10-17-2006 Regular MeetingCITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD October 17, 2006 The regular meeting of the Code Enforcement Board was called to order on Tuesday, October 17, 2006 at 7:00 p.m. Members attending were James Purvis, Chairman, A.D. VanDeMark, Terry Felder, James Davern, Bill Gray and Les Booker. Also attending were Betty McMinamen, Code Enforcement Officer, Yvette Brown, City Attorney, and Joy Thys, Code Enforcement Clerk. Joe Janusiak was absent. The Pledge of Allegiance was recited. A moment of silence was observed for Lake County Sheriff Chris Daniels who passed away on October 14, 2006. Chairman Jim Purvis read the Opening Remarks. The minutes from the Code Enforcement Board meetings of September 19, 2006 were approved. Code Enforcement Officer Betty McMinamen and everyone testifying were sworn in. Jim Purvis gave the floor to Code Enforcement Officer Betty McMinamen. NEW BUSINESS CASE N0.06-307 Heriberto Bermudez 14907 Day Lily Court Orlando, FL 32824 LOCATION OF VIOLATION: 754 E. Desoto Street, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14- 76 (3). Minimum Housing Standards. Ch. 3, 301-307.6. Code Enforcement Officer Betty McMinamen showed several pictures of the Respondent's property showing violations that included, but were not limited to: exterior doors in disrepair that are not weatherproof or rodent proof, missing or bent window ~J • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD October 17, 2006 screens, uneven roof-line over two apartments that now have water-stained ceilings, and at least one air conditioner leaking water and leaving the carpet wet and smelling of mold. Ms. McMinamen said a large amount of work has been done on this property but there is still quite a lot left to be done. Ms. McMinamen asked the Respondent be found in violation of the cited city code. Heriberto Bermundz, 14907 Day Lily Court, Orlando, FI 32824, was sworn in and stated he has completed a lot of work on the property and would like additional time in order to complete the repairs and clean-up. He stated there were tenants in one of his units that he had to obtain a court order in order to remove them. The Respondent said this eviction slowed his repair progress. The Respondent purchased the property just six months ago and he is asking for three months in order to bring his property into compliance. A. D. VanDeMark made a motion to find the Respondent in violation of the cited City code seconded by Bill Gray. The vote was unanimous in favor of finding the Respondent in violation. • Les Booker moved to allow the Respondent until November 21, 2006 to comply or be fined at the rate of $10.00 per day; seconded by A. D. VanDeMark. The vote was unanimous for the time period and fhe amount of the tine. CASE NO. 06-308 Heriberto Bermudez 14907 Day Lily Court Orlando, FL 32824 LOCATION OF VIOLATION: 754 E. Desoto Street, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34- 61. Unlawful Maintenance of Nuisances. Code Enforcement Officer Betty McMinamen showed pictures of the Respondents property that showed violations that included but were not limited to: a discarded stove and refrigerator with separate doors and drawers in plain view of the street, gas cans, broken bicycles, buckets, coolers, a puppy kennel, high grass and weeds, etc. Ms McMinamen asked the Respondent be found in violation of the cited city code. • 2 • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD October 17, 2006 Heriberto Bermundz, 14907 Day Lily Court, Orlando, FI 32824, was sworn in and requested thirty days in order to bring his property into compliance. James Davem made a motion to find the Respondent in violation of the cited City code; seconded by Teny Felder. The vote was unanimous in favor of finding the Respondent in violation. Bill Gray moved to allow the Respondent until November 21. 2006 to comply or be fined at the rate of $10.00 per day; seconded by A. D. VanDeMark. The vote was unanimous for the time period and the amount of the fine. OLD BUSINESS CASE NO. 06-290 • John & Linda Korzeniowski 8531 Doral Drive Clermont, FL 34711 LOCATION OF VIOLATION: 640 E. Juniata Street, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14- 76 (12). Unsafe Building Due To Incomplete Renovation. Code Enforcement Officer Betty McMinamen stated this case complied and wi{I not be heard. CASE NO. 04-142 Lyndon & Gillian Alleyne P. O. Box 121438 Clermont, FL 34712 LOCATION OF VIOLATION: 611 Scott Street, Clermont, FL 34711 • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD October 17, 2006 VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14- 76 (12). Standard Unsafe Building Abatement. Ms. McMinamen stated this was a case from December, 2004. There was a house located on this property that had extensive damage caused by abandonment and inadequate maintenance. The property was purchased by the Respondent in June of 2006 and the lien of $7,905.00 was paid in full upon the closing of the property. The lien under the new owner started in June of 2006 and the respondent brought the property into compliance on September 28, 2006 by demolishing the home that was located on the property. The fine now stands as $1,770.00 and Ms. McMinamen asked the current lien be forwarded to the City Council for forgiveness. A. D. VanDeMark made motion to recommend the lien be forwarded to City Council for forgiveness; seconded by Tenn Felder. The vote was unanimous in favor of recommending forgiveness of the lien. Wiggins Attorney Leigh Tucker was present on behalf of the Hillside Terrace Condominium Owners Association. Ms. Tucker stated since the last Code Enforcement Board meeting, she has met with Tamara Richardson and Cheryl Canada of the City of Clermont's Engineering Department. Cheryl Canada accompanied Ms. Tucker to the • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD October 17, 2006 property to do a site evaluation and during the site evaluation, a broken sewer pipe was found on the complainants' property and that issue would also need to be dealt with. Ms. Tucker also stated the three inch asphalt berm that was installed over a year ago in order to reroute the storm water run-off, has concentrated the path of the water. Ms. Tucker feels the tearing down of the berm and the installation of a "speed bump" to help divert more of the storm water run-off into the lake would be a solution to the problem. She stated she would like a continuance on this case until the January 16, 2007. Code Enforcement Board Meeting. A. D. VanDeMark made a motion to continue this case until January 76, 2007; seconded by Les Booker. The vote was unanimous in favor of the continuance.
