R-05-1450CITY OF CLERMONT RESOLUTION • NO. 1450 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, FLORIDA AUTHORIZING EXEMPT SALARIED EMPLOYEES TO RECEIVE PAYMENT FOR OVERTIME WHEN A CITY-WIDE STATE OF EMERGENCY HAS BEEN DECLARED BY THE MAYOR OR IN HIS ABSENCE THE MAYOR PRO TEM AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Clermont realizes that during an emergency situation, some salaried employees who are exempt from the overtime provisions of the Fair Labor Standards Act may be required to work beyond their regularly scheduled hours; and WHEREAS, the requirement for that work is due to the emergency situation; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF CLERMONT, FLORIDA; 1. The payment of overtime to exempt salaried employees is authorized when aCity-wide state of emergency has been declared by the Mayor or in his absence the Mayor Pro Tem. 2. The payment of overtime to exempt salaried employees will only be for work performed in excess of fifty (50) hours in a work week during the City-wide state of emergency period that is necessary in order to protect life, property or the effective operation of the City. • Leave taken during the work period that the overtime is worked in will not count as hours worked. 3. All overtime paid in accordance with this resolution will be paid at an hourly rate calculated by dividing the employee's normal salary for a pay period by the number of regularly scheduled hours in the pay period. 4. This resolution shall apply to all exempt salaried employees of the City, with the exception of the City Manager. 5. This Resolution shall take effect immediately.
