01-18-2005 Regular Meeting• CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD January 18, 2005 The regular meeting of the Code Enforcement Board was called to order on Tuesday, January 18, 2005 at 7:00 p.m. Members attending were Joe Janusiak, Peter Geigel Jim Purvis, A.D. VanDeMark, Stephen Berlinsky. Sharon Martin was absent. Also attending were Betty McMinamen, Code Enforcement Officer, Yvett rown Rodriguez, City Attorney and Jane C. McAllister, Leslie Schwartz, Code Enforcement Jerks. The minutes from the Code Enforcement Board meeting of November 16, 2004 were approved as written. The Pledge of Allegiance was recited. Acting Chairman, Stephen Berlinsky asked if anyone had been in contact with Sharon Martin. Ms. McMinamen stated that she had spoken to her and that this hearing was to be her last one. She was not going to be re-applying for appointment to the Code Enforcement Board. Acting Chairman, Stephen Berlinsky gave the floor to Code Enforcement Officer Betty McMinamen. • NEW BUSINESS CASE NO. 05-173 Alan J. & Katherine R. Pool 1069 Lakeshore Drive Clermont, FL 34711 LOCATION OF VIOLATION: 801 West Montrose Street, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 122, Section 122-244 (a) (11). Restaurant Requires Conditional Use Permit in CBD. Ms. McMinamen asked the Board for a continuance to a date certain of February 15, 2005 since there was no service on this case. The Code Enforcement Board agreed to Ms. McMinamen's request to continue this case to a date certain of February 15, 2005. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD January 18, 2005 CASE NO. 05-174 Alex Butchkosky 801 West Montrose Street Clermont, FL 34711 LOCATION OF VIOLATION: 801 West Montrose Street, Clermont, FL. 34711 VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 86, Section 148- Failure to Fulfill Obligations of Conditional Use Permit. Ms. McMinamen asked the Board for a continuance to a date certain of February 15, 2005. The Code Enforcement Board granted Ms. McMinamen's request. OLD BUSINESS CASE NO. 04-142 Herbert Jackson, Sr. 4107 Kingsbridge Drive Orlando, FL 32839 LOCATION OF VIOLATION: 611 Scott Street, Clermont, FL 34711. VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14- 76 (12). Unsafe Building Due to Lack of Maintenance. Ms. McMinamen presented the Board with pictures taken on January 14, 2005. Ms. McMinamen stated that she had driven by on the morning of January 18, 2005 to make sure nothing had changed. The property has remained the same. Fred Jackson, P.O. Box 210, Minneola FL, was sworn in. Mr. Jackson stated that he was part owner of 611 Scott Street, Clermont, FL. Mr. Jackson presented the Board with a deed that had a different legal description than the property in question. Mr. Jackson asked the Board for more time. Phares 477 Carroll Street Clermont, FL 34711 LOCATION OF VIOLATION: 477 Carroll Street, Clermont, FL 34711. VIOLATION: City of Clermont Code of Ordinances No. 299-C, Chapter 122, Section 122-181 thru 184. Office Requires Conditional Use Permit in R-3 District. Ms. McMinamen stated that Ms. Gomes & Ms. Phares have both worked diligently on resolving this issue and recommended that the Board grant their request for an extension. Amy Jo Gomes remained in the audience. Renee Phares, 17355 Cork Street, Winter Garden, FL was sworn in. • Ms. Phares stated that they had a deposit on 477 Carroll Street and had already purchased a new place of business in Minneola. Ms. Phares asked the Board to grant a (6) six month extension based on the facts stated above. After much discussion from the Board members, Ms. Phares request was denied and the fine would remain in place at $10.00 per day starting from December 21, 2004. CASE NO. 04-153 Daisy Clark 769 E. Montrose Street Clermont, FL 34711 LOCATION OF VIOLATION: 769 E. Montrose Street, Clermont, FL 34711. VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34- 61. Unlawful Maintenance of Nuisances. Ms. McMinamen presented the Board with pictures that she had taken on Friday January 14, 2005 showing that the violation against this property was still outstanding. Ms. McMinamen also stated that she had driven by this property this morning to be sure nothing had changed. The property has remained the same. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD January 18, 2005 Daisy Clark could not attend the hearing due to illness. Lucille DeRamus, 549 E. Broome Street, Clermont, FL 34711 was sworn in. Ms. DeRamus is the daughter of Daisy Clark. Ms. DeRamus stated that her brother was unwilling to allow clean up of that property and requested an extension. After some discussion the Board denied Ms. DeRamus's request for an extension and therefore the fine would remain in place at $3.00 per day from December 21, 2004. CASE NO. 04-154 Daisy Clark 769 E. Montrose Street Clermont, FL 34711 • LOCATION OF VIOLATION: 561 Minneola Avenue, Clermont, FL 34711. VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34- 61. Unlawful Maintenance of Nuisances. Ms. McMinamen presented the Board with pictures on January 14, 2005. Ms. McMinamen stated that she had also driven by in the morning of January 18, 2005 to see whether anything had changed. The property had remained the same. CASE NO. 04-156 Courtney R. Lewis 5202 Lazy Oak Drive Winter Park, FL 32792 LOCATION OF VIOLATION: Lot 8, Minneola Avenue, Clermont, FL 34711. VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34- 61. Unlawful Maintenance of Nuisances. There was no one present to represent this case. Ms. McMinamen stated the case • would not be heard. Case No. 04-164 -Complied on January 18, 2005. Case No. 04-165 -Complied on January 18, 2005.
