DEVELOPMENT AGREEMENT
This Agreement, by and between the City of Clermont, Lake
County, Florida, a Municipal Corporation,
("City") and Chester C.
Fosgate Company, Inc., a Florida Corporation,
("Owner").
Whereas,
"Owner" has requested "City" to re-zone certain
lands in the City of Clermont, and
Whereas,
the parties have reached an agreement as to
development of said lands.
Now therefore, in consideration of the mutual covenants and
conditions contained herein, the parties agree as follows:
1.
"Owner" has submitted an application for re-zoning of
certain lands into the corporate boundaries of "City", said
lands described in Exhibit "A" attached hereto.
2.
In the event of re-zoning of said lands,
"City" agrees
that the lands shall be zoned an R-1 classification subject
to the following conditions which "Owner" has agreed to
follow:
a.
All requirements of R-l zoning classification shall
be met by "Owner" with the exception of the front
footage requirement at the building set-back line of
lots which shall be set at 80' and the total square
footage of lots shall be 10,000 square feet.

b.
All other land development regulations shall be
met.
3.
This Agreement is subject to and conditioned upon the
formal re-zoning of the said lands.

Commence at the Northwest corner of the Northwest 1/4 of said Section 20, for a point
of reference: thence run South 89° 00' 51" East a distance of 2,639.11 feet to the North
1/4 corner of said Section 20, (a 4" x 4" concrete monument); thence run South 00° 31'
35" West a distance of 1,337.33 feet to the Northeast corner of Tract 21, Lake Highlands

Beginning: 1) thence run South 88° 57' 28" East along an extension of the North
boundary line of said Tract 21, Lake Highlands Company, a distance of 243.44 feet to
a point of curvature, said curve being Southwesterly with a radius of 1,000.00 feet; 2)
thence run Southeasterly 222.78 feet along the arc of said curve, said arc having a
central angle of 12° 45' 52", a tangent distance of 111.85 feet, a chord distance of 222.32
feet and a chord bearing of South 82° 34' 32" East to a point of tangency; 3) thence run
South 76° 11' 36" East a distance of 637.50 feet to a point of curvature, said curve being
concave Northeasterly with a radius of 1,000.00 feet; 4) thence run Southeasterly 229.41
feet along the arc of said curve, said arc having a central angle of 13° 08' 39", a tangent
distance of 115.21 feet, a chord distance of 228.91 feet and a chord bearing of South 82°
45' 55" East to a point of tangency; 5) thence run south 89° 20' 15" East a distance of

curve, said arc having a central angle of 2° 32' 33", a tangent distance of 33.29 feet, a
chord distance of 66.55 feet and a chord bearing of South 62° 23' 13" East, to a point
of tangency; 2) thence run South 61 ° 06' 57" East a distance of 541.29 feet to a point of
curvature, said curve being concave Southwesterly with a radius of 1 ,000.00 feet; 3)
thence run Southeasterly 1 ,078.24 feet along the arc of said curve, said arc having a
central angle of 61° 46' 42", a tangent distance of 598.23 feet, a chord distance of
1 ,026.76 feet and a chord bearing of South 30° 13' 36" East, to a point of tangency; 4)

curve being concave Easterly with a radius of 575.00 feet; 5) thence run Southeasterly
665.36 feet along the arc of said curve, said arc having a central angle of 66° 18' 00", a
tangent distance of 375.55 feet, a chord distance of 628.86 feet and a chord bearing of
South 32° 29' 15" East to a point of tangency; 6) thence run South 65° 38' 15" East a
distance of 244.55 feet to a point of curvature, said curve being concave Westerly with
a radius of 575.00 feet; 7) thence run Southeasterly 662.89 feet along the arc of said
curve, said arc having a central angle of 66° 03" 14", a tangent distance of 373.79 feet,
a chord distance of 626.79 feet and a chord bearing of South 32° 36' 38" East to a point
of tangency and the West 1/4 corner of Section 21, Township 22 South, Range 26 East,
and the point of termination.
