CODE ENFORCEMENT BOARD
September 21, 2004
The regular meeting of the Code Enforcement Board was called to order on Tuesday,
September 21, 2004 at 7:00 p.m. Members attending were Joe Janusiak, Peter Geigel
Stephen Berlinsky, Jim Purvis and A.D. VanDeMark. Sharon Martin and Paul Lienard
were absent. Also attending were Betty McMinamen, Code Enforcement Officer, Yvette
Brown, City Attorney and Jane C. McAllister, Code Enforcement Clerk.
The minutes from the Code Enforcement Board meeting of August 17, 2004 were
approved as written.
Vice Chairman Stephen Berlinsky introduced the two new members of the Board Jim
Purvis and A.D. VanDeMark who told those present a little about themselves.

CASE NO. 04-152

VIOLATION: City of Clermont Code of Ordinances No. 36-C, Chapter 34, Section 34-
95.
Unlawful Storage In Residential Areas.
Code Enforcement officer Betty McMinamen presented pictures taken back in June and
photos taken Sept. 20, 2004. Ms McMinamen stated that although there has been some
improvement the violations still exist. She asked that the Board find the Respondent in
violation and give enough time to finish cleaning up.
Dorothy McGriff, 933 Scott Street, Clermont, FL 34711 was sworn in and stated that the
building in question belongs to her daughter who lives out of town. Mrs. McGriff asked
for additional time to clean up.
Jonathan McGriff, 933 Scott Street, Clermont, FL 34711 was sworn in and stated that
there are a couple of the vehicles still on the property. He said that one of them is the
renter's vehicle.

Peter Geigel made a motion to frnd the Respondent in violation of the cited City Code;
seconded• by Jim Purvis The vote was unanimous for finding the Respondent in
violation.
Peter Geigel made a motion fo allow the Respondent until November 76, 2004 to
comply or be tined at the rate of $3 00 per day' seconded by Joe Janusiak. The vote
was unanimous in favor of the time limit and the fine.

• VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34-
61. Unlawful Maintenance of Nuisances.
Code Enforcement Officer Betty McMinamen stated that the Respondent was not
present but that she had received notice and therefore the case would be heard. Ms.
McMinamen presented photo taken Sept. 20, 2004 showing that the violations still exist
and asked that the Board find the Respondent in violation.
Peter Geigel made a motion to find the Respondent in violation of the cited City Code;
seconded by Joe Janusiak The vote was unanimous for hnding the Respondent in
violation.
Peter Geigel made a motion to allow the Respondent until December 21, 2004 to
comply or be lined at the rate of $3 00 per day until compliance is met• seconded by Joe
Janusiak. The vote was unanimous in favor of the time limit and the amount of the fine.

VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34-
61 Unlawful Maintenance of Nuisances.
Code Enforcement Officer Betty McMinamen read the violation and stated that there is
no representation of the Respondent. She showed pictures indicating that the violations
still exist as of September 20, 2004, and asked that the Board find the Respondent in
violation of the cited city code.
Peter Geigel made a motion to find the Respondent in violation of the cited City Code;
seconded by Joe Janusiak. The vote was unanimous for findin_g the Respondent in
violation.
Peter Geigel made a motion to allow the Respondent until December 21, 2004 to
comply or be fined at the rate of $3.00 per day until compliance is met; seconded by Joe
Janusiak.
• Stephen Berlinsky said the Board should consider that this rental is empty now, but
could possibly be rented in the future, and that they might want to consider raising the
fine.
Peter Geigel said there are two properties that need to be fixed by December 21, 2004
and that they should be treated the same way.
The vote was unanimous in favor of the time limit and the fine.

Code Enforcement Officer Betty McMinamen read the violations and stated that the
family has made progress in cleaning up the lots. She said people dump things on these
lots and that the lots are overgrown. Ms. McMinamen showed pictures taken on
September 20, 2004 indicating that the property is still in violation of city code.
Andrea Brodus, 265 Osceola Street, Clermont, FL. was sworn in and stated that people
dump trash on the property and whenever they are notified by the City they clean it up.
Dorothy Lewis, 1585 Silhouette Dr., Clermont, FL 34711 was sworn in and stated that
her mother is the owner of the property and that they are always getting notices from
the City to clean up their lots, yet there are plenty of other violations that are not
pursued by the City. She indicated that she thinks they are being singled out.
Peter Geigel made a motion to find the Respondent in violation of the cited City Code;
seconded by Joe Janusiak. The vote was unanimous for finding the Respondents in
violation.
Peter Geigel made a motion to allow the Respondent until December 21, 2004 to
• comply or be frned at the rate of $2.00 per day. The vote was unanimous in favor of the
time period and the amount of the fine.
CASE NO. 04-156

VIOLATION: City of Clermont Code of Ordinances No.232-C, Chapter 34, Section 34-
61 Unlawful Maintenance of Nuisances.
Code Enforcement Officer Betty McMinamen said that she did not have service on this
case and therefore it will not be heard.

LOCATION OF VIOLATION: 1820 Highway 27, Clermont, FL 34711
VIOLATION : City of Clermont Code of Ordinances No. 281-C, Chapter 102, Section
102-6. Sign Permit(s) required.
Code Enforcement Officer Betty McMinamen presented pictures showing that there are
signs at the above location, and she stated that these signs have not been permitted.
Ms. McMinamen asked that the Respondent be found in violation of City Code.
The Respondent was not present or represented.
Peter Geigel made a motion find the Respondent in violation of fhe cited City Code;
seconded by Joe Janusiak. The vote was unanimous for finding fhe Respondent in
violation.
Peter Geigel made a motion to allow the Respondent until October 19, 2004 to comply
• or be fined at the rate of $5.00 per day,_per sign; seconded by Joe Janusiak.
There was discussion on the motion.
Peter Geigel amended his motion to Erne the Respondent at the rate of $10.00 per day
per sign; seconded by Joe Janusiak.
There was further discussion on the motion which included the suggestion that the fine
start immediately. It was decided there should be further research regarding this
suggestion.
Peter Geigel amended his motion to make the fine $25.00 per day: seconded by Joe
Janusiak. The vote was unanimous in favor of the time limit and the fine.
There being no further business, the meeting was adjourned.
