CODE ENFORCEMENT BOARD
September 16, 2003
The regular meeting of the Code Enforcement Board was called to order on Tuesday,
September 16, 2003, at 7:00 p.m. Members attending were Joe Janusiak, David
Outlaw, Sharon Martin, Alvin Schein and Vern Schneider. Paul Lienard was absent.
Also attending were Betty McMinamen, Code Enforcement Officer, Robert Guthrie, City
Attorney and Jane C. McAllister, Code Enforcement Clerk.
The minutes from the Code Enforcement Board meeting of August 19, 2003 were
approved as written.
Vice Chairman David Outlaw gave the floor to Code Enforcement Officer Betty
McMinamen.
Code Enforcement Officer Betty McMinamen announced that the first item on the
agenda under Old Business -Continuance Case No. 03-31 and under New Business
Case No. 03-67, Case No. 03-68 and Case No. 03-72 have complied and would not be
heard.

Unlawful Maintenance of Nuisances.
Code Enforcement Officer Betty McMinamen read the violations and showed photos
showing that compliance has not been met. She asked the Board to find the
Respondent in violation of the cited City Code.
• David Outlaw asked if the Respondent was present and would like to speak. No one
was present to represent the Respondent.

Alvin Schein made a motion to find the Respondent in violation of the cited City Code.
Joe Janusiak seconded the motion. The vofe was unanimous for finding the
Respondent in violation.
Alvin Schein made a motion to allow the Respondent until November 18, 2003 to
comply or be fined at the rate of $250.00 per week until compliance is met .Joe
Janusiak seconded the motion. The vote was unanimous in favor of the time limit and
the fine.
CASE NO. 03-71
Alvin Schein made a motion to frnd the Respondent in violation of the cited Cify Code.
Joe Janusiak seconded the motion. The vote was unanimous for finding the
Respondent in violation.
Alvin Schein made a motion to allow the Respondent until November 18, 2003 to
• comply or be fined at the rate of $250.00 per week until compliance is met. Joe
Janusian seconded the motion. The vote was unanimous in favor of the time limit and
the Erne.

LOCATION OF VIOLATION: 792 E. Montrose St., Clermont, FL.
VIOLATION:
03-76 City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14-76 (12).
Unsafe Building Due To Lack Of Maintenance.
Code Enforcement Officer Betty McMinamen read the violations and presented photos
showing that compliance has not been met.
David Outlaw asked if the Respondent was present.

Pastor Daryl Forehand, 1406 N. Carver Ave., Lakeland, FL 33805 was sworn in and
said that he is doing everything that can be done to improve the property. He informed
the Board that the church is going through the Conditional Use Permit process and
would begin renovations as soon as possible if it is approved by the City Council on
September 23, 2003. Pastor Forehand asked for additional time to allow for the process
of the CUP and permitting.
Sharon Martin made a motion to find the Respondent in violation of the cited City Code.
Alvin Schein seconded the motion. The vote was unanimous for finding the Respondent
in violation.
Sharon Martin made a motion to allow the Respondent until December 76 2003 to
comply or be fined at the rate of $200.00 per month until compliance is met. Joe
Janusiak seconded the motion. The vote was unanimous in favor of the time limit and
the fine.

Code Enforcement Officer Betty McMinamen read the violations and presented photos
showing that compliance has not been met. Ms. McMinamen also added that this
building is extremely unsafe and could come down at any time.
Reverend Forehand agreed with Betty McMinamen and stated the building will be
removed as soon as possible. He indicated that he has already been in touch with a
demolition company.
Alvin Schein made a motion to find the Respondent in violation of the cited City Code

Respondent in violation.

Minimum Housing Standards.
James Johnson, 8619 Valley Ridge Court, Orlando, FL 32818 was sworn in and
explained to the Board that the family has had a large amount of repairs and cleaning
up to do on several properties around town. Mr. Johnson asked the Board for an
• extension of the lien start date of six months.
Alvin Schein made a motion to extend the lien start date to December 16. 2003. Joe
Janusiak seconded the motion. The vote was unanimous in favor of the motion.

most of the work had been done but that he needs an additional week to finish and be in
compliance.
Vern Schneider made a motion to extend the lien start date to September 24, 2003. Joe
Janusiak seconded the motion. The vote was unanimous in favor of the extension.

VIOLATION:
City of Clermont Code or Ordinances No. 249-C, Chapter 14, Section 14-76(3).
Minimum Housing Standards.
Code Enforcement Officer Betty McMinamen informed the Board that the fine on the
above case now totals $2,071.43. This has accrued since July when the fine went into
effect. Ms. McMinamen informed the Board that this property came into compliance on
September 12, 2003.
Albert E. Dean, 4505 San Sebastian Circle, Orlando, FL 32808, was sworn in and said
that the reason he wasn't in compliance before the fine started was because he has to
take care of his wife who is ill and that he was also delayed by rainy weather. He asked
the Board to show leniency and to reduce the fine.
Joe Janusiak made a motion to lower the fine to one half of what is due $1.035.43.
There was no second to the motion.
Alvin Schein made a motion to adjust the fine to $250.00. Sharon Martin seconded the
• Motion. The vote was 4-1 in favor of the motion with Joe Janusiak voting nay.

LOCATION OF VIOLATION: 1042 School Street, Clermont, FL 34711
VIOLATION:
City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14-76(12).
Existing Unsafe Building Due To Fire Damage.
Code Enforcement Officer Betty McMinamen told the Board that she has exhausted
every means available to locate all of the heirs of the estate, and that those she has
been able to contact wish to have the house demolished but can not afford to have it
done themselves. Ms. McMinamen asked the Board for an Order to Demolish.
Joe Janusiak made a motion to Order the Demolition of 1042 School Street, Clermont,
FL. Alvin Schein seconded the motion.
City Attorney Robert Guthrie wanted the record to reflect the fact that all efforts have
been made to get the permission to demolish this structure from the children and
grandchildren of the deceased owner of record.
The vote was unanimous in favor of the motion.
Wilmer Pace the Respondent in a case heard earlier was late for the meeting and asked
to be heard.
Sharon Martin made a motion fo reopen Case No. 03-70 and Case No. 03-71. Vern
Schneider seconded the motion. The vote was unanimous to reopen fhe cases so Mr.
Pace could be heard.
Wilmer Pace, 580 E. Highland Avenue was sworn in and said he wanted to know that
the Board wanted.
Code Enforcement Officer Betty McMinamen reread the case for Mr. Paces benefit and
told him of the Boards decision.

Mr. Pace told the board that his property was all cleaned up except for a vehicle that
'needs to be repaired and another vehicle that he needs as well.
Betty McMinamen showed photos indicating that Mr. Pace was not in compliance. She
asked Mr. Pace to call her and that she would work with him and help him understand
what he needs to do so that he can comply with code.
There being no further business, the meeting was adjourned.
