunders stated that the ordinance will remove existing submittal times fi:om our Code of Ordinances for various items such as Conditional Use Permits and allow the City Council to establish different submittal times by Resolution. The time-frames that are now in place do not allow the staff or Council adequate time to review projects before making recommendations or decisions. Introduction of Ordinance 377-M - Small Scale Comprehensive Plan Amendments Mayor Turville read Ordinance 377-M by title only. City Manager Saunders stated that the ordinance includes two Small Scale Comprehensive Plan Amendments that were discussed at the recent City Council retreat. Amendment # 1 is being requested by the Chester Fosgate Company and is for approximately 6 acres of vacant land located north of S.R. 50, east of Hancock Road. This is a triangular piece of property that lies on the north side of a larger commercial parcel. This piece remained after the Levitt Homes property boundaries were determined for the Summit Green development and will join this approximate 6 acres with the approximate 33 acre parcel to the south. Amendment #2 is for an approximate 3.1 acre parcel located on the south side of S.R. 50 approximately 800' west of the intersection of S.R. 50 and Citrus Tower Boulevard which is currently zoned R-3 and allowable uses are residential and professional. The Small Scale Amendment will allow commercial use on the northern 3.1 acres of a larger 9 acre parcel. The 3.1 acres fronts S.R. 50. Mayor Turville stated that the final reading and public hearing will be held February 23. CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 9 Sanitation Truck Overhaul City Manager Saunders stated that Public Service Director Davis is recommending approval of $26,000 for the refurbishment of our 1990 EVO garbage truck side loader. This truck is manufactured by Lodal, Inc. and there is only one authorized service center in Florida. Container Systems Equipment Co., Inc., the Lodal Florida service center, has quoted $23,568 for the refurbishment work that needs to be accomplished along with an option of $610 for a new steering box if required. 99-038 A motion was made bP Council Member Biddle, seconded bP Council Member Brown, and carried unanimousl_¥ to approve the $26,000 quote by Container S~¥stems Equipment Co., Inc. to refurbish the 1990 EVO garbage truck side loader with an option of $61O for a new steering box ~f required. Plat Approval - Manchester at Kings Ridge City Manager Saunders stated that staff is recommending final plat approval for Manchester at Kings Ridge which is part of the originally approved DRI for the Kings Ridge development. He stated that the plat has been reviewed and is now ready for final recording. 99-039 A motion was made by Council Member Wolfe, seconded by Council Member Lamb and carried unanimous!¥ to approve the final plat for Manchester at Kings Ridge. Resolutions 1053 Mayor Turville read Resolution 1053 by title only. Finance Director Van Zile stated he is in the process of preparing an annual financial report for the prior fiscal year and a part of the process are the amendments, the majority of which were previously approved by the Council. He explained that Resolution 1053 addresses only the General Fund items and the adoption of the Resolution is a housekeeping matter for final audit purposes and CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING FEBRUARY 9, 1999 Page 10 does not affect the current year's budget. He reviewed the items listed in Resolution 1053. 99-040 A motion was made by Council Member Biddle, seconded by Council Member Lamb and carried unanimous!¥ b~ roll call vote to adopt Resolution 1053. Resolution 1054 Mayor Turville read Resolution 1054 by title only.
