O-343-C CITY OF CLERMONT ORDINANCE NO. 343-C AN ORDINANCE OF THE CITY OF CLERMONT AMENDING CHAPTER 10, "ANIMALS", OF THE CITY CODE BY AMENDING SECTION 10-78, "VACCINATIONS REQUIl2ED", TO REMOVE THE REQUIREMENT THAT ANIMALS BE VACCINATED FOR RABIES ON AN ANN-UAL BASIS, PROVIDED THAT THE ANIMAL HAS A CURRENT VACCINATION CERTIFICATE ISSUED BY A VETERINARIAN THAT HAS ADMII~ISTERED A RABIES VACCINE AS APPROVED AND LICENSED BY THE U.S. DEPARTMENT OF AGRICULTURE, PROVIDING FOR SEVERABILITY, CONFLICT, AND EFFECTNE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, FLORIDA, as follows: Section 1. That Section 10-78, "Vaccinations Required" of the Code of Ordinances, City of Clermont, Florida is amended to read as follows (note strikethrough indicates removed • words and underlined indicates added): Sec. 10-78. Vaccinations required. (a) It shall be unlawful for the owner of any rabies-susceptible animal, for which a licensed vaccine is available, to fail to have said rabies- susceptible animal vaccinated against rabies by a licensed veterinarian of his or her choice, ~ as provided in subsection (d). (b) Evidence of vaccination shall consist of a current rabies certificate signed by the licensed veterinarian administering the vaccine. The certificate in triplicate shall show the date and type of vaccination, the name and address of the owner, the year and serial number of the animal's required tag, the breed, age, color and sex of the animal and any other pertinent data for proper identification of the animal. One copy of the certificate shall be given to the owner, one copy filed with the animal control office, and one copy retained by the veterinarian administering the vaccine. (c) No rabies-susceptible animal need be vaccinated for rabies where a licensed veterinarian has examined the rabies-susceptible animal • 1 and certified that vaccination would endanger said animal's health • at that time because of age, infirmity, debility, or other physiological consideration, and such certificate is presented to the enforcing agency within five days of such examination; provided that such certificate shall not be valid for more than 12 months from the date of issuance. (d) All rabies-susceptible animals shall be vaccinated with a rabies vaccine licensed and approved by the U.S. Department of Agriculture. Section 2. Severability. It is declared to be the intent of the City Council that, if any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof. Section 3. Conflict. Any portion of the Code of Ordinances, City of Clermont, Florida or any ordinance or part thereof in conflict with this ordinance is hereby repealed to the extent of such conflict. Section 4. Effective Date.
