CODE ENFORCEMENT BOARD
January 16, 2007
The regular meeting of the Code Enforcement Board was called to order on Tuesday,
January 16, 2007 at 7:00 p.m. Members attending were James Purvis, Chairman, A.D.
VanDeMark, Terry Felder, Joe Janusiak, James Davern, Bill Gray and Les Booker. Also
attending were Betty McMinamen, Code Enforcement Officer, Yvette Brown, City
Attorney, and Joy Thys, Code Enforcement Clerk.
The P{edge of Allegiance was recited.
Code Enforcement Chairman Jim Purvis read the Opening Remarks.
The minutes from the Code Enforcement Board meetings of November 21, 2006 were
approved.
Code Enforcement Officer Betty McMinamen and everyone testifying were sworn in.

VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 122, Section
122-344 (a). Building Permit Required.
Code Enforcement Officer Betty McMinamen displayed pictures of the Respondent's
bowling alley that showed the addition of a wooden deck that was built on a parking
space outside the North exit of the building. The wooden deck was completed without
first obtaining the required building permit(s) necessary to modify the existing property.
Compliance will be when a Zoning Clearance is obtained from the City of Clermont of
Clermont Planning and Zoning Department and the building permit(s) have been
obtained from the Lake County Department of Growth Management Building Services

Division. Code Enforcement Officer Betty McMinamen asked the Respondent be found
in violation, but be given enough time in order to comply.
The respondent did not appear.
James Hitt, Planning and Zoning Director, was sworn in and stated the Respondent's
have been cooperating with the City of Clermont in order to provide an additional
parking spot that was used in the building of the deck.
James Davem made a motion to find the Respondent in violation of the cited City code;
seconded by Joe Janusiak. The vote was unanimous in favor of finding the Respondent
in violation.
James Davern moved to allow the Respondent until February 20, 2007 to comply or be
fined at the rate of $20.00 per day: seconded by Joe Janusiak. The vote was
unanimous for the time period and the amount of the fine.

VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 86, Section 146
(b). Failure to Fulfill Obligations of Conditional Use Permit Agreed to on April 11, 1989.
Code Enforcement Officer Betty McMinamen showed pictures of the Respondent's
property that is in violation of several sections of the Conditional Use Permit that was
issued to the Respondent on April 11, 1989. Mr. Jones appeared before the Code
Enforcement Board on June 20, 2006 and at that time, gave Mr. Jones until January 16,
2007 in order to bring his property into compliance. The Code Enforcement Board
asked Mr. Jones to submit a quarterly report as to his progress. A written progress
report was submitted and reviewed by the Code Enforcement Board in

September of 2006. Ms. McMinamen asked the Board to allow the fine to start tonight
on January 16, 2007 at midnight. Ms. McMinamen stated the Respondent would be
allowed to come back at a later time and ask forgiveness for the fine.
Mr. Fred Morrison, of Leesburg, attorney for Mr. Gerald Jones, stated his client has tried
to comply with the conditions of the Conditional Use Permit by meeting with an engineer
in order to obtain a site plan. A site plan was submitted to the City of Clermont in June
of 2006 at which time the City of Clermont stated Mr. Jones needed to file for two
variances which they started. Mr. Morrison said the city then informed him and his client
that a Comprehensive Plan would also need to be filed along with a rezoning of the
Respondents property. The Respondent filed for the Comprehensive Plan in August of
2006. Mr. Morrison said the Comprehensive Plan was not scheduled to be heard until
March of 2007 and asked that his client be given until April 2007 in order to see if the
Comprehensive plan was passed.
Mr. James Hitt, Planning and Zoning Director, was sworn in and stated the staff is
currently working on the staff report for the Comprehensive Plan.
• Chairman Jim Purvis asked Code Enforcement Officer Betty McMinamen to show
pictures of the Respondent's property that was taken over several years. Upon
examination of the pictures, it was noted that very little improvement has been made
over a wide span of time. Ms. McMinamen then read the violations and Mr. Hitt showed
the original Conditional Use Permit that was signed by Mr. Jones in April of 1989.
A. D. VanDeMark made a motion to deny the request for an extension of 3 months
seconded by Bill Gray. The vote was unanimous in favor of denying the 3 month
extension. The fine of $20.00 a day will begin at midnight

Code Enforcement Officer Betty McMinamen stated this Respondent was not present
and the case would not be heard.
There being no further business, the meeting was adjourned.
