AN ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF
CLERMONT, LAKE COUNTY, FLORIDA, ADOPTED PURSUANT TO
SECTION 125.010)(q), FLORIDA STATUTES (1999), CONSENTING TO
THE INCLUSION OF THE CITY OF CLERMONT, FLORIDA, WITHIN
THE COUNTY -WIDE MUNICIPAL SERVICE TAXING UNIT FOR THE
PROVISION OF AMBULANCE AND EMERGENCY MEDICAL
SERVICES, AS ADOPTED BY THE BOARD OF COUNTY
COMMISSIONERS OF LAKE COUNTY, FLORIDA; PROVIDING FOR
THE CITY TO BE INCLUDED WITHIN SAID MUNICIPAL SERVICE
TAXING UNIT FOR A SPECIFIED TERM OF YEARS; PROVIDING FOR
CONFLICT, SEVERABILITY, ADMINISTRATIVE CORRECTION OF
SCRIVENERS ERROR, PUBLICATION AND AN EFFECTIVE DATE.
WHEREAS, Lake County has taken action to create a non-profit corporation to provide
ambulance services in Lake County effective September 30, 2000; and
WHEREAS, Lake County has determined that the best mechanism to secure the necessary
funding to provide said ambulance services is to create a countywide municipal service taxing unit
authorizing the County to levy ad valorem taxes therein for the provision of ambulance and
emergency medical services, and has enacted an emergency ordinance creating that municipal
service taxing unit; and
WHEREAS, Section 125.01(1)(q), Florida Statutes, provides that the boundaries of a
municipal service taxing unit may include all or part of the boundaries of a municipality if the
affected municipal consents, by ordinance, to be included therein; and
WHEREAS, the City Council of the City of Clermont has determined that it is in the best
interest of and serves the health, safety and general welfare of the residents of Clermont to include
the City of Clermont within the Lake County municipal service taxing unit for ambulance and
emergency services; and
WHEREAS, Lake County's emergency ordinance expressed its intent to include the City
of Clermont within the boundaries of the "Lake County Municipal Service Taxing Unit for
Ambulance and Emergency Medical Services," subject to the adoption of an approving ordinance
by the City Council of the City of Clermont;
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Clermont,
Lake County, Florida:
SECTION 1:
The City Council of the City of Clermont consents to the inclusion of the City of Clermont within
the boundaries of the "Lake County Municipal Service Taxing Unit for Ambulance and Emergency
Medical Services."

SECTION 2: TERM
This consent shall be for a term of five (5) years, provided, however, by ordinance at any time,
the City Council may repeal this Ordinance 2023-002 and withdraw the consent set forth herein.
In such event the effective date of the repeal and withdrawal shall be one (1) year from the date
of final adoption of the ordinance repealing this Ordinance 2023-002.
SECTION 3: CONFLICT
All ordinances or parts of ordinances in conflict with any of the provisions of this Ordinance are
hereby repealed.
SECTION 4: SEVERABILITY
Should any section or part of this section be declared invalid by any court of competent
jurisdiction, such adjudications shall not apply to or affect any other provision of this Ordinance,
except to the extent that the entire section or part of the section may be inseparable in meaning and
effect from the section to which such holding shall apply.
SECTION 5: ADMINISTRATIVE CORRECTION
This Ordinance may be re -numbered or re -lettered and the correction of typographical and/or
scrivener's errors which do not affect the intent may be authorized by the City Manager or
designee, without need of public hearing, by filing a corrected or re -codified copy of same with
the City Clerk.
SECTION 6: PUBLICATION AND EFFECTIVE DATE
This Ordinance shall be published as provided by law and it shall become law and shall take effect
immediately upon its Second Reading and Final Passage.

RE: Renewal of Countywide Municipal Service Taxing Unit for Ambulance and Emergency Medical
Services
Dear Ms. Howe:
The City executed Ordinance 2022-006 on February 8, 2022, providing that Clermont continue to be
included within Lake County's Countywide Municipal Service Taxing Unit (MSTU) for Ambulance and
Emergency Medical Services. The consent was for a period of one (1) year and will expire February 8,
2023.
To reduce administrative burdens on municipal staff and streamline the efficiencies of municipal
commission/council meetings, the City of Clermont could amend or pass a new MSTU ordinance without
an expiration date. As an example, there are eight (8) municipalities in Lake County that have already taken
action to pass MSTU ordinances without an expiration date.
Please advise if the City is amending its Ordinance to remain a part of the MSTU and if a no expiration
date would be considered. Once the ordinance has been executed, please provide our office with a copy of
the amended/new Ordinance for our records. If not, please advise me of the same.
