, THIS AGREEMENT made this / 3U..day of Au§ust , 1996, by and between
MERÇATOR PROPERTIES, INC., a Florida corporation, hereinafter called "MERCATOR";
and THE CITY OF CLERMONT, a Florida municIpal corporation, hereinafter called
"CLERMONT."
PREAMBLE
MERCATOR is developing a commercial subdivision within the city limits of
Clermont, Florida, to be known as CLERMONT COMMONS and has requested
CLERMONT to approve a plat of the subdivision. CLERMONT is concerned that six
driveways for I~ts 1 through 6 will create a traffic problem on Mohawk Road.
NOW, THEREFORE, the parties hereto agree as follows:
1. The conveyances of Lots 1 and 2 in CLERMONT COMMONS shall grant

The conveyances of Lots 5 and 6 in CLERMONT COMMONS shall grant
to tþa purofiaser of each lot and be subject to a mutual driveway easement loca~ed
equally across and from the lot line between Lots 5 and 6.
4.
MERCATOR further agrees that any other abutting lots in the subdivision
desIgnated by CLERMONT as requIring a Cross-Access Driveway Easement shall be
subjeot to this Agreement.
5.
All such cross-access driveway easements shall be perpetual and shall run
with the land.
6.
AU driveways shall be constructed of concrete and shall be subject to the
approval of CLERMONT.
