08-14-2004 Regular Meeting• CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD August 17, 2004 The regular meeting of the Code Enforcement Board was called to order on Tuesday, July 20, 2004 at 7:00 p.m. Members attending were Joe Janusiak, Paul Lienard, Peter Geigel and Stephen Berlinsky. Sharon Martin was absent. Also attending were Betty McMinamen, Code Enforcement Officer, Yvette Brown, City Attorney and Jane C. McAllister, Code Enforcement Clerk. The minutes from the Code Enforcement Board meeting of July 20, 2004 were approved as written. Chairman Paul Lienard stated that the Board needed to elect a Vice Chairman. Mr. Lienard nominated Stephen Berlinsky for Vice Chairman. Peter Geigel seconded the motion. The vote was unanimous for Stephen Berlinsky to be Vice Chairman. Chairman Paul Lienard gave the floor to Code Enforcement Officer Betty McMinamen. NEW BUSINESS • CASE NO. 04-148 South Lake Community Foundation, Inc. 912 West Avenue Clermont, FL 34711 LOCATION OF VIOLATION :912 West Avenue, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 106, Section 106-4(a)(b). Site Development Review and Permit Required. Code Enforcement officer Betty McMinamen stated that the violations still exist and asked that the Board find the Respondent in violation. She added that the South Lake Community Foundation has asked for 60 days in order to get their plans through the Planning & Zoning Department and through the Engineering Department. Stephen Berlinsky made a motion to find the Respondent in violation of the cited City Code; seconded by Joe Janusiak. Karst Jr. and Randall Lee Karst 1158 Fifth Street Clermont, FL 34711 LOCATION OF VIOLATIONS: 1158 Fifth Street, Clermont, FL. 34711 VIOLATION: CASE NO. 04-149: City of Clermont Code of Ordinances No. 281-C, Chapter 102, Section 102-6,8, &15. Sign Permits Required and Prohibited Signs. Code Enforcement Officer Betty McMinamen stated that the violations still exist and • asked that the Board find the Respondent in violation. Cliff Rowe, 1158 Fifth Street, Clermont, FL 34711, was sworn in. Mr. Rowe leases the building in question and has his business there. Mr. Rowe stated that he forgot to get a sign permit after his first contact with Code Enforcement. He stated further that he has been in touch with a sign company and asked for 60 days in order to secure his signs and the permits for them. Peter Geigel made a motion to find the Respondent in violation of the cited City Code; seconded by Stephen Berlinsky The vote was unanimous for finding the Respondent in violation. Magnolia Ave Clermont, FL 34711 LOCATION OF VIOLATIONS: 378 W. Magnolia Street, Clermont, FL. VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 122, Section 122-344(a). Building Permit Required. Code Enforcement Officer Betty McMinamen read the violation and stated that work was stopped on the above named property by Lake County because the owner did not have a City of Clermont zoning clearance or the proper permits from Lake County Building Department. There are two separate apartments and the dwelling must be only a single family. • Ms. McMinamen stated that the violations still exist and asked that the Board find the Respondent in violation of City Code. The respondents were not present nor were any representatives. Stephen Berlinsky made a motion to find the Respondent in violation of the cited City Code seconded by Joe Janusiak The vote was unanimous for finding the Respondents in violation. CASE N0.04-151 Amy Jo Gomes and Renee D. Phares 477 Carroll Street Clermont, FL 34711 LOCATION OF VIOLATION: 477 Carroll Street, Clermont, FL 34711 • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD August 17, 2004 VIOLATION: City of Clermont Code of Ordinances No. 299-C, Chapter 122, Section 122-181 thru 184. Office Requires Conditional Use Permit in R-3 zoning. Code Enforcement Officer Betty McMinamen stated that there is a computer business at the above mentioned site and that they do no have a CUP as required in R-3 for professional offices. The reason they can not simply get a CUP is because the Future Land Use is residential and does not include professional office. Ms. McMinamen asked the Board to find the Respondents in violation, but to give them a low fine and a long time period so they can find another location. Renee D. Phares, 17355 Court Street, Winter Garden, FL was sworn in and said that they went through Blackburn Realty and were told this location would be suitable for an office. She said they will need time to find another location. • Stephen Berlinskv made a motion to find the Respondents in violation of the cited City Code; seconded by Joe Janusiak. The vote was unanimous for finding the Respondents in violation. Stephen Berlinskv made a motion to allow the Respondents until December 21 2004 to comply or be fined at the rate of $33.00 per dam Paul Lienard made a motion to amend the fine to $10 00 per day~ Seconded by Joe Janusiak. The vote was unanimous in favor of the time period and in favor of the amended fine of $10.00 per day. OTHER BUSINESS CASE NO. 04-101 Manzella Builders & Remodeling Inc. 931 Scott Street Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No.249-C, Chapter 14, Section 14- 76(12). • Unsafe Building Due to Lack of Maintenance. 4 • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD August 17, 2004 Code Enforcement Officer Betty McMinamen said that last month Mr. Manzella asked for and was granted additional time. She stated that since the lien has not been filed, the Board has the ability to forgive the fine if they so choose. Mr. Manzella has asked that board forgive this fine. Stephen Berlinsky moved to forgive the fine; seconded by Peter Geigel. The vote was unanimous in favor of forgiving the fine. In the matter of Case No. 04-119 Stephen Berlinsky made a motion to extend the lien start date to October 19. 2004 with a fine of $14.28 per day if not in compliance; seconded by Joe Janusiak. The vote was unanimous in favor of the time limit and the fine.
