corporation, hereinafter called "MERCATOR"; and THE CITY OF

PREAMBLE
MERCATo.R is developing a commercial subidivison within the
city limits of Clermont, Florida, to be kn:own as ,ø:.ERHONT COMMONS
and has requested CLERMo.NT to approve a plat of the subdivisIon.
CLERMo.NT is concerned that eleven driveways for lots 7 through 17
will create a traffic problem on Hatteras Avenue.
No.W THEREFo.RE, the parties hereto agree as fqllows:
1. The conveyances of Lots 8 and 9 in CLERMONT COMMONS shall
grant to the purchaser of each lot and be subject to a mutual

The conveyances of Lots 12 and 13 in CLERMo.NT Co.MMONS
shall grant to the purchaser of each lot and be subject to a mutual
drivew~y eas~tnent located equally across and from the lot line
between Lots 12 and 13.
4. The conveyances of ~Lots 14 ,and 15 in CLERMo.NT Co.MMo.NS
shall grant to the purchaser of each lot and be subject to a mutual
driveway e~sement located equally across and from the lot line
between Lots 14 and 15.
5. The conveyances of Lots 16 and 17 in CLERMONT COMMONS
spall grant to the purchaser of each lot and be subject to a mutual
driveway easement located eq~ally across and from the lot line
between Lots 16 and 17.
6. MERCATOR further agrees that any other abutting lots in
the subdivision designated by CLERMONT as requiring a Cross-Access
Driveway Easement shall be subject to this Agree~ent.
7. All such cross-access driveway easements shall be
perpetual and shall run with the land.
8. All driveways shall be constructed of concrete and shall
be subject to the approval of CLERMONT.
9. Any instrument creating such cross-acc~ss driveway
easement shall provide for mutual maintenance by the abutting land

10. MERCATOR shall be responsible for and shall have control
over the allocation of costs for the construction of a driveway
, between any of the two lots described above.
