CONTRACT
THIS CONTRACT, entered into this 3 day of M 2022, by and between
FOUR SEASONS DISPLAY, INC.
AND
CITY OF CLERMONT
FOR AND IN CONSIDERATION of the mutual promise of benefits to be derived by both parties, they do
hereby agree to the following and in this Contract CITY OF CLERMONT is known as CLIENT and
MARITZA RIVERA is known as CLIENT'S AGENT.
FOUR SEASONS DISPLAY, INC. will present an Independence Day Fireworks display events on July 4,
2022 and July 4, 2023 for $22,500 (Twenty-two 'Thousand Five Hundred Dollars) per event. This contract
includes the barge and all equipment necessary to present the displays on Lake Minneola at Waterfront Park in
Clermont, Florida. The display will be fired electronically from a support boat on Lake Minneola.
CLIENT AGREES in addition to show cost to reimburse Four Seasons Display, Inc. for any and all costs for
fire protection if required by City of Clermont or local jurisdiction.
CLIENT AGREES to obtain proper permitting. FOUR SEASONS DISPLAY, INC. will provide necessary
documents for CLIENT to obtain permitting.
CLIENT AGREES to supply a safe and secure set-up site for this event including crowd control.
FOUR SEASONS DISPLAY, INC. agrees to purchase adequate insurance consisting of not less than
$5,000,000 per occurrence to cover this event with CLIENT and other related entities designated by client as
additional insured at no additional cost to client.
FOUR SEASONS DISPLAY, INC. will conduct this display in a safe manner and comply or exceed all
distance requirements as regulated by local fire jurisdiction and NFPA 1123.
If, for any reason, (weather or any unsafe conditions) the fireworks show is canceled, FOUR SEASONS
DISPLAY, INC. will be given the opportunity to re -schedule the show for a future date mutually agreed upon
by both parties and set as rain date indicated below. In the event that both parties do not agree upon a future
date, 50% of the total contract price would be paid to FOUR SEASONS DISPLAY, INC. for time and expenses
incurred in preparation.

CLIENT PARTY CANCELLATION: Show will be re -scheduled and set as rain date set at time of deposit.
FOUR SEASONS DISPLAY, INC. will make every reasonable effort to conduct the display as scheduled.
Should bad weather or any other unsafe condition prevent the display on the agreed dates, after crew is on site,
set-up is in progress, or set-up is finished, CLIENT is responsible for additional expense and travel costs not to
exceed 50% of the contracted price and will be deducted from the deposit or added to the final payment of the
show.
CLIENT agrees to pay all Attorneys' fees, Court cost and a total of all incurred cost and/or loss if FOUR
SEASONS DISPLAY, INC. should obtain an Attorney to enforce collection of this account.
CLIENT agrees to name Four Seasons Display, Inc. in all media correspondence and advertising concerning
this event as the Fireworks Company presenting the display.
DEPOSIT: Deposit is due no later than 60 days before display date.
DEPOSIT: A 50% Deposit of $11.250.00 (Eleven Thousand Two Hundred Fifty Dollars) is required to secure
the shooting date to make this contract valid and secure necessary proof of insurance. Balance of $11,250.00
(Eleven Thousand Two Hundred Fifty Dollars) will be due upon completion of show.
CLIENT'S AGENT: MARITZA RIVERA, Program Coordinator shall be designated as CLIENT'S AGENT to
whom all questions and inquiries shall be sent. CLIENT'S AGENT shall be the only agent of the CLIENT
authorized to request rescheduling of the delivery and exhibition of the fireworks display on part of the
CLIENT.
THIS CONTRACT IS THE ENTIRE AGREEMENT BETWEEN BOTH PARTIES AND CAN ONLY BE
MODIFIED IN WRITING WITH BOTH PARTIES SIGNATURES AND DEPOSIT OF $11,250.00.
DEPOSIT IS DUE AT LEAST 30 DAYS BEFORE DISPLAY DATE. THE CONTRACT BINDS AND
BENEFITS BOTH PARTIES, THEIR SUCCESSORS AND ASSIGNS. TIME IS OF THE ESSENCE. OF
THIS CONTRACT.
