03.08.2022 - City Council MinutesCity of Clermont MINUTES REGULAR COUNCIL MEETING March 8, 2022 CALL TO ORDER The City Council met in a regular meeting on Tuesday, March 8, 2022 in the Clermont City Council Chambers. Mayor Murry called the meeting to order at 6:30 pm with the following Council Members present: Council Members Pines, Entsuah, Bates, and Purvis. Other City officials present were City Manager Bulthuis, City Attorney Mantzaris, and Deputy City Clerk Wisniewski. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was provided by Father Mark Wajada of Blessed Sacrament Catholic Church followed by the Pledge of Allegiance. PRESENTATIONS Gary Schindele gave an overview of the Naval Sea Cadets battalion in Clermont. As of March, they will have 50 cadets in the program. Gary Schindele introduced his son Command Chief Kurt Schindele who commanded the pinning ceremony of two Petty Officers to Chief Petty Officers in the United States Naval Sea Cadets Corps. Petty Officer Breanna LaPena came forward and was pinned by Chief Broadway as well as Petty Officer Matthew Festa who was pinned by his father, Fruitland Park Officer James Festa. PROCLAMATION Mayor Murry invited Airman Lt. Daniel Keel to the front and read the Proclamation for the Tuskegee Airmen recognition day on March 17, 2022. Mayor Murry presented the Proclamation to Airman Lt. Daniel Keel who served as a Tuskegee Airman from 1943 until 1946 and will be 100 years old this September. OPENING COMMENTS Mayor Murry informed the Council that there was a change to the agenda. Item No. 9 — Ordinance No. 2022-010 Chicone Property, Transmittal City Manager Bulthuis informed the Council that he is asking for this item to be tabled. The motion passed 5 to 0 with all members present votink, ave. PUBLIC COMMENTS Rene Lowe, 2265 Lakeview Avenue — Thanked Council and the community on behalf of the Fallen Hero 5k this past weekend. The event started last year on behalf of Conrad Buckley who was a fallen Clermont Police Officer. Last year there were 75 runners and this year we had 200. The 5k raised $9,000 which will go to the Fallen Hero fund, to assist local officers here in the area, and the Conrad Buckley scholarship. There will be a fundraiser on March 19 between our local Police Department and Fire/EMS. They will be playing kickball to raise money for our local cancer foundation. Sharon Keys, 644 W. Osceola Street - Spoke about the Community Center the Lincoln Park South Lake Alliance wants to bring to Clermont and thanked everyone that came to the table with them to discuss this project. Charlene Forth, 939 W. Desoto Street — Spoke about the fire code violations at Lilly's on the Lake. Expressed concerns regarding the type of events happening at Lilly's on the Lake. REPORTS CITY MANAGER REPORT City Manager Bulthuis • March 15, 2022 City Council Workshop is cancelled. • The next CRA meeting will be March 22, 2022 at 6pm. • Streetscape project will be starting later this month. • This weekend they will have the Movies under the Stars and the Downtown Wine Stroll. • Thank the Police Department and everyone who put on the 5k this last Saturday. Congratulated Council Member Entsuah for second place for his age group. • Thanked the Fire Union and everyone involved for working together and coming to an agreement. CITY ATTORNEY REPORT City Attorney Mantzaris — No report. CITY COUNCIL REPORT Council Member Bates • State Legislature have approved new districting, not sure what that means for our area as of yet. Mayor Murry stated that the Mayor of the City of Mount Dora has reached out to him to discuss the opposition regarding the pending bill to restructure Lake County Water Authority and that they are looking to support that as well. Council Member Purvis • Spoke about the Tuskegee Airman and that people should learn their story. 2 City of Clermont MINUTES REGULAR COUNCIL MEETING March 8, 2022 • Gave awards out for the Clermont Sailing Club on Sunday. The city was awarded an award in recognition and thanks from the Sailing Club for the cities involvement. City Manager Bulthuis stated that he went on the fire boat to watch the Sailing Club and it was a great event. He went on to say that staff did an exceptional job. Council Member Entsuah Ran in the Fallen Hero 5k, and was second place in his age group. Thanks to the Kiwanis Club and the Police Department for putting on a great event. Council Member Pines — No report. Mayor Murry • There is a Tuskegee Airmen movie. It is great to have a piece of history living in Clermont. • Attended the Little League opening day with Fire and Police on Saturday. Made the announcement to play ball. • Chief Ezell gave a tour of all four fire stations and thanked him. She stated we need to complete Fire Station No. 2 as soon as possible. • Thanked all those who came out to the Mayor's lunch at Sonny's. • Will be touring Public Works next week. He encouraged Council to do all the tours. • Attended a ribbon cutting at Winn Dixie plaza, for a motorized bicycle store. Cypress Ridge Elementary School Robotics team was in attendance. Cypress Ridge is one of five teams that qualified for the World Championships in Dallas which they are looking for donations for the trip. City Manager Bulthuis asked Chief Ezell to talk about the fire engine that was in the accident. Chief Ezell explained that the truck has a bent frame, so that will extend the repair time. Last week Mount Dora reduced their fleet and had a truck for auction, we bid and won, the cost was $20,000. That will add a fourth engine to our reserve fleet while we are waiting for the new truck. Council Member Purvis stated that we need to put pressure on the insurance company to total the truck instead of fixing it at this point. Chief Ezell remarked that our representative from Pierce said there is an opportunity to buy trucks that are being used as demo units as early as June. These would not be custom, but given the situation we would be happy to have a truck quickly. CONSENT AGENDA Mayor Murry advised the next item on the Agenda for consideration was the Consent Agenda and requested anyone wishing to have any item pulled for discussion to please come forward at this time. Item No. 1— Minutes Approval Item No. 2 — Surplus Request Consider approval of the January 11, 2022 and February 22, 2022 Council Meeting and February 15, 2022 Workshop minutes. Consider declaring surplus from Fire and Finance and dispose of in accordance with the Purchasing Policy. City of Clermont MINUTES REGULAR COUNCIL MEETING March 8, 2022 Item No. 3 — Letter of Engagement Item No. 4 — Resolution No. 2022-008R Item No. 5 — Phase 3 Downtown Streetscape Project and Budget Amendment Item No. 6 — Community Garden Sponsorship Consider the selection of Special Counsel with Shepard, Smith, Kohlmyer & Hand, and P.A. Law Firm to the Code Enforcement Board. Consider Resolution declaring surplus approximately .5+1- acres located at 332/334 Palm Lane, property acquired by the City through a Code Enforcement action, authorizing the sale to Carey Hubbard Family Trust for the purchase price of $72,000 with the buyer demolishing the structures on the property and paying all closing costs. Consider the third contract amendment between the City of Clermont and Traverse Group, Inc. to provide construction of Phase 3 of the downtown streetscape project in the amount of $7,215,149.68 with an ARPA fund budget amendment for the total project budget of $7,757,916.31. Consider approval to utilize any donated sponsorship dollars collected for the Community Garden project exclusively for the project. Item No. 7 — Collective Bargaining Agreement Consider the Collective Bargaining Agreement and Budget Amendment with the International Association of Firefighters, AFL -CIO -Clermont Professional Firefighters Local 4350 and a General Fund budget amendment in the amount of $180,000. Item No. 8 — Comprehensive Plan Proposal and Budget Amendment Consider approval to utilize East Central Florida Regional Planning Council to complete the Evaluation Appraisal Report and a budget amendment in the amount of $45,000. Dani Page pulled agenda Item No. 3 for further discussion. Council Member Bates moved to a rove Consent Agenda Items 1-2 and 4-8 br March 8 2022 • Seconded by Council Member Pines. Passed unanimously- 5-0 with all members present voicing ave. Item No. 3 - Dani Page, Inside Clermont, asked why this did not go out to bid and was just given to this particular law firm. City Manager Bulthuis stated that the city went to bid a year ago for a Special Magistrate and selected this firm. This is essentially the same role as the Attorney for the Code Enforcement Board as he will be representing staff. Dani Page expressed concerns regarding possibly paying more due to more hours and travel time with this role. Council Member Purvis stated since this gentlemen was just appointed a year ago and has only met a few times, he feels comfortable with this decision. 4 City of Clermont MINUTES REGULAR COUNCIL MEETING March 8, 2022 Charlene Forth, 939 W.
