Contract 2022-025AINTERLOCAL AGREEMENT BETWEEN LAKE COUNTY WATER AUTHORITY AND CITY
OF CLERMONT
THIS AGREEMENT is made and entered into by Tim Murry, as Mayor of the City of
Clermont, Florida, whose address is 685 W. Montrose St, Clermont, FL 34711, (hereinafter
referred to as "CLERMONT POLICE") and the Lake County Water Authority, whose address is
27351 S.R. 19, Tavares, Florida 32778, (hereinafter referred to as LCWA).
WHEREAS, one of the purposes of the LCWA is fostering the tourism business in Lake
County and providing recreational facilities for tourists and citizens and taxpayers of Lake
County; and
WHEREAS, the LCWA believes that an integral part of fulfilling the aforementioned
purposes is through enhanced enforcement of boating laws; and
WHEREAS, the LCWA believes the CLERMONT POLICE is uniquely qualified to
perform these tasks intends to dedicate two police officers to patrol the waterways of the
Clermont Chain of Lakes for the purposes of enforcing the laws of the State of Florida and Lake
County as well as promoting boating safety on the waters of Lake County; and
WHEREAS, both the LCWA and the CLERMONT POLICE are public agencies under
the terms of the Florida Interlocal Cooperation Act of 1969 with the power to exercise jointly
their common interests; and
WHEREAS, pursuant to the Voluntary Cooperation and Operational Assistance Mutual
Aid Agreement between the Lake County Sheriff's Office and the City of Clermont Concerning
Jurisdiction on Adjacent Waterways, dated September 17, 2020 (and any extensions thereof),
CLERMONT POLICE may render law enforcement services on waterways bordered by and
concerning both Lake County and the City of Clermont.
NOW THEREFORE, BE IT AGREED by and between the LCWA and the CLERMONT
POLICE as follows:
1. The initial term of this Agreement shall be for three year from April 151, 2022 to and
including April 30, 2025, and shall automatically renew on an annual basis thereafter
unless a party provides notice at least thirty (30) days prior to the end of the initial
term or any renewal term thereafter of its intent not to renew this
Agreement.
2. Subject to annual funding approval by the LCWA Board of Trustees, the LCWA shall
annually pay to the CLERMONT POLICE the actual annual salaries and related
benefits and personnel costs for two (2) police officers up to a maximum of TWO
HUNDRED TWENTY THOUSAND DOLLARS ($220,000.00) payable in Quarterly
Installments, equal to those hours that the Officers worked, (Billed at $50 per hour) to
CLERMONT POLICE. The positions will be filled on a rotating basis until such time as
the positions can be filled on a permanent basis.
3. CLERMONT POLICE shall provide two (2) full-time police officers assigned to
patrolling the Clermont Chain of Lakes waterways in fulfillment of this Agreement and
as permitted under the Voluntary Cooperation and Operational Assistance Mutual Aid
Agreement between the Lake County Sheriff's Office and the City of Clermont
Concerning Jurisdiction on Adjacent Waterways, dated September 17, 2020 (and
any extensions thereof), Officers shall have as their primary duties the patrolling of
Clermont Chain of Lakes waterways for the purpose of enforcing Florida law and
Lake County Ordinances, as well as promoting boating safety.
4. The CLERMONT POLICE shall furnish to the LCWA monthly reports regarding the
activities of the assigned officers. The reports shall be provided in a format mutually
agreed upon by the LCWA and the CLERMONT POLICE and should specifically
identify the nature of and time spent on the water and patrolling LCWA preserves.
Said reports shall further outline at a minimum the hours and statistics for each
LCWA funded officer as recommended by LCWA staff or as agreed upon by the
parties.
5. CLERMONT POLICE shall be responsible for obtaining and maintaining its own
boats, motors, trailers, and any other equipment necessary for its fulfillment of its
obligations pursuant to this Agreement.
6. Attendance at the LCWA meetings by CLERMONT POLICE is not required; however
if directed by the Chief of Police, CLERMONT POLICE officers assigned to patrolling
the Clermont Chain of Lakes shall attend meetings of the Board of Trustees of the
LCWA.
7. CLERMONT POLICE officers assigned pursuant to this Agreement shall assist the
LCWA by investigating and advising the LCWA of the condition and placement of
speed zones and other markers in the waterways.
8. CLERMONT POLICE officers assigned pursuant to this Agreement shall assist the
LCWA by notifying LCWA and investigating navigational hazards problems within the
lakes, canal and rivers.
9. CLERMONT POLICE officers assigned pursuant to this Agreement shall assist the
LCWA by patrolling LCWA owned properties and investigating problems within the
boundaries of these properties.
10. CLERMONT POLICE's liability, personal injury, automobile, and worker's
compensation insurance shall cover all CLERMONT POLICE's employees and
volunteers for all activities while acting pursuant to this Agreement on LCWA
property.
11. Any operational matters arising under this Agreement, including, but not limited to,
navigation obstructions, signage inspection, citizen requests, public events, etc.,
shall be directed to the following points of contact for LCWA and CLERMONT
POLICE:

12. This Agreement may be cancelled by either party upon thirty (30) days written notice.
Upon such cancellation, the payments described in paragraph two (2) shall be
prorated through the effective date of cancellation and the appropriate financial
adjustment made between the parties.
IN WITNESS WHEREOF, the parties to this Agreement have caused their names to be
affixed hereto by the proper officer thereof on the dates indicated below.
