07-21-2020 Code Enforcement HearingCity of Clermont MINUTES CODE ENFORCEMENT HEARING July 21, 2020 The City of Clermont Code Enforcement Hearing for July 21, 2020, took place in the Clermont City Center beginning at 1:30 p.m. with Special Magistrate, Andrew Lanius, presiding over the hearing. Also attending were Matthew Reusch, Code Enforcement Supervisor, Glenn Mohney, Code Enforcement Officer, Dan Mantzaris, City Attorney, Curt Henschel, Development Services Director, John Kruse, Senior Planner, and Nicholas Gonzalez, Planning Coordinator. Code Enforcement Officers Reusch and Mohney, along with any member of the public who may wish testify, were sworn in. City Attorney, Dan Mantzaris stated there are three cases to be presented and each case there is a respondent present to state their case. He introduced the first case saying that staff realizes that the property is now in compliance but would want to record that there was a violation in place and by now being in compliance the city is no longer seeking a fine at the moment. Item 1- Case Number: C2020-000348 Respondent: Homes In Partnership Inc. City Attorney Dan Mantzaris presented the case. The Respondent was present and sworn in. Violation: Section 122-344 Property Maintenance, Section 301.3 Vacant Structures and Lands and Section 302.4 Weeds Code Enforcement Officer Mohney presented the case. Disposition: There was a violation of Section 122-344 Property Maintenance, Section 301.3 Vacant Structures and Lands and Section 302.4 Weeds and can be brought back for repeat violation if the violations occur again; with a no fine at this time, however if in repeat violation the fine would accrue at $200 per day for every day property is in violation. Shakena Suggs, 726 E. Broome Street, stated that she has a 6-year old son and she complained last year because the grass was taller than her son. She stated that she fears there will be snakes and other critters. Item 2- Case Number C2020-000164 Respondent: Vista Commerce Center LLC City Attorney Dan Mantzaris presented the case. The Respondent was present and sworn in. Violation: Section 702.1 Means of Egress, Section 122-344 Building Permit Required Code Enforcement Supervisor Reusch presented the case. Disposition: In violation of Section 702.1 Means of Egress, Section 122-344 Building Permit Required; with a fine of $200 per day for every day in violation past August 28, 2020. Item 3- Case Number: C2017-000755 Respondent: John Prickett City Attorney Dan Mantzaris presented the case. He stated the property accrued a fine of $170,250. He stated that the City believes a reduction to $17,000 would be an appropriate reduction. The Respondent was present and sworn in. Request: Reduction of Fine John Prickett stated that they try to be a good neighbor. He stated that he didn't know about it. He stated that he has had serious health issues and has been gone for a while. He said he reached out to the tenants. He stated he found out about this lien through a lien search. He stated that had he known about this 2 years ago, it would have been dealt with. Disposition: To allow a fine reduction to the amount of $17,025. With no further scheduled hearings, the hearing adjourned at 2:14 p.m.
