MINUTES
CODE ENFORCEMENT BOARD
December 16, 2003
The regular meeting of the Code Enforcement Board was called to order on Tuesday,
December 16, 2003, at 7:00 p.m. Members attending were Joe Janusiak, Alvin Schein,
Vern Schneider, Paul Lienard and David Outlaw. Sharon Martin was absent. Also
attending were Betty McMinamen, Code Enforcement Officer, Robert Guthrie, City
Attorney and Jane C. McAllister, Code Enforcement Clerk.
The minutes from the Code Enforcement Board meeting of November 18, 2003 were
approved as written.
Chairman Paul Lienard gave the floor to Code Enforcement Officer Betty McMinamen.
Betty McMinamen announced that since the Respondent was not present CASE NO.
02-43 and CASE NO. 03-08 would not be heard.
OLD BUSINESS
CASE NO. 03-61
Thomas Smail

LOCATION OF VIOLATION: 991 Montrose Street., Clermont, FL. 34711
VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 14-
76 (3).
Minimum Housing Standards.
Thomas Smail, 500 Shady Nook Lane, Clermont, FL., and David Smail 1050 Michigan
Avenue, Groveland, FL 34736 were sworn in.
Thomas Smail stated that he has sold the property in question to his brother David
Smail.
David Smail said he closed on the house on December 11, 2003, and asked if the lien
could be forgiven. He further promised to keep the property in good condition,
Code Enforcement Officer Betty McMinamen told the Board that the property was now
in compliance with the City Code.

David Outlaw made a motion that the amount of the lien be reduced to $250.00. Alvin
Schein seconded the motion. The vote was unanimous in favor of the reduced fine.
Thomas Smail asked for an extension on cases that have already been processed and
were not on tonight's agenda.
Betty McMinamen explained why the lien date on those cases should not be extended
at this time.
City Attorney Robert Guthrie said that the Board could hear Mr. Smails request to
extend the lien dates on his other cases, or they could opt to hear his request next
month.
David Outlaw suggested tabling this discussion until the end of this meeting, and the
Board agreed.
CASE NO. 03-70 and CASE NO. 03-71 have complied and therefore are removed from
the agenda.
CASE NO. 03-76 Church of Our Lord Jesus Christ of The

CASE NO. 03-77
Church of Our Lord Jesus Christ of The
Apostolic Faith, Inc.

Clermont, FL 34711
VIOLATION: City of Clermont Code of Ordinances No. 249-C, Chapter 14, Section 24-
76(12). Unsafe Building Due To Lack of Maintenance.
Pastor Daryl Forehand, 1012 Disston Avenue, Clermont, FL 34711 was sworn in and
told the Board that the church has paid the demolition company to demolish the building
on Lot 3, Block 3. He said they were waiting for the demolition company to set the date
• they would be able to do the job, but that it certainly should be done within the next 30
days.

In the matter of Case No. 03-77 David Outlaw made a motion to extend the lien start
date until January 20, 2004. Alvin Schein seconded the motion. The vote was
unanimous in favor of the motion.
Pastor Forehand asked for additional time to bring the property at 792 E. Montrose St.
up to code.
Code Enforcement Officer Betty McMinamen stated that the respondent would need
time to go through the site review process and then the permitting process. She added
that they have already applied for and been granted a Conditional Use Permit by the
City.
Pastor Forehand added that they are anxious to get the building in shape as quickly as
possible, but thinks they will need at least six (6) more months.
In the matter of Case No. 03-76 David Outlaw made a motion to extend the lien start
• date until June 75. 2004. Alvin Schein seconded the motion. The vote was unanimous
in favor of the motion.
CASE NO. 03-91 Peoples State Bank and Clermont
CASE NO. 03-92 Hospitality Inc.

E. Highway 50, Clermont, Fl_.
Attorney Jimmy D. Crawford who is representing Peoples State Bank and Clermont
Hospitality, Inc. said that his clients were going to ask the City for a variance to allow
this off site sign remain where it is. The variance will not be able to be heard until April
2004. Mr. Crawford asked for an extension of the lien start date to April 20, 2004. He
stated that if the variance is not granted by the City, the sign would be taken down.
Alvin Schein made a motion to extend the lien start date until April 20 2004 Joe
Janusiak seconded the motion. The vote was unanimous to extend the lien start date
The matter of whether to hear the request from Mr. Smail on anon-agenda item was
discussed.
Alvin Shein said he was reluctant to hear a case that was not on the agenda, and one
that Ms. McMinamen had not had the opportunity to prepare.
• David Outlaw expressed the same feeling as did the other members of the Board.

It was decided that Mr. Smail would have to make a request to be heard at the January
20, 2004 meeting of the Code Enforcement Board.
There being no further business, the meeting was adjourned.
