07-19-2005 Regular MeetingCITY OF CLERMONT • MINUTES CODE ENFORCEMENT BOARD July 19, 2005 The regular meeting of the Code Enforcement Board was called to order on Tuesday, July 19, 2005, at 7:00 p.m. Members attending were, Jim Purvis, A.D. VanDeMark, Terry Felder, James Davern, Bill Banzhaf, and Joe Janusiak. Also attending were Betty McMinamen, Code Enforcement Officer, John Morgeson, Jr., City Attorney, and Joy Thys, Code Enforcement Clerk. Chairman Stephen Berlinsky was absent. The minutes from the Code Enforcement Board meeting of June 21, 2005 were approved as written. Vice-Chairman Jim Purvis gave the floor to Code Enforcement Officer Betty McMinamen. Unlawful Maintenance of Nuisances. Code Enforcement Officer Betty McMinamen stated this case is complied and will not be heard. CASE NO. 05-201 Louvenia Benjamin 579 E. Broome Street Clermont, FL 34711 LOCATION OF VIOLATION: 579 E. Broome St. Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34- 61. Unlawful Maintenance of Nuisances. • Code Enforcement Officer Betty McMinamen read the violation and presented several pictures showing accumulation of multiple items around the property, including car parts and household items. Several items have been cleaned up since the first pictures on May 2"d, but the property is still in violation as shown in the pictures dated July 18tH 2005. Ms. McMinamen asked the board to find the Respondent in violation. Angelo Benjamin, son of Louvenia Benjamin, was sworn in and stated that he would need a couple of weeks to complete the clean-up of the property. Jim Purvis asked the Respondent if he was doing automotive repair work from his home and he responded said that he was not. Bill Banzhaf made a motion to find the Respondent in violation of the cited City Code; seconded by A. D. VanDeMark. The vote was unanimous for finding the Respondent in violation. Bill Banzhaf made a motion to allow the Respondent until August 16, 2005 to comply, or be fined at a rate of $2.00 per day: seconded by Terry Felder. Broome Street Clermont, FL 34711 LOCATION OF VIOLATION: 579 E. Broome Street. Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 36-C, Chapter 34, Section 34- 95. Unlawful Storage Within Residential Areas. Code Enforcement Officer Betty McMinamen read the violation and showed pictures of several cars without tags and a commercial step-van with and expired tag, among other vehicles with either missing or expired tags. Angelo Benjamin, son of Louvenia Benjamin, was sworn in and stated that he would need a couple of weeks to complete the clean-up of the property and remove or tag the vehicles in question. • Bill Banzhaf made a motion to find the Respondent in violation of the cited City Code; seconded by Joe Janusiak The vote was unanimous for finding the Respondent in violation. Bill Banzhaf made a motion to allow the Respondent until August 16 2005 to comply or be fined at the rate of $2 00 per day' seconded by Joe Janusiak. The vote was unanimous in favor of the time period and the amount of the fine. CASE NO. 05-204 Elin Satory 1000 Old England Avenue Winter Park, FL 32789 LOCATION OF VIOLATION: Lot 7 and E '/z of Lot 9, Osceola St. Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34- 61. Unlawful Maintenance of Nuisances. Ms. McMinamen asked the board to find the Respondent in violation The Respondent was not present and Ms. McMinamen showed the board the signed receipts showing she had service on this case. James Davem made a motion to find the Respondent in violation of the cited City Code; seconded by Joe Janusiak. The vote was unanimous in favor of finding the Respondent in violation. Terry Felder made a motion to allow the Respondent until August 16, 2005 to comply or be fined at the rate of $10.00 per day; seconded by Joe Janusiak. The vote was unanimous in favor of the time period and the amount of the fine. CASE NO. 05-205 • Evelio DeHoyos and Elin Satory 1000 Old England Avenue Winter Park, FL 32789 LOCATION OF VIOLATION: 765 Osceola Street, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No.232-C, Chapter 34, Section 34- 61 Unlawful Maintenance of Nuisances. Code Enforcement Officer Betty McMinamen presented several pictures showing the lot is currently overgrown with tall grass and weeds. Code Enforcement Officer Betty McMinamen presented the case showing pictures of this property being overgrown with tall grass and weeds and a large pile of debris and clippings on the right-of-way on 7t" Street. Ms. McMinamen asked the board to find the Respondent in violation The Respondent was not present and Ms. McMinamen showed the board the signed receipts showing she had service on this case. James Davern made a motion to find the Respondent in violation of the cited City Code; seconded by Joe Janusiak. The vote was unanimous in favor of finding the Respondent in violation. Code Enforcement Officer Betty McMinamen presented the case showing pictures of this property being overgrown with tall grass and weeds and a large pile of debris and clipping on the right-of-way on 7t" Street. Ms. McMinamen asked the board to find the Respondent in violation The Respondent was not present and Ms. McMinamen showed the board the signed • receipts showing she had service on this case. James Davern made a motion to find the Respondent in violation of the cited City Code; seconded by Bill Banzhaf. Unlawful Maintenance of Nuisances. Code Enforcement Office Betty McMinamen showed pictures of the premises being overgrown with tall grass and weeds and including dead or dying trees. Ms. McMinamen asked the board to find the Respondent in violation The Respondent was not present and Ms. McMinamen showed the board the signed receipts showing she had service on this case. James Davern made a motion to find the Respondent in violation of the cited City Code; seconded by Joe Janusiak. The vote was unanimous in favor of finding the Respondent in violation. Terry Felder made a motion to allow the Respondent until August 16, 2005 to comply or be fined at the rate of $10.00 per day seconded by Joe Janusiak. The vote was unanimous in favor of the time period and the amount of the fine. • OTHER BUSINESS Stephen Berlinsky arrived and had two motions that he wanted to present. The first motion was he felt the City of Clermont should try to recover the cost the administrative costs of each Code Enforcement case. The board felt Stephen Berlinsky should meet with the City Manager, Wayne Saunders to discuss this issue; the motion was seconded by A. D. VanDeMark. The vote was unanimous in favor of asking Stephen Berlinsky speak to the City Manager. The second motion by Stephen Berlinsky was he felt the names and addresses of the Respondents be published on the City of Clermont website.
