06-24-1986 Regular Meeting . e CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING June 24, 1986 The Regular Meeting of the Clermont City Council was held on Tuesday, June 24, 1986 in the Council Chambers. The meeting was called to order at 7:35 p,m. by Mayor Pool with the following Council Members in attendance: Council Member Cole, Council Member Dupee, Council Member Huff, and Mayor Pro Tem Turville. Other City Officials present were City Manager Saunders, City Attorney Baird, Finance Director Van Zile, and Deputy City Clerk Brandt. INVOCATION The Invocation was offered by Nilsa Whitehead followed by the repeating of the Pledge of Allegiance to the Flag by all present. REPORTS CITY MANAGER'S REPORT WEST BEACH DOCK It was reported that construction of the fishing pier at West Beach was completed and already had been put to good use by local citizens. LEAGUE OF CITIES QUARTERLY MEETING It was reported that the quarterly meeting of the Lake County League of Cities would be held on Wednesday, July 16, 1986 in Lady Lake. Those Council Members wishing to attend were asked to contact Julie Brandt by Friday, June 27th. LEAGUE OF CITIES BOARD OF DIRECTORS City Manager Saunders stated that the City was eligible to have a Director and Alternate on the Board of Directors of the Lake County League of Cities, and asked if the Council wished to make those appointments. The Board of Directors meets the third Friday of each month at noon. 86- 118 A MOTION WAS MADE BY MAYOR POOL, SECONDED BY COUNCIL MEMBER HUFF AND UNANIMOUSLY CARRIED TO APPOINT COUNCIL MEMBER DUPEE AS THE CITY'S REPRESENTATIVE TO THE LAKE COUNTY LEAGUE OF CITIES BOARD OF DIRECTORS. A MOTION WAS THEN MADE BY COUNCIL MEMBER COLE, SECONDED BY COUNCIL MEMBER HUFF AND UNANIMOUSLY CARRIED TO APPOINT MAYOR POOL AS THE CITY'S ALTERNATE REPRESENTATIVE TO THE LAKE COUNTY LEAGUE OF CITIES BOARD OF DIRECTORS. MAYOR'S REPORT 86- 119 MORITORIUM ON LARGE-SCALE MOBILE HOME PARKS Mayor Pool stated that he agreed with County Commissioner Claude Smoak's position that a six month moritorium should be placed on large scale mobile home developments in Lake County. The mori- torium would give the County time to evaluate its ,present policy which encourages this type of development at the expense of build- ing apartments or homes. He further stated that he was not 'anti-mobile home, but would like the City to pass a Resolution concurring with Commissioner Smoak's position. 86- 120 After a brief discussion. A MOTION WAS MADE BY COUNCIL MEMBER . e CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING June 24, 1986 Page -2- TURVILLE, SECONDED BY COUNCIL MEMBER DUPEE AND UNANIMOUSLY CARRIED TO PLACE THIS ITEM ON THE AGENDA OF THE NEXT REGULAR COUNCIL MEETING WITH A RESOLUTION SUPPORTING THE MORITORIUM ON MOBILE HOME PARKS. COUNCIL MEMBER DUPEE'S REPORT EAST CENTRAL FLORIDA REGIONAL PLANNING COUNCIL Council Member Dupee reported that she had been chosen again as the representative to the Board of Directors of the East Central Florida Regional Planning Council. She also stated that she had been appointed representative to the Green Swamp Resource and Management Committee. It was pointed out that Polk County representatives are again trying to get their area out of the "area of critical concern" in the Green Swamp, and that a meeting concerning this matter would be held sometime in September in Polk County. Mrs. Dupee assured the Council she would keep them ~nformed on this important matter. COUNCIL MEMBER TURVILLE'S REPORT ANDERSON HILL Council Member Turville stated that he had received complaints about the manner in which the County had diverted water coming down Anderson Hill causing it to run across across Lakeshore Drive during periods of heavy rainfall. He suggested that some type of retention area may be needed in the area. City Manager Saunders stated that he would con- tact the County concerning this matter. COUNCIL MEMBER HUFF'S REPORT LEAGUE OF CITIES BOARD OF DIRECTORS MEETING Council Member Huff stated that he had attended the Lake County League of Cities Board of Directors Meeting held last Friday, and reported that there had been so much opposition to the Department of Environ- mental Regulation G-l Aquifer Rule during a Miami Workshop, that the proposed rule, as written, had been scraped. The next workshop con- cerning this matter will be held in Brooksville, and the City will be receiving a letter from Richard Swartz, President of the Lake County League of Cities, as to the date and time of the meeting. COUNCIL MEMBER COLE'S REPORT WEST BEACH Council Member Cole stated that he had observed the consumption of alcoholic beverages at West Beach, and requested that the Police Department patrol the area more often. City Manager Saunders stated that he would inform the Police Department of this matter. VISITORS WITH BUSINESS GLORIA JOHNSON Gloria Johnson appeared before Council to request permission to cross City owned property to install an irrigation system to pump water from East Lake to her home at 667 Pitt Street. Mrs. Johnson explained that previously she had been denied this request, but that she had noticed other pumps, including one bn Beals' property on Lakeshore Drive, had been installed. . e CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING June 24, 1986 Page -3- Mayor Pool then read an excerpt from the Minutes of the June 24, 1984, Council Meeting during which the Council adopted a policy to not allow persons to cross the City right-of-way or property to install irriga- tion systems in the City's small internal lakes. Mrs. Johnson stated that she believed the pump on Lakeshore Drive had been installed after she made her request, and questioned why her request had been denied. Some discussion ensued concerning why the policy was adopted. It was the consensus of Council to uphold the 1984 policy, and Mayor Pool stated that the City would investigate Mrs. Johnson's allegations. If it is determined that the pumps were installed in violation of City Policy, the property owners will be required to remove them. RESOLUTION NO. 530 - MASTER TRAFFIC SIGNAL MAINTENANCE AGREEMENT It was explained that the State Department of Transportation had already accepted the City's Master Traffic Signal Maintenance Agreement which was approved by the City Council on May 13, 1986. Resolution No. 530 authorizes the City Manager to acknowledge and approve request orders from the Department of Transportation. City Manager Saunders stated that the first request made, which had already been approved under the new agreement would be the installa- tion of the caution light at the intersection of Highway 27 and Hook Street. Council Member Cole asked about the status of moving the traffic signal control box located at the intersection of Fifth Street and Highway 50. The control box is located too close to the intersection and has been severely damaged several times, City Manager Saunders stated that he had spoken with the Department of Transportation in Deland, and they were investigating the situation to see what could be done. He further stated that he expected an answer within the next few weeks. 86- 121 After a brief discussion, A MOTION WAS MADE BY COUNCIL MEMBER HUFF, SECONDED BY COUNCIL MEMBER DUPEE AND UNANIMOUSLY CARRIED BY ROLL CALL VOTE TO ADOPT RESOLUTION NO. 530 AURHORIZING THE CITY MANAGER TO ACK- KNOWLEDGE AND APPROVE REQUEST ORDERS FROM THE DEPARTMENT OF TRANSPORTA TION. THE RESOLUTION WAS READ BY TITLE ONLY. TERMINATION OF A TEN FOOT'UTILITY EASEMENT ACROSS LOT 4, DICKSON SHORES City Manager.Saunders explained that Attorney George Hovis, representing the seller of Lot 4, Dickson Shores, First Addition, was requesting the termination of a ten foot utility easement across the lot. Mr. Saunders continued by stating that he had been advised by Utility Director Preston Davis that the City no longer needed the easement. The water line originally crossing the property had been removed, and subsequently replaced with a new, rerouted line. 86- 122 A MOTION WAS MADE BY COUNCIL MEMBER DUPEE, SECONDED BY COUNCIL MEMBER TURVILLE AND UNANIMOUSLY CARRIED TO ABANDON AND TERMINATE THE TEN FOOT UTILITY EASEMENT ACROSS LOT 4, DICKSON SHORES, FIRST ADDITION. BASS FISHING TOURNAMENTS It was reported that Miller's Bait and Tackle of Altamonte Springs had requested the use of the Jaycee Beach Boat Ramp and area for two Tournaments to be held October 4, 1986 and March 7, 1987. It was pointed out that these tournaments usually have one hundred to one hundred-fifty participants. ' . . CITY OF CLERMONT MINUTES REGULAR COUNCIL MEETING June 24, 1986 Page -4- In light of recent legislation banning Bass Fishing Tournaments with twenty-five or more boats on the Clermont chain-of-lakes, it was determined that no Council action should be taken on this matter. City Attorney Baird stated that the law would become effective October 1, 1986, and that a letter should be sent to Miller's Bait and Tackle explaining the situation. PUBLIC COMMENTS Nilsa Whitehead, who was present in the audience, stated that she had been approached by several people asking that the,City adopt 'an ordinance against children riding in the back of pickup trucks, City Attorney Baird explained that the City had no jurisdiction over riding in the back of pickup trucks, and could not pass such an ordinance.
