CODE ENFORCEMENT BOARD
February 17, 2004
The regular meeting of the Code Enforcement Board was called to order on Tuesday,
February 17, 2004 at 7:00 p.m. Members attending were Joe Janusiak, Alvin Schein,
Paul Lienard, Peter Geigel and Stephen Berlinsky. Sharon Martin was absent. Also
attending were Betty McMinamen, Code Enforcement Officer, Robert Guthrie, City
Attorney and Jane C. McAllister, Code Enforcement Clerk.
The minutes from the Code Enforcement Board meeting of December 16, 2003 were
approved as written.
Chairman Paul Lienard gave the floor to Code Enforcement Officer Betty McMinamen.
Code Enforcement Officer Betty McMinamen announced that there were two new
members of the Board and introduced Stephen Berlinsky and Peter Geigel. Both Mr.
Berlinsky and Mr. Geigel told those present a little about themselves and their
backgrounds.
City Attorney Robert Guthrie announced that it was time to elect a new Chairman and
Vice Chairman for the year 2004.
Paul Lienard was unanimously re-elected as Chairman.
Alvin Schein was unanimously elected Vice Chairman.
City Attorney Robert Guthrie announced that there would be a meeting in the Chambers
on Feb. 26, 2004 from 6:00 p.m. to 9:00 p.m. regarding the Florida Sunshine Law and
quasi judicial proceedings. Mr. Guthrie encouraged the Board Members to attend.

Code Enforcement Office Betty McMinamen advised those present that Ms. Hinton, et
al are requesting another extension of the lien start date.
James Johnson, 8619 Valley Ridge Court, Orlando, FL. 32818, and Christina Clark,
12928 Lakeview Avenue, Clermont, FL. were sworn in.
Christina Clark proceeded to tell the Board that she is a realtor who works for Mickey
Blackburn and that she is trying to sell off all the property that is involved with the
estate. She said the family is having a hard time because the properties are
continuously being vandalized.
James Johnson asked for an additional ninety (90) days before the lien would start.
Stephen Berlinsky made a motion to reduce the fine from $200.00 per week to $50.00
per week and to extend the lien start date to May 20, 2004. Peter Geigel seconded the
motion. The vote was unanimous in favor of the motion.

VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14-
76 (3). Minimum Housing Standards.
Betty McMinamen stated that this case started in October of 2002 and that distinct
improvements have been made to the property, but that it is still not in compliance.
She stated that the fine was scheduled to start on December 17, 2003 at $150.00 per
day.
James Johnson asked for and additional ninety (90) days before the lien starts.

Stephen Berlinsky made a motion to forgive the lien that was supposed to start on
December 17, 2003, to extend the lien start date to Mav 20, 2004 and to reduce the fine
from $950.00 per day to $100.00 per week. Alvin Schein seconded the motion. The vote
was unanimous in favor of the motion.

VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14-
76(3). Minimum Housing Standards.
• Janice Jones Smith was sworn in and stated that this property was part of the same
estate as the previous two cases and that they were trying to sell the property. Ms.
Smith asked for a ninety (90) day extension of the lien start date.
Stephen Berlinsky made a motion to extend fhe lien start dafe to Mav 20, 2004. Alvin
Schein seconded the motion. The vote was unanimous in favor of the motion.
CASE NO. 03-36

LOCATION OF VIOLATION: 614 Grand Highway, Clermont, FL
VIOLATION: City of Clermont Code of Ordinances No. 281-C, Chapter 22, Section
122-349(a)(d). Home Occupation as Accessory to Residence.
Code Enforcement Officer Betty McMinamen told the Board that Ms. Johnson has been
using a residential unit at the Hillside Villas exclusively as an office.
Julia Johnson, 670 Grand Highway, Clermont, FL 34711 was sworn in and requested
• an extension of the lien start date. She asked for an additional year.

Peter Geigel made a motion to extend the lien start date to May 20, 2004. Stephen
Berlinsky seconded the motion. The vofe was unanimous in favor of extending the lien
start date to May 20, 2004.
CASE NO. 03-64

VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14-

• Code Enforcement Officer Betty McMinamen advised the Board that she had a letter
from Ms. Risher requesting and additional sixty (60) day extension of the lien start date.
She said that Ms. Risher informed her they would be closing on the property at the end
of March.
Alvin Schein made a motion to extend the lien start date to April 20, 2004. Joe Janusiak
seconded the motion. The vote was unanimous for allowing the extension.

Stephen Berlinsky made a motion to extend the lien sfart date to April 20, 2004. Alvin
Schein seconded the motion. The vote was unanimous for allowing fhe extension.

The request was denied. The fine went into effect on November 18, 2003.
CASE NO. 03-96 was not heard as compliance was attained
There being no further business, the meeting was adjourned.
