CODE ENFORCEMENT HEARING
January 21, 2020
The City of Clermont Code Enforcement Hearing for January 21, 2020 took place in the Council
Chambers at City Hall beginning at 1:30 pm with Special Magistrate Andrew Lanius presiding
over the hearing. Also attending were Code Enforcement Officer Katherine Neill, Code
Enforcement Supervisor Matthew Reusch, Planning Manager John Kruse, Development Services
Director Curt Henschel, City Attorney Dan Mantzaris and Nicholas Gonzalez, Planning
Coordinator.
Code Enforcement Officers Reusch and Neill, along with any of the public who may testify, was
sworn in.
City Attorney Dan Mantzaris stated that the first 6 cases are lien cases.
Case Number: C2019-000271 Respondent: John R. Prickett
City Attorney Dan Mantzaris presented the case.
The Respondent was present and sworn in.
Mr. Mantzaris stated that the compliance date was August 19, 2019. He stated that the fine is
$250 per day. The fine has accrued to $38,500 and continues to accrue at $250 a day. He stated
that since the property is still out of compliance and the fine is still accruing the City is
requesting a lien be placed on the property.
Jose Gonzales stated that he purchased the property and all the violation has been corrected other
than the vehicles. He stated the classical cars on the property are being removed today.
City Attorney Mantzaris stated that this is the first they knew that he owned the property.
Mr. Gonzales stated that he takes responsibility for the non-compliance.
Disposition: To place a lien on the property for $38,500 and accruing fines.
Case Number: C2019-000717 Respondent: John P. Adams & Ann D.
Adams Family LP
City Attorney Dan Mantzaris presented the case.
The Respondent was present and sworn in.
Mr. Mantzaris stated that the compliance date was December 20, 2019 with a daily fine of $100
per day and has accrued to $3100. He stated that since the property is still out of compliance and
the fine is still accruing the City is requesting a lien be placed on the property.
Joseph Zagane stated that he was here for another matter and he's just hearing about this. He
stated that he owns the building from ground up but the Adams' Trust owns the ground, however
Mr. Zagane is solely responsible for any code issues.
Code Enforcement Neill stated the non-compliance is due to wind flags.
Disposition: To place alien on the property for $3,100 and accruing fines.
Case Number: C2019-000737 Respondent: John P. Adams & Ann D.

Mr. Mantzaris stated that the compliance date was December 20, 2019 with a daily fine of $100
per day and has accrued to $3100. He stated that since the property is still out of compliance and
the fine is still accruing the City is requesting a lien be placed on the property.

Joseph Zagane stated that this is the same issue as previous case except that he no longer owns
the lease holding for this property.
Disposition: To place alien on the property for $3,100 and accruing fines.
Case Number: C2019-000954
Respondent: John P. Adams & Ann D.
Adams Family LP
Code Enforcement Officer Neill presented the case.
The Respondent was present and sworn in.
Joseph Zagane stated he did receive notice for this property and that's why he is here. He stated
that the flags will be removed on his way home today and he will send a cease and dismiss letter
to the tenants.
Disposition: In violation of Chapter 102, Section 102-8 (7) Wind sign; with a fine of $100 per
day for every day in violation past February 4, 2020.
Case Number: C2020-000002 Respondent: ALP Investments
Code Enforcement Officer Reusch presented the case.
The Respondent was present and sworn in.
Jimmy Crawford stated that he represents ALP Investments. He stated that they are in agreement
with staff. He stated that it is a construction site that has stalled at this point.
Disposition: Is in compliance of the repeat violation of Chapter 34, Section 34-61 Nuisances,
34-62 Creation or maintenance of nuisances by property owner declared unlawful, Chapter 122,
Section 122-344 Property maintenance, IPMC Section 301.3 Vacant structures and lands, 302
Sanitation, with a no fine at this time.
Case Number: C2019-000789 Respondent: Jose M. Concepcion Lopez
Code Enforcement Officer Neill presented the case.
The Respondent was present and sworn in.
Jose Concepcion Lopez stated that he was notified for the violation. He stated that he noticed
when they posted the sign.
Disposition: Is in compliance of violation of Chapter 34, Section 34-95 Prohibition of storage of
certain items; with no fine at this time, however if a repeat violation a fine will be accessed.
Case Number: C2019-000721 Respondent: Willie C. & Lola Mae Chandler
Code Enforcement Officer Neill presented the case.
The Respondent was present and sworn in.
Madeline Young stated she is the daughter Willie Chandler. She stated that she agrees with what
is presented, however they have called the law on the people that are coming to the property and
creating the trash. She stated that where the people are sitting on the neighbor's property
however they trash is being put on the Mr. Chandler's property.
Disposition: In violation of Chapter 34, Section 34-61 Enumeration of prohibited items,
conditions, or actions constituting nuisances, Chapter 50, Section 50-33 Precollection practices,
Chapter 54, Section 54-1 Placing articles or obstructions on streets or sidewalks, Chapter 122,
Section 122-344 Property maintenance, IPMC Section 302 Sanitation, 308.1 Rubbish and
garbage; with a fine of $150 per day for every day in violation past February 4, 2020.

Case Number: C2019-000876 Respondent: Clermont East Partners, LLC
Code Enforcement Officer Neill presented the case.
The Respondent was present and sworn in.
City Attorney Dan Mantzaris stated that from the City's position is that a human sign holder is in
violation when they are off the private property.
Jack Brennen with Grey Robinson, stated he represents the tenant and not the property owner.
He stated that the signs did belong to his tenant. He stated the wind signs have been removed. He
stated that the sign spinner was on the side walk, however since being there he received a text
from his client stating the sign spinner has been moved to the public property.
Disposition: In violation of Chapter 54, Section 54-1 Placing articles or obstructions on streets
or sidewalks, Chapter 102, Section 102-8 (7) Wind sign, 102-8 (15) Signs places on government
owned public areas; with a fine of $150 per day for every day in violation past February 4, 2020.

The Respondent was not present.
Disposition: To place a lien on the property for $22,400 and accruing fines at $175 per day.

Disposition: To place a lien on the property for $21,000 and accruing fines at $250 per day.

Disposition: To place a lien on the property for $12,600 and accruing fines of $150 per day.
