DEVELOPERS AGREEMENT
TillS AGREEMENT, made as of the 14 day of ~ ' 1995, by and
between the City of Clermont, a municipal córporation in the tate of Florida, hereinafter
sometimes referred to as the "City", and Star Development, Inc" a Florida Corporation,
hereinafter referred to as "Developer".
WITNESSETH THAT
WHEREAS, Owner warrants that it holds legal title to certain land situated in the City of
Clermont, Florida, as described in Exhibit "A" hereto, such land to be hereafter sometimes
referred to as the "Property"~ and
WHEREAS, the Property is substantially undeveloped at the present time and will require
platting, planning and the installation of certain capital improvements as it is developed~ and
WHEREAS, the City is authorized under the Laws of Florida, to regulate such
development~ and
WHEREAS, the Owner as part of its compliance with the City of Clermont final
requirements approval desires to enter into this Agreement~ and
WHEREAS, it is the purpose of this Agreement to set forth clearly the understanding and
agreement of the parties with respect to all the foregoing matters
NOW, THEREFORE, in consideration of the mutual promises contained herein, $10.00
and other valuable and good consideration, the sufficiency of which is hereby acknowledged the
parties agree as follows:
1, The Developer shall provide for an unpaved emergency access point at the Laurel
Cove Court cul-de-sac as shown on the approved Construction Plans on Sheet 4 of 30, which
said access point shall remain open to and accessible on an emergency basis to provide a
secondary project access point until North Ridge Blvd. is completed to Highway 50.
2. The City hereby commits sewage capacity and connections for the first eighty-two
(82) lots unconditionally with all of such fees charged to the Builder. Further, the City hereby
agrees to allow construction by developer or its successors or assigns on the remaining nine (9)
lots and provide said lots capacity and connections in the City's sewer system upon determination
by the City of capacity in the City sewer system, Notwithstanding anything to the contrary, the
City agrees to give the above referenced nine (9) lots priority over any new connections to the
City's sewer system.

3. The City agrees to pay to the Developer the costs incurred by the Developer for
the Lift Station and utility line upgrades as described on the attached Exhibit B.
Nothwithstanding the foregoing, both parties acknowledge said payments shall be made to
Developer based upon the payment schedule on the attached Exhibit B. Both parties
acknowledge that the lift station's emergency generator is to be provided exclusively by the City
and is not included in the Developer's construction costs. The City agrees to provide the
emergency generator on a timely basis.
4. It is understood and agreed that, upon the construction or dedication of rights-of-
way, stormwater retention area tracts or easements or of any capital improvements by Developer
as required by, and the acceptance thereof by the City, the City will thereafter assume the cost of
maintenance of the same; provided that all such improvements shall be covered by a bond suitable
to the City conditioned to pay for any defects in such improvements which shall become apparent
within one (1) year after acceptance by the City in accordance with the regulations or ordinance
of the City.
6. This Agreement shall be binding, and shall inure to the benefit of the Property and
be binding upon any person, firm, or corporation or municipality who may become the successor
in interest, directly or indirectly to the Property.
IN WITNESS THEREOF, the parties hereto have caused these present to be signed all
as of the date and year first above written"

Dear Mr. Rossman:
The City Council has agreed to an initial amount of SI15.358.86 8S the City's share of
certain upgrades in the infrastructure of the North Ridge Subdivision, however,
$39,891.94 of this amount which represents a portion of the lift station upgrade must
be reimbursed to the City prior to the commencement of the 2nd phase. The City's
contribution wi11 be made upon installation of the improvements and final approval
and acceptance as operational.

Prior to the development order being issued, the utility easement located in the 100-
year flood plain of Wi11ow Lake needs to be delivered to the City. We have sent a
Jetter to Lake County supporting your request for a $59,150 of road impac\ fee credits
for construction of North Ridge Boulevard and intersection improvements.
We look forward to continuing to work with you on this development.
