02-20-2007 Regular MeetingCITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD February 20, 2007 The regular meeting of the Code Enforcement Board was called to order on Tuesday, February 20, 2007 at 7:00 p.m. Members attending were James Purvis, Chairman, A. D. VanDeMark, Terry Felder, Joe Janusiak, James Davern, Bill Gray and Les Booker. Also attending were Betty McMinamen, Code Enforcement Officer, Yvette Brown, City Attorney, and Joy Thys, Code Enforcement Clerk. The Pledge of Allegiance was recited. Code Enforcement Chairman Jim Purvis read the Opening Remarks. The minutes from the Code Enforcement Board meetings of January 16, 2007 were approved. James Purvis was re-elected Chairman and A. D. VanDeMark was re-elected Vice- Chairman of the Code Enforcement Board. Code Enforcement Officer Betty McMinamen and everyone testifying were sworn in. Jim Purvis gave the floor to Code Enforcement Officer Betty McMinamen. NEW BUSINESS CASE NO. 07-320 Prakai & Vannee B. Pachiratana 15456 Margaux Drive Clermont, FL 34711 LOCATION OF VIOLATION: 158 W. Highway 50, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 122, Section 122-344 (a). Building Permit Required. Code Enforcement Officer Betty McMinamen displayed pictures of the Respondent's restaurant that showed the interior renovations in progress that were started by the Respondent's tenant without a proper permit. Compliance will be when the Zoning • Clearance is obtained from the City of Clermont Planning and Zoning Department and CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD February 20, 2007 the Building Permit(s) have been obtained from the Lake County Department of Growth Management. Ms. McMinamen asked that the Respondent's be found in violation of the cited city code. Mr. Joseph Shoemaker, attorney for the Respondent's, stated his clients leased out their restaurant several years ago to a Mr. and Mrs. Adalar. This was along-term lease between the Respondent's and the Adalar's that will expire on December 1, 2007. At some point during the lease, the Adalar's sub-let the restaurant to a person by the name of Sunshine Blackburn. This sub-lease was done without the written consent of the Respondent's, which was a clause in the original lease agreement between the Respondent and the Adalar's. There is a legal suit pending between the Respondent and the other parties in order for the Respondent to gain back control of the restaurant. Mr. Shoemaker requested six months in order to finalize the pending lawsuit and rectify the outstanding violations. James Davem made a motion to find the. Respondent in violation of the cited City code: seconded by A. D. VanDeMark. The vote was unanimous in favor of finding the • Respondent in violation. James Davem moved to allow the Respondent until August 21. 2007 to comply with a written report to be given to the Code Enforcement Board on May 15. 2007, or be fined at the rate of $20.00 per day: seconded by A. D. VanDeMark. The vote was unanimous for the time period and the amount of the fine. OLD BUSINESS CASE N0.06-310 & 06-311 Vivienne F. Henry 958 Bloomington Court Ocoee, FL 34761 LOCATION OF VIOLATION: 677 W. Highway 50, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14- 76 (12). Unsafe Building Due to Fire & Deterioration & Ordinance No. 281-C, Chapter 122, Section 122-344 (a). Building Permit Required. • 2 • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD February 20, 2007 Code Enforcement Officer Betty McMinamen showed pictures of the Respondent's property where a fire occurred in March of 2006. These cases were originally heard before the Code Enforcement Board on November 21, 2006 and were found in violation at that time. The interior of the main building was destroyed by the fire and there was a storage building on the premises that had been turned into a beauty salon without first obtaining the proper permits. A fine of $10.00 a day each is due to start at Midnight on this date and the Respondent is present to ask for more time in order to bring her property into compliance. Mr. Ron Kalish, the contractor for the Respondent, was sworn in and updated the Board on the progress that was being made in order to bring this property into compliance. Mr. Kalish applied for the building permit in September 2006 to Lake County Department of Growth Management and is still in the process of working with the Lake County Building Department in order to answer all comments that are required in order to obtain the building permits. Mr. Kalish stated the storage building that was converted into a beauty • salon will now be demolished on the inside and once again be used as a storage building. Mr. Kalish requested more time in order to obtain the permits and start the work on the property. James Davem made a motion to extent the compliance date to August 21, 2007, with a written progress report to be given to the Code Enforcement Board on May 75, 2007; seconded by A. D. VanDeMark.
