10-24-1986 Regular Meeting '~ . CITY OF CLERMONT MINUTES SPECIAL COUNCIL MEETING October 24, 1986 A Special Council Meeting was held Friday, October 22, 1986 in the City Hall Conference Room. The meeting was called to order by Mayor Pool at 8:00 a.m. with the following Council Members in attend'ance: Dupee, Turville and Huff. Council Member Cole was absent due to a prior commitment, Other City Officials present were City Manager Saunders, City Attorney Baird, Finance Director Van Zile, and City Engineer Springstead. Others present were Paul Bradley, Virginia Polk and Bob Richenberg. City Manager Saunders explained that Watson Construction Company,. the contractor who was awarded the bids for the treatment plant expansion and for Lift Station #6 has issued a letter withdrawing from the contracts due to delay in returning the signed documents, as outlined in the bid specifications. These specifications state that the City must return the signed contacts to the contractor within 15 days of receipt of acceptable contract documents, bonds and insurance. The FmHA must approve contract documents and they have issued a letter to the City that stated the contract documents should be acceptable with some minor corrections. It is the City's position and the FmHA's position that the City has not yet received acceptable documents, City Attorney Baird stated that he felt comfortable with the City's position, but from an economic standpoint the City should negotiate a settlement for cost of delays. Mr. Saunders stated that the second lowest bidder's bid is $177,000 over Watson Construction Company, City Engineer Springstead stated that rebidding the project would require 4 - 5 months and could cost considerably more. City Manager Saunders stated that Watson Construc- tion is asking for $100,000 for delay costs. 86-191 After much discussion, A MOTION WAS MADE BY COUNCIL'MEMBER HUFF, SECONDED BY COUNCIL MEMBER DUPEE AND UNANIMOUSLY CARRIED FOR THE STAFF TO NEGOTIATE A SETTLEMENT FOR DELAYS, SUBJECT TO COUNCIL APPROVAL. ABANDONED RAILROAD RIGHT-OF-WAY City Manager Saunders reported that Mr. Rast of CSX Systems had verbally accepted the City's offer for the right-of-way and would start processing the paper work.
