03-20-2007 Regular MeetingCITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD • MARCH 20, 2007 The regular meeting of the Code Enforcement Board was called to order on Tuesday, March 20, 2007 at 7:00 p.m. Members attending were James Purvis, Chairman, A.D. VanDeMark, Terry Felder, Joe Janusiak, James Davern, William Gray and Les Booker. Also attending were Betty McMinamen, Code Enforcement Officer Betty McMinamen, Yvette Brown, City Attorney, James Hitt, Planning and Zoning Director, and Joy Thys, Code Enforcement Clerk. The Pledge of Allegiance was recited. Code Enforcement Chairman Jim Purvis read the Opening Remarks. The minutes from the Code Enforcement Board meetings of February 20, 2007 were approved as written. Code Enforcement Officer Betty McMinamen and everyone testifying were sworn in. Jim Purvis gave the floor to Code Enforcement Officer Betty McMinamen. NEW BUSINESS • CASE NO. 07-323 S. W. Williams, LLC 901 12tH Street Clermont, FL 34711 LOCATION OF VIOLATION: 901 12tH Street, Clermont, FL 34711 VIOLATION: Ordinance No. 232-C, Chapter 34, Section 34-61. Unlawful Maintenance of Nuisances. Code Enforcement Officer Betty McMinnamen was sworn in and stated the Respondent's property, also known as Exceltech at the corner of Highway 50 and 12tH Street, was in violation due to but not limited to the property being littered inside the chain-link fence with broken pallets, pieces of metal and wood, buckets, barrels, plastic tubs, a broken roll-off-container, concrete blocks, pieces of ripped plastic, used tires, scattered trash and littler, high grass and weeds, holes in exterior of building, etc. Compliance will be when the premises have been repaired and secured and cleared of all the above mentioned items. Ms. McMinamen stated she would like the Respondent found in violation of the cited city code. • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD • MARCH 20, 2007 Mr. Dave Williams of 901 12tH Street, Clermont, FL 34711, was sworn in and passed out a checklist which showed what he felt had already been corrected by them. Mr. Williams said he and his employees have spent more than sixty man hours trying to bring this property into compliance. Mr. Williams also noted that there are currently three companies working out of this location with over one hundred employees, the leases for these tenants will not be renewed and the building is set to the sold and torn down within the next two years. Mr. Williams admitted they could do a better job in keeping the grass and weeds trimmed, but that some of the locations where the grass was growing is hard to reach. Mr. David McKay of 901 12t" Street, Clermont, FL 34711 was sworn in and stated they also have problems with local residents dumping furniture, trash and beer bottles onto their property. Code Enforcement Board member Terry Felder stated the location is an eyesore for the community and she feels the property should be brought into compliance as soon as possible. James Davern made a motion to find the Respondent in violation of the cited City code: seconded by Les Booker. The vote was unanimous in finding the Respondent in • violation. James Davern moved to allow the Respondent until April 77, 2007 to comply, or be fined at the rate of $50.00 per day: seconded by Joe Janusiak. The vote was unanimous for the time period and the amount of the fine. CASE NO. 07-325 S. W. Williams, LLC 901 12tH Street Clermont, FL 34711 LOCATION OF VIOLATION: 901 12tH Street, Clermont, FL 34711 VIOLATION: Ordinance No. 281-C, Chapter 122, Section 122-263 (c). Outdoor Uses Must Be Screen From View. Code Enforcement Officer Betty McMinnamen was sworn in and stated the Respondent's property also know as Exceltech at the corner of Highway 50 and 12tH Street was in violation due to the outside storage of trucks, eighteen wheel trailers and flat-beds with and without tractors attached, a tall crane, several storage tanks in assorted sizes, fork-lifts, stacks of lumber, shipping containers, dumpsters, etc. • Compliance will be when all commercial uses, storage, and the like have been completely screened from all public streets and adjacent properties, placed in an 2 CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD • MARCH 20, 2007 enclosed building, or entirely removed from the property. Ms. McMinamen stated she would like the Respondent found in violation of the cited city code. Mr. Dave Williams and Mr. David McKay of 901 12th Street, Clermont, FL 34711 were sworn in and stated the outside storage is extremely better now than in previous years. Since September 11, 2001, the dynamics of the business has changed and they have much less outside activity and storage as they did in the past. The Respondent's said they are starting to lower the booms on all the cranes at the end of each work day in order to enhance their properly. There was much discussion among the Code Enforcement Board members as to the definition of "screening". Mr. James Hitt, Planning and Zoning Director, was sworn in and tried to clarify the definition of "screening" for the Board Members. James Davem made a motion to find the Respondent in violation of the cited City code,- seconded byJoe Janusiak The vote was 6 to 1 in favor of finding the Respondent in violation with William Gray opposing. James Davem moved to allow the Respondent until June 19, 2007 to comply, or be fined at the rate of $50 00 per day- seconded by Joe Janusiak. The vote was 6 to 1 in favor of finding the Respondent in violation with William Gray opposing. A "CURRENT LIEN STATUS" report and a Code Enforcement Board calendar were handed out to each board member. There being no further business, the meeting was adjourned.
