LOCAL PLANNING AGENCY MEETING
JUNE 20, 1995
The meeting of the Local Planning Agency was called to order Tuesday, June 20, 1995 at
7:00 P.M. by Chairman Robert Smythe. Members present were James Brown, Wendell
McDannel, Marilyn George and Keith Mullins. Members Joseph Janusiak, Darryl
Bishop, Bill Rauch and Joseph Wiebush were absent. Also attending were Lanny
Harker, Director of Planning and Mimi Shaw Ogden, Planning Technician.
Mr. Harker explained that this is the first public hearing for amendment of the
Comprehensive Plan. The LPA will be required to make a recommendation to the City
Council for submittal to the Department of Community Affairs.
Mr. Harker noted that he would like to begin with item #3 on the memo to the LPA.
Mr. Harker indicated the revision of Future Land Use Element Policy 1-5, would
essentially revise the manner in which Floor Area Ratio (FAR) is calculated. The
maximum FAR was previously designated in the Comprehensive Plan to be 18%. This
change is simply making the floor area ratio a formula, rather than a flat percentage.
T'he formula would be based on the established impervious surface coverage ratios as
specified for each development district as specified in the Land Development
Regulations, established parking requirements as specified in the LDR's, established
Landscape and Buffering standards as specified in the LDR's, and the established
stormwater abatement standards as specified in the LDR's and Drainage Element of the
Comprehensive Plan.
The second policy that is recommended to be changed is in the Drainage Sub-Element.
This amendment has added Policy 4-12, that provides for mitigated encroachment of
certain infrastructure within special flood hazard areas. (Copies of the proposed changes
and new policy were previously provided to the LPA for their review).
At this time Chairman Smythe asked all those present who wished to speak in regard to
this items be sworn in.
There was no one present who wished to speak in regard to these items.
A motion was made by Marilyn George to recommend approval of the changes to the
Future Land Use Element and Drainage Sub-Element to the City Council as presented
by staff, seconded by Keith Mullins and approved by a unanimous vote.
Mr. Harker stated he would now like to proceed with item #2 on the Memorandum to
the LPA. This is the revision of the Future Land Use Map to accommodate request for
Future Land Use classification change (.71 acres) for property presently located within
the City. Specifically, the amendment is for two (2) lots located behind the First Federal
Bank building. Under the current land use designation this property is residential and
the applicant has requested the property be changed to residential/professional office.

(A Future Land Use Map was provided for the LPA's review and consideration). Mr.
Harker stated that Staff recommends this amendment be approved as it is consistent with
the surrounding land uses.
Mr. Harker noted that since the packets were prepared for the LPA there has been an
additional change requested (copy of letter from Harold Roberts Realty on behalf of the
owner Mr. Eulon Richardson was distnbuted to the LPA members). Mr. Richardson's
property is located on U.S. Highway 27, directly adjacent to the Skyline Motel. Mr.
Richardson is requesting that his property, which is currently designated as residential on
the Future Land Use Map, be changed to commercial, as there is interest in a project
similar to the Skyline Motel being located on this site. The surrounding area, adjacent to
U.S. 27, includes the Skyline Motel and Edgewood Lakes PUD commercial lots to the
north, and the Citrus Tower tourist facility, Motel 8 and the House of Presidents wax
museum to the east, hence tourist oriented facilities are predominate in this area.
Due to the historic trend evidenced in this area, Staff would recommend that not only
Mr. Richardson's parcel be amended but also the adjacent two parcels to the south also
be changed to commercial use. In addition, Tourist Accommodations are recommended
to be added to the UD-3 Future Land Use District category as an allowable use.
At this time Chairman Smythe asked all those present who wished to speak in regard to
this items be sworn in.
There was no one present who wished to speak in regard to these items.
Member McDannel asked how far this commercial district would extend.
Mr. Harker noted this would extend from Grand Highway south to Hunt Street, which is
a paper street (i.e. designated right-of--way, unimproved).
A motion was made by Wendell McDannel to recommend approval of the changes to the
Future Land Use Map and the UD-3 Land Use District to the City Council as presented
by staff, seconded by Marilyn George and approved by a unanimous vote.
Mr. Harker stated that he would at this time like to proceed with item #1 which pertains
to revision of the Future Land Use Map to accommodate property annexed into the City
which must be provided with a Future Land Use classification. An Annexation Acreage
List and revised Future Land Use Map have been provided for review and consideration.
Mr. Harker noted that each parcel previously annexed is referenced by the corresponding
annexation number in the table provided to the LPA. Map reference may be

coordinated from the list. This table also provided the Existing Land Use of each
annexed parcel and Future Land Use Category.
Mr. Harker noted that the LPA was distnbuted a revised annexation table (dated 6-20-
95). The only change on this table is Ordinance 282-M which is comprised on 175 acres.
The City had originally provided approximately 85 acres of commercial along State Road
50, 40 acres of residential/professional office, with the remainder to be residential.
However, after discussions with the consultants for this property, a request has been
received to decrease the commercial to 45+/- acres, and omit the residentiaUprofessional
office designation entirely. They have also requested a UD-5 district language
amendment to say that commercial development would be allowed 1,300 feet north of
S.R. 50, as opposed to the 2,400 that is currently in the FLU district directive. The
remainder of the property would be residential with the exception of approximately 4.5
acres that is to be designated conservation area due to its location within the 100-year
flood area.
Mr. Harker proceeded with agenda item #4. Revision of a certain portion of the data,
inventory, and analysis concerning Future Land Use District designations. The
Undeveloped District S (UD-5) has added directives #10, #11, and #12 pertaining to
areas located east of U.S. 27 and north of S.R. 50. Mr. Harker noted that directive #12
will now be changed to state "General commercial uses should occur adjacent to the
major roadway and not extend more than 1,300 feet north of Highway 50", as discussed
earlier. The Undeveloped District 6 (UD-6) has been created to direct development
patterns located east of U.S. 27 and south of S.R. 50. Essentially, revision is occumng in
response to annexation that has occurred in this area.
At this time Chairman Smythe asked all those present who wished to speak in regard to
this case be sworn in.
Persons sworn in were Neil Frazee, representative of Miller-Sellen Associates, Inc.
Mr. Frazee noted that they have been working with Mr. Harker to formulate a plan that
would be appropriate for the Ordinance 282-M area.
After further discussion, a motion was made by Marilyn George to recommend approval
to the City Council of Agenda items 1 and 4 as presented by staff, seconded by James
Brown, approved by a unanimous vote.
A final motion was then made by Wendell McDannel to recommend approval of the
discussed amendments to the City Council for transmittal to DCA, seconded by Marilyn
George and approved by a unanimous vote.
