REQUESTED ACTION:
To rezone the property from C-2 General Commercial zoning to
Planned Unit Development (PUD) zoning to allow single-family townhomes
SECTION 2: GENERAL CONDITIONS
This application for a Planned Unit Development is to allow for a single-family residential
townhome project; be granted subject to the following conditions:
l . The conditions as set forth in this Planned Unit Development shall be legally binding upon
any heirs, assigns and successors in title or interest.
2. The property shall be developed in substantial accordance with the Cityside Townhomes
Concept Plan prepared by Stringfellow Planning & Design, dated August 5, 2022. Formal
construction plans incorporating all conditions stated in this permit shall be submitted for
review and approved by the Site Review Committee prior to the issuance of a zoning
clearance or other development permits.
3. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove,
improve, move, convert, or demolish any building or structure, or alter the land in any
manner within the boundary of the project without first submitting necessary plans,
obtaining necessary approvals, and obtaining necessary permits in accordance with the City
of Clermont Land Development Regulations and those of other appropriate jurisdictional
entities.

4. Fiber optic conduit and pull boxes may be required to be installed by the developer in the
utility easements to extend the City's fiber optic network. The City's Information Tech-
nology Director or authorized designee will work with the developer at the time of site plan
review to determine the extent of fiber optic conduit.
SECTION 3: LAND USES AND SPECIFIC CONDITIONS
1. A total of 56 townhome units shall be permitted with a maximum density of 6.96 dwelling
units per acre.
2. Setbacks for the townhomes:
Front setback: 25 feet from the property line
Rear setback: 25 feet from the property line
Corner/side Setback: 15 feet from the property line
Highland Avenue setback: 25 feet from ROW
3. The buildings shall be constructed in a manner that shall meet the City of Clermont's
Architectural Standards and as represented in the provided elevations.
4. The landscape buffer along the southern property line (The Crown) shall have an enhanced
landscape buffer consisting of 30% more plant material along with an opaque privacy
fence. The buffer shall be a minimum of 15 feet.
5. The City of Clermont Fire Marshall shall determine the feasibility and design of the access
point and the necessary means of ingress/egress to the residential development at the time
of site plan review and approval.
6. If required by the City of Clermont, Lake County or Florida Department of Transportation,
as a result of the traffic impact analysis, the developer shall be responsible for any
proportionate fair share improvements or payments. The proportionate fair share
improvements or payments shall be completed prior to the first Certificate of Occupancy.
7. This Planned Unit Development shall expire if all development actions authorized or required
hereunder are not taken within a period of two (2) years of the date that this Planned Unit
Development is approved by the City Council and becomes legally effective. If the Planned
Unit Development expires, the property will revert to the C-2 General Commercial Zoning
Designation.
8. School concurrency shall be met before final site plan approval or final plat in accordance
with the Comprehensive Plan and Land Development Code.
9. The internal streets and alleyways within the project will be privately maintained by the
Developer or HOA with an easement dedicated to the City.

10. The project shall be developed according to the C-2 General Commercial zoning
designation in the Land Development Code, unless expressly stated above.
SECTION 5: CONFLICT
All Ordinances or parts of this Ordinance in conflict herewith are hereby repealed.
SECTION 6: SEVERABILITY
If any portion of this Ordinance is declared invalid, the invalidated portion shall be severed from
the remainder of the Ordinance, and the remainder of the Ordinance shall continue in full force
and effect as if enacted without the invalidated portion, except in cases where such continued
validity of the remainder would clearly and without doubt contradict or frustrate the intent of the
Ordinance as a whole.
SECTION 7: ADMINISTRATIVE CORRECTION
This Ordinance may be re -numbered or re -lettered and the correction of typographical and/or
scrivener's errors which do not affect the intent may be authorized by the City Manager or
designee, without need of public hearing, by filing a corrected or re -codified copy of same with
the City Clerk.
SECTION 8: RECORDING
This Ordinance shall be recorded in the Public Records of Lake County, Florida.
SECTION 9: PUBLICATION & EFFECTIVE DATE
This Ordinance shall be published as provided by law, and it shall become law and take effect
upon its Second Reading and Final Passage.

REQUESTED ACTION:
To rezone the property from C-2 General Commercial zoning to
Planned Unit Development (PUD) zoning to allow single-family townhomes
SECTION 2: GENERAL CONDITIONS
This application for a Planned Unit Development is to allow for a single-family residential
townhome project; be granted subject to the following conditions:
1. The conditions as set forth in this Planned Unit Development shall be legally binding upon
any heirs, assigns and successors in title or interest.
2. The property shall be developed in substantial accordance with the Cityside Townhomes
Concept Plan prepared by Stringfellow Planning & Design, dated August 5, 2022. Formal
construction plans incorporating all conditions stated in this permit shall be submitted for
review and approved by the Site Review Committee prior to the issuance of a zoning
clearance or other development permits.
No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove,
improve, move, convert, or demolish any building or structure, or alter the land in any
manner within the boundary of the project without first submitting necessary plans,
obtaining necessary approvals, and obtaining necessary permits in accordance with the City
of Clermont Land Development Regulations and those of other appropriate jurisdictional
entities.

4. Fiber optic conduit and pull boxes may be required to be installed by the developer in the
utility easements to extend the City's fiber optic network. The City's Information Tech-
nology Director or authorized designee will work with the developer at the time of site plan
review to determine the extent of fiber optic conduit.
SECTION 3: LAND USES AND SPECIFIC CONDITIONS
l . A total of 56 townhome units shall be permitted with a maximum density of 6.96 dwelling
units per acre.
2. Setbacks for the townhomes:
Front setback: 25 feet from the property line
Rear setback: 25 feet from the property line
Corner/side Setback: 15 feet from the property line
Highland Avenue setback: 25 feet from ROW
3. The buildings shall be constructed in a manner that shall meet the City of Clermont's
Architectural Standards and as represented in the provided elevations.
4. The landscape buffer along the southern property line (The Crown) shall have an enhanced
landscape buffer consisting of 30% more plant material along with an opaque privacy
fence. The buffer shall be a minimum of 15 feet.
5. The City of Clermont Fire Marshall shall determine the feasibility and design of the access
point and the necessary means of ingress/egress to the residential development at the time
of site plan review and approval.
6. If required by the City of Clermont, Lake County or Florida Department of Transportation,
as a result of the traffic impact analysis, the developer shall be responsible for any
proportionate fair share improvements or payments. The proportionate fair share
improvements or payments shall be completed prior to the first Certificate of Occupancy.
7. This Planned Unit Development shall expire if all development actions authorized or required
hereunder are not taken within a period of two (2) years of the date that this Planned Unit
Development is approved by the City Council and becomes legally effective. If the Planned
Unit Development expires, the property will revert to the C-2 General Commercial Zoning
Designation.
School concurrency shall be met before final site plan approval or final plat in accordance
with the Comprehensive Plan and Land Development Code.
9. The internal streets and alleyways within the project will be privately maintained by the
Developer or HOA with an easement dedicated to the City.

10. The project shall be developed according to the C-2 General Commercial zoning
designation in the Land Development Code, unless expressly stated above.
SECTION 5: CONFLICT
All Ordinances or parts of this Ordinance in conflict herewith are hereby repealed.
SECTION 6: SEVERABILITY
If any portion of this Ordinance is declared invalid, the invalidated portion shall be severed from
the remainder of the Ordinance, and the remainder of the Ordinance shall continue in full force
and effect as if enacted without the invalidated portion, except in cases where such continued
validity of the remainder would clearly and without doubt contradict or frustrate the intent of the
Ordinance as a whole.
SECTION 7: ADMINISTRATIVE CORRECTION
This Ordinance may be re -numbered or re -lettered and the correction of typographical and/or
scrivener's errors which do not affect the intent may be authorized by the City Manager or
designee, without need of public hearing, by filing a corrected or re -codified copy of same with
the City Clerk.
SECTION 8: RECORDING
This Ordinance shall be recorded in the Public Records of Lake County, Florida.
SECTION 9: PUBLICATION & EFFECTIVE DATE
This Ordinance shall be published as provided by law, and it shall become law and take effect
upon its Second Reading and Final Passage.
