CODE ENFORCEMENT HEARING
March 19, 2019
The City of Clermont Code Enforcement Hearing for March 19, 2019, took place in the
Clermont City Center beginning at 1:30 p.m. with Special Magistrate, Andrew Lanius, presiding
over the hearing. Also attending were Matthew Reusch, Code Enforcement Supervisor,
Katherine Neill, Code Enforcement Officer, Dan Mantzaris, City Attorney, Curt Henschel,
Development Services Director, John Kruse, Senior Planner, and Rosalee Cohen, Administrative
Assistant.
Code Enforcement Officer Reusch and Neill, along with any of the public who may testify, was
sworn in.
Case Number: C2019-000060 Respondent: Hurtak Family Partnership
Code Enforcement Officer Reusch presented the case.
The Respondent was present and was sworn in.
Chris, Fire Inspector, stated that the egress was not wide enough to allow for any necessary
egress.
Brian Hawthorn stated that the fire extinguisher was obstructed.
James Hurtak stated that he was here to make sure the fines are taken care of. He stated that Ron
as a tenant is responsible for any fines accessed.
Ron Shore, owner of Clermont Furniture, stated that it took a little while to get everything in to
compliance.
Disposition: Was in repeat violation of Chapter 14, Section 14-9, IPMC Chapter 7, Fire Safety
Requirements, Chapter 14, Section 14-9, 702.1 Means of Egress, Chapter 14, Section 14-9, 702.2
Aisles, Chapter 14, Section 14-9, 704.1 Fire Protection Systems; with a fine of $400 per day for
the 6 days in violation totaling $2400.
Case Number: C2018-000571 Respondent: Hillside Terrace Condominium
Association
Code Enforcement Officer Reusch presented the case. He stated that the property is in partial
compliance.
The Respondent was present and sworn in.
Ed Miller stated that he is a volunteer for the Board of the Hillside Terrace Condominium. He
presented photos of the property. He stated that some of the photos presented by Code
Enforcement Officer Reusch were photos of property that is not theirs.
City Attorney Dan Mantzaris stated that this is a citizen driven complaint. He stated that they are
willing to extend the compliance date to April 30, 2019 to work out the differences.
Disposition: In violation of Chapter 122, Section 122-344 Property Maintenance, Chapter 34,
Section 34-61 Enumeration of Prohibited Items, Chapter 34, Section 34-62 Creation or
Maintenance of Nuisance, with a fine of $100 per day for every day in violation past May 15,
2019.
Case Number: C2019-000079 Respondent: LGCC Holdings, LLC
Code Enforcement Officer Neill presented the case.
The Respondent was present and sworn in.
David Nameniuk stated that he and his wife own the LLC. He stated that he does not disagree

with what staff is saying. He stated that the tenant is trying to keep it cleaned up but he thinks he
is having issues getting trucks in and out of the property.
Disposition: In repeat violation of Chapter 122, Section 122-344 Property Maintenance, with a
fine of $350 per day for every day in violation for the 11 days, totaling $3850.
Case Number: C2018-000291 Respondent: Fred R. Jackson
Code Enforcement Officer Reusch presented the case.
The Respondent was present and sworn in.
Fred Jackson stated that the guy that is staying on the property has been told he cannot stay there.
He stated that he had been in the hospital and it took him time to clean up the property. He stated
that he will have to get a court order to get the guy removed from the property.
Disposition: To impose a lien on property
Case Number: C2017-000308
Respondent: Ricky E. and Connie A. Wright
Bayview Loan Servicing, LLC
Code Enforcement Officer Reusch presented the case.
The Respondent was not present.
Craig Stein stated that he was there representing Bayview Loan Servicing. He stated that this has
proceeded through foreclosure. He stated that they had thought the work orders provided made
the property in compliance.
Disposition: To impose a lien on property
Case Number: C2018-000570 Respondent: SRGC, LLC
Code Enforcement Officer Reusch presented the case.
The Respondent was not present.
Disposition: In violation of Chapter 14, Section 14-9, IPMC Section 305.3 Interior Surfaces
Chapter 14, Section 14-9, IPMC Section 605.1 Electrical Equipment, with a fine of $175 per day
for every day in violation past April 1, 2019.
Case Number: C2018-000529
Code Enforcement Officer Neill presented the case.
Respondent: Hillside Terrace Condominium
Association
The Respondent was not present.
Disposition: In violation of Chapter 122, Section 122-344 Property Maintenance, Chapter 34,
Section 34-61 Enumeration of Prohibited Items, Chapter 14, Section 14-9, Section 302.8 Motor
Vehicles, with a fine of $150 per day for every day in violation past April 2, 2019.
Case Number: C2018-000569 Respondent: Jose Gonzalez
Code Enforcement Officer Reusch presented the case. He stated that the property is in
compliance.
The Respondent was not present.
Disposition: In violation of Chapter 14, Section 14-9, IPMC Section 302.8 Motor Vehicles
Chapter 34, Section 34-95 Vehicles, with no fine at this time, but if property does become non-
compliance to find property in repeat violation.
