07-20-2004 Regular MeetingCITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD JULY 20, 2004 The regular meeting of the Code Enforcement Board was called to order on Tuesday, July 20, 2004 at 7:00 p.m. Members attending were Joe Janusiak, Paul Lienard, Peter Geigel and Sharon Martin. Stephen Berlinsky was absent and it was announced that Alvin Schein has passed away. Also attending were Betty McMinamen, Code Enforcement Officer, Yvette Brown, City Attorney and Jane C. McAllister, Code Enforcement Clerk. The minutes from the Code Enforcement Board meeting of June 15, 2004 were approved as written. Chairman Paul Lienard gave the floor to Code Enforcement Officer Betty McMinamen. VIOLATION: CASE NO. 04-144: City of Clermont Code of Ordinances No. 36-C, Chapter 34, Section 34-95. Unlawful Storage in Residential Areas. Code Enforcement Officer Betty McMinamen stated that the violations still exist and asked that the Board find the Respondent in violation. Herbert Jackson Sr. 4107 Kingsbridge Drive, Orlando, FL 32839 was sworn in and said that he has not looked after the property due to lack of time. He asked for more time in order to decide whether he should rehab or raze the structure. In the matter of Case No. 04-942 Sharon Martin made a motion to find the Respondent • in violation of the cited City Code: seconded by Joe Janusiak. The vote was unanimous in favor of finding the Respondent in violation. Sharon Martin made a motion to allow the Respondent until October 19 2004 to comply or be fined at the rate of $900.00 per week until compliance is met• seconded by Joe Janusiak. The vote was unanimous in favor of the time limit and the fine. In the matter of Case No. 04-143 Sharon Martin made a motion to find the Respondent in violation of the cited City Code; seconded by Joe Janusiak. The vote was unanimous in favor of finding the Respondent in violation. Montrose Street Clermont, FL 34711 LOCATION OF VIOLATION: 792 E. Montrose Street, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14- 76(12). Unsafe Building Due to Lack of Maintenance. Code Enforcement Officer Betty McMinamen reiterated the history of the property in question and informed the Board that this was the Respondents opportunity to state that the property is now in compliance and to stop the filing of the lien if the property is indeed in compliance. This property was not in compliance, however the Pastor and a • church member requested to speak and were granted that opportunity . Pastor Daryl Forehand, 1406 N. Carver Lane, Lakeland, FL 33805, and James Jenkins, 1503 Herring Lane, Clermont, FL 34711 were sworn in and both pleaded with the Board to forgive the fine and not file an administrative lien on the property. City Attorney Yvette Brown explained that it was no longer in the power of the Board to stop the fine from running since that has already been decided. She further explained that this was merely an opportunity for the Responded to inform the Board that he is in compliance to stop the filing of an administrative lien. That was not the case. Peter Geigel made a motion to file the order for the administrative lien; seconded by Joe Janusiak. The vote was unanimous in favor of filing the order for the administrative fine. LOCATION OF VIOLATION: 941 Scott Street, Clermont, FL 34711 VIOLATION: CASE NO. 04-103: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14-76(12). Unsafe Building Due to Fire and Deterioration. Code Enforcement officer Betty McMinamen indicated the although there has been a great deal of progress the violations still exist. • Louis Manzella, 10350 Log House Road, Clermont, FL 34711 was sworn in and asked that the orders for the administrative fines on these properties not be filed. He said that he has made a tremendous effort to comply and should meet compliance very soon. However, the properties are not in compliance at this time. In the matter of Case No. 04-99, Case No. 04-101 and Case No. 04-103 the Board unanimously agreed that the order for an administrative lien should be filed.
