04-20-2004 Regular Meeting• CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD April 20, 2004 The regular meeting of the Code Enforcement Board was called to order on Tuesday, April 20, 2004 at 7:00 p.m. Members attending were Joe Janusiak, Alvin Schein, Paul Lienard, Peter Geigel and Stephen Berlinsky. Sharon Martin was absent. Also attending were Betty McMinamen, Code Enforcement Officer, Robert Guthrie, City Attorney and Jane C. McAllister, Code Enforcement Clerk. The minutes from the Code Enforcement Board meeting of February 17, 2003 were approved as written. Chairman Paul Lienard gave the floor to Code Enforcement Officer Betty McMinamen. NEW BUSINESS CASE NO. 04-123 Bradley S & Kelli R. Pinkerton 1144 Linden Street • Clermont, FL 34711 LOCATION OF VIOLATION: 1144 Linden Street, Clermont, FL 34711 VIOLATION: City of Clermont Code of Ordinances No. 318-C, Chapter 10, Section 10- 27. More Than Five (5) Animals on Property. Donna Howard, Animal Control Officer stated that the respondent is keeping seven (7) dogs on the premises when only five (5) are allowed. She further stated that the respondent has been made aware of the violation and has taken no steps to correct the situation by either getting rid of two of the dogs or by requesting a Conditional Use Permit to allow the dogs to remain. The respondent was not present. Alvin Schein made a motion to find the Respondent in violation of the cited City Code Joe Janusiak seconded the motion. The vote was unanimous for finding the Respondent in violation. Alvin Schein made a motion to allow the Respondent until June 75 2004 to comply or be fined at the rate of $200.00 per week. Unsafe Building Due to Lack of Maintenance. VIOLATION CASE NO. 04-100: Clermont Code of Ordinances No. 232-C, Chapter 34, Section 34-61. • Unlawful Maintenance of Nuisances. Code Enforcement Officer Betty McMinamen stated the violations on the property and indicated that there has been no improvement in the conditions since the original violation notices went to the representative. She stated that the representative lives in another state and that this and the next six cases are part of an estate that is being settled by selling all of the properties. Tiki Jackson, 284 Catherine Street, Groveland, FL was sworn in and stated that she is a real estate agent and is representing both the buyer and the seller of these properties. She stated that the buyer is aware of the problems and is willing to rehab the properties, but needs to be granted some additional time in order to accomplish that. Ms. Jackson stated that the closing on all of these properties was going to take place on April 22nd or April 23rd, 2004. In the matter of Case No. 04-99 Alvin Schein made a motion to find the Respondent in violation of the cited Citv Code. Joe Janusiak seconded the motion. In the matter of Case No. 04-101 Alvin Schein made a motion to end the Respondent in violation of the cited City Code. Joe Janusiak seconded the motion. The vote was unanimous for finding the Respondent in violation. Alvin Schein made a motion to allow the Respondent until June 15, 2004 to compl~or be fined at the rate of $150.00 per week. VIOLATION CASE NO. 04-105: City of Clermont Code of Ordinances No. 36-C, Chapter 34, Section 34-95. Unlawful Storage In Residential Areas. In the matter of Case No. 04-103 Alvin Schein made a motion to find the Respondent in violation of the cited City Code. Joe Janusiak seconded the motion. The vote was unanimous for finding the Respondent in violation. Alvin Schein made a motion to allow the Respondent until June 15 2004 to comply or be fined at the rate of $150.00 per week. Code Enforcement Officer Betty McMinamen asked the Board to hear one item from OLD BUSINESS since it was also associated with this respondent. CASE NO.03-64 • Reuben Jamison c/o Shirley Rlsher 201 Gadsden Loop Walterboro, SC 29488 LOCATION OF VIOLATION: 790 E. Juniata St., Clermont, FL 34711 Tiki Jackson who spoke earlier in reference to the new cases involving this respondent asked that the Board extend the lien start date as this property is also included in the pending sale. Alvin Schein made a motion to extend the lien start date to June 15. 2004. Stephen Berlinsky suggested the lien start on May 18, 2004. Alvin Schein did not amend the motion. Joe Janusiak seconded the motion. VIOLATION: City of Clermont Code of Ordinances 232-C, Chapter 34, Section 34-61. Unlawful Maintenance of Nuisances. Code Enforcement Officer Betty McMinamen read the violation. There was no one present to represent the Respondent. • Alvin Schein made a motion to find fhe Respondent in violation of the cited City Code. Joe Janusiak seconded the motion. CASE NO. 04-119 CASE NO. 04-120 CASE NO. 04-121 William Monath and Joe Pozo 953 Tenth Street Clermont, FL 34711 Code Enforcement Officer Betty McMinamen read the violations and explained to the Board that all three cases were in the process of reaching compliance. She stated that there are items coming before the City Council at a meeting scheduled for April 27, 2004. If the respondents requests are granted by the City Council he will no longer be in violation. Ms. McMinamen asked for time for the respondent to comply. • • CITY OF CLERMONT MINUTES CODE ENFORCEMENT BOARD April 20, 2004 Page -7- William Monath, 387 Seminole Street, Clermont, FL 34711, of Seabreeze Construction was sworn in and stated that he is in the process of taking care of all the problems associated with this property. He asked for additional time without being assessed a fine. Alvin Schein announced that he has business dealings with Mr. Monath and Seabreeze Construction because he is on the Board of Directors of Summit Greens Homeowners Association, and asked to be excused from the discussion and the voting on this item. For some unknown reason Mr. Monath took this as a personal assault and proceeded to go into a tangent of yelling and screaming so threatening that the Code Enforcement Officer took out her cell phone to call the police. At the urging of Board Members and his wife Mr. Monath finally calmed down. In the matter of Case No. 04-119 Stephen Berlinskv made a motion to find the Respondent in violation of the cited City Code. Peter Geigel seconded the motion. The • vote was unanimous for finding the Respondent in violation. Stephen Berlinskv made a motion to allow the Respondent until August 17, 2004 to comply or be fined at the rate of $100.00 per week. Joe Janusiak seconded the motion. The vote was unanimous for the fine and the time limit. Code Enforcement Officer Betty McMinamen announced that she did not have service on the next two items on the agenda CASE NO. 04-116 AND CASE NO. 04-117 and so they would not be heard.
