RECYCLE AGREEMENT FOR WASTEWATER SLUDGE DISPOSAL

of County Commissioners of Sumter County, Florida (County) and City of Clermont (City),
Lake County, Florida.
WHEREAS the County has pennitted and constructed a facility utilizing treated
domestic sewage sludge (SLUDGE) as an addItive in its Municipal Solid Waste (MSW)
compo sting digester, and
WHEREAS the both parties presently have a verbal agreement for the County to use
City SLUDGE through temporary FDEP approval, and both parties now desire to enter into a
continuing contract, and
WHEREAS, the City has a continuing need to dispose of SLUDGE from its west side
municipal sewage treatment plant (STP), and
WHEREAS both parties desire to enter into a written agreement outlining the
responsibilities of the County and City.
NOW, THEREFORE, the parties agree as follows:
1.
The City wil.1 obtain, with County assistance if needed, a modification to the City's
FDEP permit allowing the west side STP to dispose of the SLUDGE generated from
said STP at the County MSW facility.
2.
The City will produce a SLUDGE that meets the composition requirements of FDEP
and County standards.
3.
The City will produce a SLUDGE that is dewatered to 14% or more solids by weight.
4.
The City will load or have loaded SLUDGE at the STP into County transport trucks.
5.
The County will schedule and transport the SLUDGE from the City to the County
facility and process SLUDGE in County's MSW digester.
6.
The County will procure and maintain all permits as necessary to comply with number
5 above.
7.
The County will be responsible for and dispose of all MSW compost, incorporating the
SLUDGE, at no additional cost to the City.
8.
The County shall be responsible for meeting FDOT and FDEP requirements for
transporting SLUDGE.

After SLUDGE is loaded and removed from the STP site, the SLUDGE shall be the
property of the County. The City shall be held harmless during the transportation and
processing of the SLUDGE, except for SLUDGE that does not meet FDEP
requirements.
10.
The County shall pick up the SLUDGE from the STP a minimum of once per month.
11.
The City shall provide the County with copies of the quarterly SLUDGE analysis.
12.
County shall fax to the City the tonnage and cubic yardage of SLUDGE hauled within
24 hours of pick-up.
13.
The County will charge and the City will pay the County twelve dollars and fifty cents
($12.50) per cubic yard for each cubic yard hauled from the City's STP, with billings
and payment to be made on a quarterly basis.
14.
The City has and owns certain surplus water supply and storage equipment as shown
on Schedule "A" attached, that the City is interested in disposing of, and the County is
interested in obtaining said equipment and wishes to exchange said equipment for the
disposing of 1200 cubic yards of the city SLUDGE.
15.
The term of this agreement shall be from the date of execution extending for a five
year period, and may be renewed or revised upon agreement of both parties.
16.
This agreement may be tenninated by either party upon 180 days prior written notice.
If this agreement is tenninated, City shall pay for all SLUDGE disposed of up to the
date of tennination.
IN WITNESS WHEREOF, the parties have signed this agreement the day and year
first above written at Bushnell, Sumter County, Florida and the City of Clennont, Lake
County, Florida respectively.
