THIS IS AN AGREEMENT by and between THE CITY OF CLERMONT, a political
subdivision of the State of Florida, hereinafter referred to as the "City";

WHEREAS, in the interests of ensuring the protection of the public health and
welfare, and the rights of the citizens at the City to enjoy public access to and trom their
properties; and
WHEREAS, the Property, which is the subject of this Developer's Agreement, is
more fully described in Exhibit "A"; and
WHEREAS, The Owners are voluntarily entering into this Agreement;
IN CONSIDERATION OF the mutual terms and conditions, promises, payments
and covenants hereinafter set forth, the parties agree as follows:
SECTION 1. Recitals Incorporated.

The above recitals are true and correct and incorporated herein.
SECTION 2. City Obligations.
The City shall pave and maintain, at public expense, the public prescriptive right-of-
way providing ingress and egress to the Owners' property, substantially in accordance
with the attached Exhibit "B".
SECTION 3. Use ot Right-ot-Way.
The City recognizes and agrees that the public prescriptive right-of-way is no more
than twenty (20) feet in width, and has been historically used for residential purposes.
No increase or alteration in the type or amount of use is contemplated by this Agreement.
Any such increase or alteration would be inconsistent with the residential nature of the
right-of-way as well as a potential violation of the right-of-way and road improvement
standards of the City, and as such is expressly prohibited.
SECTION 4. Entire Agreement.
This document incorporates and includes all prior negotiations, correspondence,
conversations, agreements, or understandings applicable to the matters contained herein.
The parties agree there are no commitments, agreements or understandings concerning
the subject matter of this Agreement which are not contained in this document.
Accordingly, it is agreed no deviation from the terms hereof shall be predicated upon any
prior representations or agreements whether oral or written.
